    Legalize fountains, spinners, sparklers then remove the permit requirement for firecrackers and you will see the powerful exploding aerials reduce drastically. You need to give Hawaii easy access to safer fireworks. Otherwise the black market will dictate the type of fireworks sold.

    I remember growing up in Hawaii. Back then we all went to Ala Moana Beach Park to watch aerial fireworks and let the professionals do the fireworks. Now it's out of control and there are so many illegal fireworks.

      The State wanted to take it (fireworks)over 2 years ago - because it comes in via State Harbors.
      Everyone mad when HPD makes arrests - everyone mad when they don’t make arrests!
      I seen the Cops drive up in my neighborhood and all the violators run and hide in their house!

    Every politician in this state needs to look at themselves in the mirror and be honest with themselves... this is hawaii everyone knows everyone... i bet every politician has a family member blowing fireworks... just make the damn thing legal and educate ppl on it and designate a safe zone to pop... we have hundreds of open parks on the islands... wake up hawaii

    Over 300 people died in Hawaii last year alone of drug overdoses. Fireworks are the least of our problems here in Hawaii but in true democrat form they will never let a good disaster go to waste.. this just another way for them to strip us of more rights and traditions!

      All aerials are illegal, but it’s the big “BOOM” type the blew that person’s brain all over the side walk. Also these large ones blew people’s arms and legs off. Watch the video, multiple large explosions were at ground level. There are no “cultural traditions” connected to these mortar type devices.

    Truth is that if you allow it to be imported, people will find ways to get it. Shifting the focus to possession just allows for huge fines to be issued (which means the state makes money). Punishable up to 5 years OR $10,000 judges will not put people in prison, people will get fines.

    You'll never stop this without becoming a police state. The problem with making things illegal is that you destroy all forms of dictating product enhancement (in terms of safety in this case), and the ability to educate the public with knowledge of safe use and handling of these items. Learning to not store your fireworks where something can go wrong and set everything on fire and/or learning how to make a proper stand so your fireworks don't tip over while going off would have prevented this. Having the ability to dictate safe manufacturing methods (so things don't catch on fire too easily from the outside) would have helped a ton too, but why would a manufacturer or smuggler want to bother with these things when the objective is purely to get it past law enforcement and make as much profit as possible?

    1st offense $10K, 2nd offense $50K, 3rd offense $100K and/or forfeiture of house/property. All offenses could include five year jail time too. Now, Firecrackers, sparklers, kids throw on the ground pops should be permissible, as long as it’s kept to under 5 pounds total per household. This way, nothing too crazy can happen. All while allowing Hawaii residence to still celebrate new years.

      Deterrents are ineffective in Hawaii because many people remain unaware of the law or simply do not care. Additionally, punishments are imposed only after the fact. The focus should be on preventing the sale of dangerous items.

    For those of us that wonder where that fireworks ban came from originally, look no further than Marcus Oshiro. In 2010 he sponsored house bill HB1987 without any other law maker supporting it. That year, one of his top donors was the Consumer Fireworks Safety Association.

    Instead of assigning officers assigned to stop spectators from stopping on freeways, we could have had them patrolling neighborhoods. If we had laws that can allow officers confiscate fireworks (If an officer is sent to investigate a neighbor setting off illegal aerials, but finds fireworks but no permit for it, officers should be able to fine the home owner AND confiscate it). If possession of any illegal fireworks become felony offense, it might help deter people from buying it. We should monopolize on the results of this very unfortunate Aliamanu incident to use its momentum to pass laws, and procedures to help officers in keeping our neighborhoods safer, by keeping illegal explosives out of them. Find ways to help streamline and eliminate red tape to aid our officers, and keep us all safe.

    A one-year moratorium on all fireworks permits and related consumer activity would be a practical way to put a pause on fireworks use by the public, leaving it to the professionals through govt and private displays only.
    This could be a way for the community to heal and find solutions together for the use of fireworks in Hawai’i moving forward. This pause can perhaps be in honor of those who lost their lives and the friends, families, and neighbors who suffered as well. Those who vehemently oppose a moratorium may be those who actually profit off of illegals.
    Something to think about.

    Use drones to identify those who are setting off the illegal fireworks, and send police directly to those homes. Find those who are participating. This can also include drones with facial recognition, and cross reference the department of licensing data based to locate and fine those participating.

      That’s actually a good idea. You don’t need thousands just enough to get started. Once the word gets out that people are being prosecuted, you will see a decrease in these illegal fireworks. Once the target source has been located, send in unmarked vehicles and under officers to issue the citations or make the arrests.

