  • Many people leave it too late and don’t take the right steps to protect their assets and possessions when they die.
    What happens in Pattaya when you die and you are not protected! How are your possession and moey etc distributed to your loved ones. Who can claim against your Will and try to get money and assets maybe you don’t want them to have?

    The advice I was given by a lawyer in Thailand was that you should have a will in your own country to cover assets held in that country and a separate will in Thailand to cover any assets held in Thailand. My lawyer in Australia also agreed with this advice.

    I'm not a lawyer, and whatever anyone does is up to them. 🙂 I do have a Thai will, and one of the other things I have done is create a Google document that lists out where all my assets are, what my pension account numbers are, where my bank accounts are, etc. I have listed out everything I think someone ought to know after my demise to finalize out my stuff. That document is shared (but not editable) with a trusted friend within Thailand, and a lawyer friend back in the US. My past experience was my father dying. He handled everything, so when he passed, my mother didn't have any idea where anything was. So in addition to her husband passing, she had to figure out all the financial issues starting from scratch. I didn't want to do that to whoever I leave behind, so I've taken the time to list all that information out, and put it in a location that can be accessed after my departure.

    Most interesting video I've ever seen about if we die living abroad. Great video Trev a topic few people ever think of is taking our last breath. My self been a coffin maker my own death does not bother me. Would just rather be not there when it happens. Where ever there is a begining in life they had to be an end.

    Not a lawyer. But if you are from England, if you have no will your estate goes through the family chain (your wife and dependents, then your parents, brothers/sisters, their children etc) and if none to the government. In particular, your girlfriend, other friends get nothing.

    Your questions were very valid and would apply to many expats living in Thailand.
    That guy was not good at answering your questions, clearly.
    I have Thai will for my Thai possessions, and separate will for my properties owned in NZ and Australia.
    Magna Carts law, in Pattaya, is very efficient for this type of thing.

    If your in the jungle and die, your belongings are shared with all ,your burnt on a wood fire, and your girlfriend still uses your ATM card to clear your bank and while any pensions are paid into that accout 😮😮😮😮

    Good video Trev and yeah having a will is a must. Point to note, i was told by my solicitor in UK that my will there was useless and of no use because i was not resident in UK, i was told to get one in Thailand and another one in Middle East as that is where i work.

    Even having a will means very little in Thailand. Everything gets contested, and the law is pathetic and will pretty much side with whoever's paying the most/best lawyer. Speaking from experience with land inheritance... Ms.Mairu's family, and even extended family, are doing everything possible to take her inheritance from her. Even the Land Office has been scared off from surveying the land.

      Very true...when my 2nd wife died unexpected in 2015 we had a savings account in her name with + baht 3 mill - my 1st Thai wife would not give me a divorce unless I paid her millions hence the sole bank account...her Auntie heard about this account + we went to court however I won as the lawyer was on 20% commission for successful award to me whilst Auntie paid baht 10k for her lawyer who was open to a bribe via my lawyer to have the case dismissed due to incorrect paperwork submitted to the Court + the promise of a job with my lawyer's firm in Bangkok...for bank accounts it was statutory that all claims on disputed bank accounts have to be closed within 90 days of the date of death....this was in 2015

      @@boleynphil Absolutely. A will in Thailand is a false peace-of-mind, as far as I'm concerned. It *is* better to have one than not -- you don't want to make it too easy for the vultures -- but just don't count on it.
      However, saying that, I'll be dead, so I won't know how it all went anyway! The main thing, in my personal opinion, is not to let anyone know what's in the will (and ensure the better half understands to keep his/her gob shut!), and keep yourself to yourself. Flaunting wealth in Thailand is a recipe for disaster.

    So notes to date.
    Have will in Thailand.
    Should be signed and witnessed in front of proper officials.
    2. Thailanf has Hierarchical disbursement of assets starting with Wife, Children, etc
    The will can list who gets what amount of what.
    3. Need power of attorney and wills go through courts.
    4.I thought the Thai will was recorded at the local Ampur. I would notify people who will be working with will what location office it is recorded at in the Will

    I lived in Cambodia for many years and saw many expats die there. Relatives coming out to Cambodia to get access to Dad's money in Cambodian banks was a major problem. One scottish guy had always told his Kymer girlfriend he had provided for her in his will and she would get all his assets. He always told her his will was with his possessions back in Scotland. When he died unexpectedly, his relatives in Scotland could not find the will and his khymer girlfriend got nothing. Everything went to his scottish relatives.

    Imagine you die without a will. And some sharpie who knows their way around the legal system contrives to cheat your loved ones. (And there are loads of sharpies who thrive on gaming the system.) A strong will prevents that.

