Hi, I am seeking clarity on the arm's length situation. I own an incorporated business which pays (the only employee) me a steady bi-weekly salary which is over the 20K threshold (I qualify on all other grounds). I called the CRA and explained my situation, and they said that my salary was eligible.... however, I have a speech impediment and was not sure that the agent understood fully... so I am trying to triple check before I make a serious mistake. Any advice?

    Thank you for the video,
What if business is operational since long ago, but payroll account was created just now?

It doesn't seem like the business would qualify under the Payroll Stream. Perhaps Non-deferrable Expense Stream is a better option.

Did you get a definite answer to this question?

The Government has not yet announced the process of securing the additional $20K. I will post the information once it becomes available.

Please do a video on the newest regulation for Ontario 364/20 under General Compliance. Specifically when it is necessary to wear a mask in the workplace and when it is NOT necessary to wear a mask. I work in an area that meets the requirements for not wearing a mask (do not deal with the public AND can maintain a distance of 2 metres) and yet I m still forced to wear a mask. What rights do I have when my employer disregards the regulation? Mr. Galati says an employer cannot trump the regulation. My employer says otherwise. Who is right under the law? Anyone, please help me here!!

Your employer can not force you. You may remove.
If they harrass or fire you you will have an easy case to win in court.

@@Duckster8769 Actually, they have already written me up for pulling my face mask down. Had to breathe. I manhandle heavy windows for loading on a truck. Got caught walking off the trailer with my face mask pulled down and got written up with a threat of dismissal if I do it again. No one was around me. I have appealed to my union rep who says if I don’t like it, quit. What bullshit! I’m just trying to find out if I have any legal grounds here. Who reigns supreme, my employer or the company I work for. Need to know what my rights are before I file a grievance.

@@janetbaldock3425 Sue for civil rights violations. Many of them to be had here. Look up the Canadian Charter of Rights and Freedoms.

@@janetbaldock3425 All contracts are voluntary. An employer could ask a new employee to abide by a rule given he is made aware of the rule prior to contracting. If you were employed before the rule you cannot be forced into the contract adter the fact without renegotiating. You have the upper hand. Depending on your length of employment could determine how strong that hand is. As for union rep ge should ve fired and you can sue for dues at a minimum for failure to work for you. Again they are under voluntary contract to protect you.
My advice record and log every interaction and all harrassment. See a doc get a note stating you are exempt. Does not have to list condition. Present it with grievance to union and management. I would also cite facts that despute the cv narrative and the many studies that show that prolonged mask wearing is hazzardous especially with preconditions and let them know they would be liable extra more so if they failed to do due diligence on dangers before mandating a mask and demand they provide proof of the virus by scientific data and wet signature of a gold standard isolatiin of said virus in the wild.

@@Duckster8769 First of all, thank you for replying. Tried getting a doctor’s exemption, but the prick would not do it. Have been with the company for almost 5 years so the masking was not a condition of employment. I have contacted the Union and they are basically saying tough shit. I threatened filing a grievance and they outright said they would not accept it. I am thinking of approaching a law firm to see how much it would cost me to have them give me a definitive answer about whether or not a private company can overrule the Ontario Regulation. If I had that in my back pocket, then I could have the law firm write a letter to the company stating what is the law. AND THAT is essentially my problem. Where can I find that piece of law that says who has the right. Me or the company? I need to see that in black and white.
