Metropolitan Police officer found guilty of assault for manhandling woman on bus

  • A Metropolitan Police officer who “manhandled” and wrongly arrested a woman for bus fare evasion in front of her young son has been found guilty of assault.
    Pc Perry Lathwood, 50, of Norman’s Bay, East Sussex, grabbed Jocelyn Agyemang by the arm, causing bruising injuries during the arrest on July 21 last year in Whitehorse Road, Croydon, south London.
    Ms Agyemang was dropping her son off at her mother’s house before heading to an appointment in Marylebone scheduled for 12.30pm.
    Police officers were helping ticket inspectors on a bus in Croydon at the time.
    After she and her son disembarked the bus at around 11am, she was asked to show she had paid her fare by a bus inspector.
    At Westminster Magistrates’ Court, Deputy Senior District Judge Tan Ikram ruled it was “not necessary” for Lathwood to “grab the woman’s arm, arrest her and handcuff her”.
    The police watchdog said it will now liaise with the force to progress disciplinary proceedings for the officer.
    Lathwood, who is attached to the Metropolitan Police’s Road Traffic Policing Command, will be sentenced at the same court on June 14.

      @@davidboat8467glad I’m not the only one who knows and noticed this! I can’t believe they ganged up on her knowing she has a kid… poor kid was worried his mom was gonna be taken away. I find it incredibly cruel for police to behave in that manner especially infront of a child and a parent 😔

    Back in the 80's myself and three friends were returning home after a night out on the town. We made our way to an underground subway that took us to the other side of some train tracks. As we exited the subway we were met by a police van and about 6 officers, including a police dog. They immediately pounced on us. There wasn't any explanation, but I was thrown against a wall, then thrown to the floor and handcuffed. During this time I had bitten my tongue so bad it was bleeding, I was so angry because we had literally done nothing wrong. We were taken to the police station and as we were escorted to the cells I was telling the officer that had thrown me to the ground I was going to sue him for assault. He just laughed and said "That's not assault" but then as he led me through a doorway, handcuffed, he violently shoved me against the doorpost and simply said "Oops, mind the door"! They said we had caused some commotion at a Kebab Takeaway, but none of us had been there and we were simply making our way home. The following morning we were all released with a "Police Warning" for being drunk and disorderly. The arresting officers weren't present and we never saw them again. Since then I have never trusted or had faith in the Metropolitan Police. I'm so thankful that these days so much of their thuggery is caught on camera

      I had always disliked the police they are on a power trip mostly and do not handle true crimes rather they waste their times on petty ordeals. Now being a police is nothing they are slow, stupid and incompetent and these are the people who are meant to uphold the law whom do not follow it themselves. Also, they do not catch thieves who are on the lose more and more robberies occur now in daylight the law is almost non-existent. If you beat up a criminal it is assault even if they are the ones committing a crime you will be thrown in the cell for "assaulting" them. My personal belief is if you are robbing someone you have thrown away you rights whatever happens next if you get kicked, thrown or attacked is your own fault and the police should not defend you.

      With all respect, policing in the 80's is very different to today. Policing nowadays isn't the same as it was back then. I don't understand what the officer in this situation is meant to do?
      If the police officer does not do his job properly - the public complain. The fare paying passengers may well complain and he will be investigated.
      So he asks to see the ticket and she does not show it to him, there is some suggestion to him that she has not paid for her ticket, and is now attempting to walk off.... so in order to prevent that he arrests her.
      Now he is found guilty of assault and will lose his job as a result??? What's he supposed to do in that situation?
      If he allows her to walk off everyone would complain he didn't do his job (as it wouldn't come to light that she had in fact bought a ticket) and if someone complained he would be investigated....
      I don't know why she didn't just show a ticket.... it literally takes seconds and avoids a whole scene like this. How people think they have the right to get on some form of transport, not show a ticket and that nobody should be allowed to escort them off or deal with them is beyond me...
      Do you think a passenger getting on a plane without a ticket would just be let on their way.... ?

      It is not only the metropolitan police they're like that all over the country, and they are supplied with the cheapest bodycams because its amazing how often there turns out to be no footage.

