If it's already trademarked, there is little this person can do. And like another person said, it takes years... most likely millions. I think Taco Bell was the only one to successfully challenge another company's copyright regarding the "Taco Tuesdays" trademark.Taco John held it for years.
Believe it or not social media presence can help fight a copyright claim. As long as you can prove you are the originator. I think it's something about intent/malice.

I'm sorry but it should be illegal to trademark someone elses creativity. Its disgusting that people with money can steal someone elses creativity just because they have the money to file legal paperwork. There should be some sort of time frame allotted for the original creator to file legal paperwork for their work before it can be snatched away like that.

The Bates person is well known for doing this because he also filed to trademark a phrase used by Russell Wilson & phrases regarding the Denver Broncos. He currently has other applications pending for various trademarks. It can take up to a year to even get approved. Jools can start selling Merch with the phrase, file application but needs to be aware of Bates doesn’t abandoned this application like previous that they could end up on court. Jools can prove he is the one who got the word popular. He shouldn’t have deleted this tiktok video, a judge would most likely rule in his favor it’s just a risk and will cost.

Key word is “Filed” and “Approved “ are two different things. The trademark application has been filed. Has it been approved is the question. Until it has been approved. All the information she seeks can be found on the USPTO Website.

The thing is Selyna.Brillare came out and said they started it. Had videos of it being said (probably a year ago) and Jools follows the person. And when confronted about it Jools said why didnt the other Selyna just call so they could work on something together for T girls instead of going to the internet. Never denied taking it. Not a lawyer - if there is a lawyer in here correct me if I’m wrong but I don’t think she’ll be able to use it for merch. She would have to advertise and market at some point and the trademark covers exactly that. She may be able to challenge the trademark.

I think he meant resources as in fees for the trademark and merch. Someone else made a point that you can argue and prove you used it first but that's even more money. You also have to look at if you'll use it in other countries etc. Look at celebrities. They trademark their kids names b4 they're born. Didn't Beyonce lose her right to trademark her daughter's name cuz a store was already in operation with that name before her? It's tough when ur not in business or the industry.
