    In Florida you can fish around the oyster farm but you have to stay outside the marked boundary. That's according to the state law.

    That dude is a pecker head! I had a run in with him the day he was putting up that sign! He tried to tell me to get out until I told him that I was going to call my marine patrol friend and tell him I was being harassed! Then he changed his tune and said to please not hook or cut his ropes, lol! Lets ALL go fish it Friday! Need about 20 boats!

      The Coast Guard requires Triangle Reflective signs every few feet and a Navigational Lights marking his cages . I dont see any of that here, If someone hit that warning sighn and got a scratch they could own his house and cages etc. etc . i have heard of boats hitting things and trowing people out of the boat. and the boat just ran in circles hitting things and bouncing off of for an hour.

    Welcome to LA in AL. Water access rights consider that private property in LA and you will get run off at gunpoint vice being asked to leave. It’s crazy

    In live in NC. If you can access it on a boat, you can fish it. Tell dude to kick rocks in flip flops with no socks! Metal blade in a zawall will hook that sign pole up too

      Not to mention, oyster season is from October to March. It's August. Maybe he thinks he owns what he can see and laws only apply to others. I would like to know what the marine fisheries patrol has to say. If he interferes with you, he maybe breaking a state law. I know you can't interfere with anyone while they are hunting in NC. Either way putting him on RUclips will make him a neighborhood topic, he will surely love you next week 🤣

    Hey nate coming from st.bernard parish louisiana i fish oyster leases year round for big triple tail and slot reds nobody says anything. Come make a trip to hopedale, La and fish MRGO and get on some bass, flounder, slots, & 23+ trout all day.

    I fished those same exact pot last Sept while they were emptying them and they didn't say a word to me. I don't recall seeing that sign at the time either.

    I've lived and fished in Alabama the last 22 years . . specifically south Baldwin county . . If the body of water experiences any tidal flow, even if it's a creek/stream . . then, that land/water from the median tide line out resides in the "Public Trust" of Alabama . . I could name off a dozen places between where you were on Fort Morgan and Orange beach where private land owners/leasers think they own the water or the land around tidal areas - be it right off the beach, or back in the marsh . . Bottom line, it's "Public" water there!

    It MAY be a "Private Beach" but the Idiot doesn't own the water. No matter whether it's on a Lake, Bay, or Gulf....It doesn't work like that. It's more like his traps/cages are a Hazard to the Public. Like I've told them "Call the Coast Guard or Game Warden! If you don't, I will and have Harassment of a Fisherman Charges put on you!". Him coming out there and trying to start crap would be no different than a Jetski operator coming really close to you and trying to Jack with you.

    I have fished oyster leases in NC with no issues. There was one instance where I was fishing anew area and I actually asked an oyster farmer where the trout were.. he replied.. all around my oyster pots. He proceeded to tell me the most likely spots to get them around his pots and simply asked that I fish respectfully and not mess up his pots and wished me luck! Great mutual interaction.
    I did a lil digging and here is an excerpt from a legal forum on this topic from an NC standpoint: “ Oyster growers in North Carolina who want to develop or expand their businesses must lease tracts of water and pay annual fees to the state. In addition, these leases are subject to inspection by government entities. Growers cannot own the area outright because leased- water rights for oyster aquaculture are subject to the Public Trust Doctrine. This legal doctrine holds that no person shall own the navigable bodies of water of the United States, as well as any beachfront sand (either up to the mean high-water mark or mean low-water mark). Instead of individual ownership, these waters are held in trust by the federal and state governments for use by the public. North Carolina defines public trust rights as “rights held in trust by the State for the use and benefit of the people of the state in common”

    Actually fished this spot a few weeks back. He did the same thing honked and yelled. I paid him no mind. Made it to the back side of the bed and he walks out into the water towards my boat. He tried to get close enough to get on lol. Told me I couldn’t fish inside the pvc poles he had in the water. I continued fishing it.

    Screw that guy! So many people think they own the water around docks, oyster beds, etc. Not unless the sign says it's an official state project or something like that, keep on fishing. You can still be respectful of his pots but continue to do your thing too!

    You Cant Farm Oysters there i guess . Thats probably Unconstitutional for that. But the Only Law issue i see is the Guy doesnt have the Required triangle sighns required to keep boats from hitting a cage and throwing someone out of a boat. The Coast Guard is pretty clear about how many feet apart the Triangle reflective sighns reqired. Thats the only law infraction going on here. This guy is actually doing a good job providing cover for fish . Hes not going to do Squat growing Oysters im afraid . You Cant change Water pollution with a oyster farm . But they did put a Sewerage system along the coast in Mobile CO. . Where instad of peoples septic tank field lines draining into the bay at least some detergents will be drained in the soil a little further inland.