      @@WS-ij1fu The bodycams are supplied by Axon. They work well enough but aren't brilliant.
      Contrary to popular belief the footage can't be deleted by an officer. A camera gets "docked" and charges up and whilst it's charging it uploads the footage to the cloud. When officers/supervisors want to view the footage or to use it evidentially they login to a website and can view it and download the clips.
      Clips that are "Saved" for evidential purposes are retained for 6 years I believe it is.
      Any clip not categorised as "evidence" remains there for 30 days and is then automatically deleted as I understand... no doubt people will tell me i'm wrong (i'm not) but there is no "delete" button on any of the footage that anyone can click on, you simply have to wait 30 days.
      Sometimes in a violent struggle where you are using perhaps two hands, you aren't able to activate the recording on your camera, as this requires a hand.
      The cameras are usually on "buffer mode" so they basically record 1 minute prior to the camera button being activated but without audio - this is why the first part of the clip has no sound - because the "buffer" part has no audio. Once the camera is set to record by the officer or a colleague it starts recording audio as well.
      Sometimes the batteries in a camera don't last a whole shift, especially if it's a 14-18 hour shift.

      Are you even aware of the facts and all that happened on the bus before it got to the road?! If you are - then God have mercy on you for what you wrote! If you think this was okay, then I hope the same happens to you! because sometimes that is the only way people learn to have compassion. What happened on the bus was unfair! now THIS?! Highly unfair.
      What has happened to having simple humanity?
      I pray she and her child receive Healing for the trauma and shock!
      All that happened there should not have happened and could or should have been handled differently and WITH COMPASSION! Hope you get some! I wonder if you would say the same if that were your daughter, sister, wife, family member of friend.

      By the way - I am a qualified Lawyer myself - I am glad the Courts came to the right decision. Normally our Courts are always criticised but thankfully the Courts saw through it all. Hope one day, you have that approach as well to your fellow man/woman.
      Yes we are all taught to respect the man/woman in uniform but it also goes both ways. They are meant to serve the community not this...It saddens me and you should feel the same way and don't wait until the same happens to you or someone close to you, before you realise that what all of us observed was unfair. As for the Bus Conductor - I hope she feels bad when she sees all that she caused - she could have handled it differently and it would NEVER have escalated to this

All she had to do was show the ticket or card which she is required to do so by law, when asked by the revenue inspection officers. She made something out of nothing. I'm surprised she didn't pull the race card. The officers were actually cleared.

    See when my son and his mates got robbed at knife point, with 100s of witnesses and CCTV the police didn't even bother to turn up. Yet an army turn up for bus fair. Same as if someone's evicted, there's something very wrong with our country. These police should be sacked, I cannot believe what they did in front of the poor woman's child

      One wonders if the officers dare to give the same treatment to a bloke. All these officers are quick to response for light incidents for their target quota.       Also, there is STILL grey area in the court system...it gets confusing on public transport networks, but (depending on POV) fare evasion is a civil matter.
      If someone is using a service they claim to have paid for, and the supplier claims they have not paid for...

      Get your facts right. They didn't swarm the bus. In certain parts of London, the dishonest practice of ticket evasion is very high (and affects the price you and I have to pay for a ticket). Sadly, ticket inspectors doing their job quite often get abused and assaulted, so in certain areas police are needed for support. In most instances, their presence is enough for most people to do the right thing and show their ticket, even if they haven't paid most will own up. It was a normal situation where this lady was asked to show her ticket so that it could be verified that she had paid for her journey. It would only have taken a matter of seconds and she would have been on her but she walked away and ignored the collector and police despite repeated requests to comply. She could have shown her child an example of being civil and law abiding but instead acted suspiciously by trying to walk away as though she was above the law; she then escalated the situation by using raising her voice, creating a scene and using her child as an excuse all because she wouldn't show her ticket when asked (which is what numerous other passengers would have cooperatively been doing before her). Moral of the story: when given a normal, simple request, cooperate instead of making a mountain out of a molehill and trying to turn it into fictional 'police brutality'. If the policeman hadn't touched her she would have continued to walk away, is he supposed to allow anyone who refuses to comply to merely walk away do just that? How was he or the ticket collector/inspector supposed to know that she had a valued ticket if she wouldn't answer their simple question or allow them to check her ticket?

    To all those people that defend that unstable mother, saying that she paid the ticket, I remember that she refused to show it. Refusing to show the tickets is the same to don’t pay it. She tried to walk away from a police officer. An honest person cooperate with a police officer. This sentence is disturbing.

