you have a misunderstanding of how things work. criminal law requires beyond a shadow of a doubt to have consequences. Civil law has a lower standard, a preponderance of evidence, which basically means there is a more than 50% chance they are guilty of the act, and there were damages to the victim as a result. sexual assault often is difficult to prosecute at the "beyond a reasonable doubt" standard so they can have enough evidence to say they highly likely committed the act but not definitely basically.