    Wow ,, I would have kept fishing also , then checked with law enforcement or called them on my cell phone ,,
    I know Louisiana has something going on with some navigateable waters ,, but that’s not the same with what’s going on here ,,
    I am more concerned with that drive breaking again 😩 was it the belt breaking again ,, kinda need to know more about what broke ,,
    If it was a rubber part ,, I guess that will happen ,, you do use your kayak more than most ,, that being said ,, do you think it lasted way longer this time than last time ,, rubber part or not ?

    Check with the fish and game dept there. I know this has come up in fresh water before. I always thought that property owners did own the river bottom half way to the other bank but not the water. I learned after checking into it that in some states they own navigable water too. This happened in the south but I don't remember what states though. I want to say it's Alabama but I'm not really sure since it happened so many years ago. I would highly suggest asking any Game Warden that you know because they'll know for sure. There are some strange laws on the books and they differ from state to state. We've all heard that navigable water isn't owned by any person but in some states it actually is. I was shocked when I learned this! Here in Texas we have strong personal property laws but navigable water isn't one of them. As long as you don't set foot on the land owner's property to get on the water then the land owner can't keep you off of it. But that's Texas and you weren't fishing here. Contact Fish and Game so this doesn't become an issue in the future. That would be my suggestion, anyway.

    I definitely agree, the water should be open and free to fish. Unless his permit is thru the state or federal and states otherwise, then he can't control the waters of fishing.
    BUT.. I do understand his anger at some points, like dock owners, because there are many anglers who are not respectful and would have no problem breaking off a hook in one of the ropes without trying to get it back. Unfortunately it hurts all of us when the few jerks do not respect other's property.
    In short, I would definitely keep fishing until I found out that I was in the wrong for sure.

      Absolutely, I talked to Marine Police and they stated that as long as wasn’t damaging or interrupting the work I could fish wherever I want around there.

    i mean this with no disrepsect but I honestly I think you were in the wrong. The reasons being in some states lease out the land thats underwater for clam and oyster farming. On top of that these leases on the land DO NOT COME UP FOR SALE NOT VERY OFTEN. Well yes they don't own the water but they do have their clams and oyster beds growing on their land.

    Hello brother man you didn't do nothing wrong in my books. He does not own that body of water. That body of water does not look like a pond. But if the sign did not say who owned that body of water and why you had to stay off of it I would have kept on fishing and you can just call the police if you want me to move cuz you was not doing nothing wrong. You didn't touch or bother any of his stuff. Good video brother thank you for sharing.

    On the “LAND” issue, he owns or leases the bottom, NOT navigable waters, KNOW your RIGHTS! Without that TIDAL water coming in and out his oysters would NOT mature, oyster need the trash in the water to grow, they will not grow in a stagnant pond. NOBODY owns TIDAL waters, if there is a variation in tidal movement, that’s PROOF in its self that the water keeps moving, bringing fish and crustaceans in and out the area. Commercial people, regardless of “INDUSTRY” on the WATER, my experience has been, ‘THEY’ think they HAVE more RIGHTS to the water bc of their profession and HOW they make their living, I ALWAYS have something for those A-holes.

    Nah, you weren’t out of line. If anything you were respectful of the area by not weaving in and out of the pots.
    I would have told the guy throwing the hissy fit nothing, but kept on ignoring him. I would not have left the area. In doing so, he feels he won the round. Let the Marine patrol show up, if they do at all. If you’re in the wrong, you’ll get a free education and no citation.

    I feel your un the right until some sort of a LEO tells you otherwise. Navigatable waterways are public waters ways in MOST instances with exception on case by case basis which is, as you mentions, goverment/state regulated and should be posted as such.

      If the guy cursing him from the bank doesnt have the required Navigation reflective signs and someone was to hit one of his cages or hit his warning sign , say running thru there at night , they could own the cages and the guys house etc, etc. and the probably had a electonic truck he got down there with. he might have electric boat too.

    Here in FL you would be in the wrong. While no one “owns” the water, they can sure lease the land which gives (here’s the exact wording FL uses) “the lessees shall enjoy the exclusive use of the lands” They applied, paid for studies and surveys, paid all kinds fees to be able to use that land and grow oysters, and they deserve the rights that they paid for. Not sure why it’s difficult to understand. I have the opposite approach- I encourage more oyster growing plots- it cleans the water and provides habitat, and it’s not a government subsidized project but a private enterprise trying to provide us with oysters. I can certainly find a different spot to fish.

    From my understanding of the laws where I live if it’s accessible from public waters and your in ankle deep waters or on a boat then it’s public and can’t be posted same goes for duck blinds built in public waters don’t matter if you paid for the lumber it’s now public. So I would just keep fishing and if it became a problem have the wildlife commission come and sort it out. It never fails though there’s always that guy who thinks since his property butts up to the water he can claim half the bay