    I can see homeowners insurance going up. Insurances will look at Hawaii as a risk with illegal fireworks. Just like Maui after the fires, when time for renewal, either your insurance will drop u or moved u to a new company with high rates. It affected the whole island. Didn’t affect just 1 family but the whole State!! 🤦🏻‍♀️🙃

Geeze, they can come up with citing the owner of the car, and not the actual driver, for violating the law from a picture. They can arrest someone for having drug paraphernalia. And it took them this long to figure out that if you have illegal fireworks they can arrest you, huh? Those law makers move real slow on this kind of stuff.     Literally fireworks wasn’t as bad as it is now when I was a kid cause back then fountains and stuff was still legal. After the ban it got way worse. You guys like one solution, try making fountains and ground bloomers and stuff legal again! Should go down for sure. Not all the way but better than what it is now.

    Failure to control the illegal import of the Ariels . I was a kid of the 70s here and we had fire crackers and some minor stuff like jumping Jack's and somme small rockets, sparklers but not this professional grades Ariel stuff that should only be done by authorized permitted shows. You see how deadly those are ,point upwards , but point lateral and they can be deadly weapons. Permits for firecrackers and minor stuff like sparklers , jumping Jack's are good, but the Ariels should not be available to un permitted people. Problem is in inability to control the import of the illegal, which makes you imagine beyond fireworks that they can smuggle in illegal firearms, military grade weapons , illegal drugs and narcotics. I'm just an observer I haven't did fireworks since the 70s and 80s , so the Cultural or traditional claim is relatively new cause we weren't doing those ariels back in the day. With the amount they are doing these types of tragedies are inevitable, I worry about damage and injury to people, pets houses , cars etc.

    Illegal or banned? Or. Illegal cause its banned?
    Hawaii needs to regulate it. Give the people what they want make all consumer fireworks legal like other states. I understand yes leave the pro stuff to licensed professionals. (Lots of ariels are consumer grade for those that dont know) Put a 100% greedy state tax on fireworks and make your money. Make people take a safety class and get a certificate of completion like hunter education. Teach people the proper ways and safe handling and only then you are able to buy fireworks with a certificate of completion. You do it for hunting.
    Enforce it to only New Years since thats when Hawaii does it big. If you get caught outside that time you get a fine or time or something.
    When you use or are around people that use fireworks you know the risk involved. Life is full of risk. You take a risk everyday in life walking outside your house, walking around the block, driving your car, going to the beach.
    They all have risk and you know that. What are you gonna do banned driving or going to the beach? How many people die or get hurt driving or in the ocean every year?

      3 days into the New Year. How many traffic deaths/injures? Life is a risk. If you dont like fireworks stay away from it. Dont hate on it.

    Wow, talk about an absurd and ultimately worthless policy. You have to stop it at the port. That’s the only way you solve this problem. Cut off the supply. It should be relatively easy since it’s a damned island chain and the only way things get there is via the ports, except apparently the longshoreman’s union has the state government by the balls.

    we didnt need a hpd major to predict this happening. hpd does not enforce the fireworks law so it was gona happen because of no enforcement. the reason for this should be the big question. this enforcement should be given to another department.

      Its because the violators all run into their houses and hide when the Cops come. And Judges are soft on sentencing after spending all that effort on an arrest! Its a waste of time if the violators walk after paying a $50. Fine.

    That was a tragedy, but my question is: if that tragedy happened just before midnight on New Year's eve, why were there no other fireworks going off? The whole island is lit up "just before midnight". This whole story seems more suspicious to me than the illegal fireworks.

    Police expect the citizens to investigate their neighbors and seem consider calls about illegal fireworks to be a nuisance. I’ve called many times during my six years on O’ahu, provided audio and video, and offered insight as to a main supply source but 🤷‍♀️.

      Here in Las Vegas you can report your neighbors with illegal fireworks anonymously. They are recently using drones to catch illegal fireworks because they don't have enough police to arrest them. Fireworks are illegal in our gated community but there are still sporadic and illegal fireworks in other neighborhoods

    This approach sucks. While I hate fireworks, I know people love them. Re-legalize aerials, but clearly DEFINE and ENFORCE a culture of safety and accountability. Like with guns, private users of fireworks should obtain licenses which require safety, knowledge of laws (both criminal AND civil), etc.
    That way authorities have more credibility and BROAD public support when they declare “open season” on swinging a BIG hammer down on ANYone “doing their own thing”. There will NOW be a legion of private citizens who worked HARD to enjoy what is a freedom handled with responsibility.