    Great epidode today Trev. I expected the answers that David said to be honest. Everyone should have a will with everything listed. I think it is good to have a list of everything with contact numbers aswell, makes it so much easier to sort. I had to go through tons of paperwork after losing my parents last year to get everything sorted. Give a copy of everything to your mum, wife and kids so they are all on the same page

    In the uk if you suspect someone that has died jas life insurance you just need basic information there are websites that can find insurance policies for you easy peasy

    That living will just sounds like a lawyers sales pitch. Most farang have health insurance that would cover this ,right ? And there are so many relationships with thai women that many farang can't trust her or discuss these things.

    If your family are in another country and you want be taken back to that country be aware of the costs. We had to pay £8,000 for a family body to be returned home, let alone the mortuary and legal fees. So be insured.

Trevor that was not morbid at all that was very good advice and infos if you want to live in Thailand and not have any problem it's a must to do so your family will know what to do and if you are married your Thai wife will know to that was awesome Trevor. Me in Chateauguay Quebec Canada i did that when i get married the live and the last will . Just like many Judges would walk out of Courts as they could not deal with having lied for their Oaths in an illegal Admin Court, they would simply oblige the transfer of the Bill OR reject it by the Company concerned. So some do, some don't. It may rack up the debt on your afterlife... that to these ppl using it for a free life are not bothered by this as they may not by this time have assets... no property nor car. I mean, even a car may be ample to pay off such debt by death. Regardless how we use this, it is Lawful and how our hidden debts are totalled. They may get written off. The Legal aspect of this is too deep for the system to comprehend.

    Gday T yeh this was one of ya best mate. Alot of very useful info thanks Dave. My will in Oz is sorted so if l croak in Buzzin Lounge chasing one of the Buzzettes the Aussie embassy will be notified and my kids will share my estate. I think a will in Thailand is as important as health insurance lMHO. 795 Baht is a no brainer.

    If you pass without a will, then you are subject to govt laws which could be a disaster. You should have a Will & trust, so get an atty to draft one up!!

    Another point is not only making a will you need to go to the land office and get an agreement between you and your wife if she dies before me I can stay in the house until I die or I have one year to sell it and move on or if I die the house is left 50 50 with her son and grandaughter

    I just set it up if I die my brother who is my only living relative can just simply transfer all my money from my bank here back to my account in the U.S. I would never own property here so it is pretty simple for me as far as clothes just give them to charity

    I don't have a will at this time, but I do have an agreement between my Thai girlfriend ( lived together for 8 years), and my eldest daughter in England ( which my other two children have given consent too), that whatever I have in Thailand, goes to my Thai girlfriend ( house,Thai bank account and all house contents). Whatever is in my English accounts and my civil service pension ( paid for two years after my passing), will go to my Eldest daughter to provide for my two only grandchildren. I would like to know how much this legal firm will charge me to put everything in place? This has been discussed between myelf, my Thai girlfriend and my 3 children, just need it made legal.

    Good subject Trev, my best mate died at the young age of 51 in Oz. It has made us all here think about setting up a will. As my mate supposedly didn’t have a will and it had to go to probate, (his brother in law admitted that she was emailed it 3 years ago and lost it), so his ungrateful family will get. I’ll have to start the process here and in Thailand as I’m looking at building a house in Thailand and also looking at buying some land in my new born sons name, in Oz d be worried that someone would take advantage of her. Everything will hopefully go to her and she can distribute it accordingly with her children.
    With Thai legal protection will their will be recognised overseas?

    Nothing much all depends on your circumstances.
    If you have a uk will or where your from nothing in Thailand will happen if you have no accets i drip feed my thai bank account with funds and its a myth that you can only get a bank account in Thailand only with a visa crap or residency.
    I have a thai bank account in Thailand i dont have a visa or residency rhe facts are people you can get alot of information from xpats that are living like xpats and not like native then the information olis fldiffrent and more accurate

      It's too expensive.
      You need to be cremated in Thailand.
      A friend of mine passed away in pattaya from Australia & it would cost 80k aud to return the whole body.
      Service in Thailand was 15 k Thai baht

      Go to the land office and get a written agreement with you and your wife that says if she dies before you you can stay in the home until you die and they can't do anything to you and you get one year to sell it and move on if you want to or stay there until you die

      Remember if she dies and you are on a marriage visa that visa is then cancelled on the date of death.

      It'll mean sweet F.A. in Thailand. Even a will in Thailand won't guarantee anything. The old saying goes, don't invest anything in Thailand you're not prepared to lose. Make a will to your missus (or mister, if that's your thing), but don't count on it being honoured. Whatever you do leave in Thailand, particularly anything in a bank, is staying in Thailand, that's for sure!

      @@Buzzinpattaya true and your loved ones or family collect your ashes and apparently include some bones , because I read just yesterday that the fires they have are not hot enough to turn all of the bones in to ash , they are supplied in a white canvass bag then I assume you will be cast into the Mekong or thrown into the sea or forest maybe even sent back to your home land.