    She was already off the bus when she was approached and asked for her ticket, you only have to show your ticket when actually on the bus. The lady was in the right and did not have to show her pass. Her pass was later checked and she had paid her fare hence she hasnt been charged and the officer involved has been convicted. This could just of easily been your family member and people should remember that when they're defending these types of police officer.

      This is literally how tfl and the police check for tickets now, once you get off the bus, same with trains, the inspectors will wait in the ticket lobby.
      So you are claiming you can just ignore them as you aren't on the mode of transport anymore!?

      @@eyesodd They need to take into account that people have other things to do. You can check people's tickets while on the bus. I would be quite impatient if I was stopped while getting off a bus because most likely I have places to be at a specific time or I have a connection to make and I'll end up missing it while standing around talking to you about something that should have been checked on the bus. It would be like checking my boarding pass after I get off a flight.

    How many shoplifters and crack fiends were probably on that bus on the way to the city to cause distress and rob and steal more than what i earn in a month. And this poor woman gets manhandled over a bus ticket on her way to an appointment in front of her young child this made me feel sick to my stomach.the world is finished.

    I think people are being intentionally dense but here’s me hoping for the best, in beginning you can see her walking away with her child (likely bc its ridiculous for 5 officers to be present for fare evasion), then when cornered by the officer wearing the bodycam we can see her remove her oyster card from her jean jacket pocket 0:07 , then she goes to grab her son and moves her oyster towards the scanner around 0:30 but the shock from the officers arm causes her to be distracted from the scanner and we can hear her distress about being manhandled, then when asked “where’s your card” she says 1:01 “my card is here”, then he starts DRAGGING HER 1:09 till 1:14 by 1:26 she’s on the floor, clearly not being moved on her own will, whilst another officer focuses on her behaviour and her screaming, when his colleague is behaving inappropriately, at 1:37 she’s back up and another officer is trying to deescalate the situation 1:36 , but she is clearly struggling w someone twisting her arm.
    At 2:11 untill 2:17 , i personally start to feel sick, he VERY clearly is mishandling her arm, by this point she has made it very clear that she has an appointment - none of the officers have even attempted asking what for(a common diffusion tactic). at 2:22 her braids are pulled by this officer, if he was genuine about this, her safety(especially for a petty offence) would be prioritised, even if she did commit fare evasion(which the court later proved she didn’t) it would still be well within her right to charge for some form of deliberate assault. by this point 2:33 , she seems exhausted by her own fear response and clearly would prefer if any of the other officers detained her atp, its not about “why am i being arrested” it’s about “ let anyone but him arrest me”. FINALLY at 3:31 someone just forcibly takes her card from her, in my personal opinion that would be the preferred crime - i would rather get judged for taking someone’s belongings by force than get sacked and prosecuted for assaulting a woman (who hasnt even been asked if she has any disabilities mental or physical which may explain why she’s so adamant about not being arrested). Its also at this point where she clearly and calmly states her issues. finally at 4:38 they remove the cuffs and she explicitly states her issues with the officer wearing the cam, then when she moves away from him he calls her a “daft cow” - clearly unprofessional, clearly shows his rudeness, i have no sympathy for him.
    My final analysis, this is clearly an officer that has conformed to his expectations of what an officer should be instead of actually doing his due diligence in making the streets a safer place, the other officers are also a part of this issue - instead of removing the antagonistic officer away from this woman, they proceeded to ask condescending questions like “whats the problem, talk to me” when she has clearly stated that her issue is with HIM. This is a woman who has an appointment for her son (i believe) has to carry his scooter and make sure he comes with her - she’s in a rush but clearly isnt going to dash off like some young teenager, even if she did, she’s SURROUNDED by officers, one of which is holding onto her son - she isn’t going to leave. Officers tend to forget that meeting them, especially in a situation where they can revoke your rights at any moment is a traumatic experience, especially for mena and black people where there is a recent history of abuse and false detainments. officers represent eachother and when one acts like this, it further diminishes the trust the general public has for ALL of them.

      That is a very well constructed analysis of the situation
      I also thought that as the handcuffs were coming off, she had calmed down, as another officer had stepped in, yet as the cuff was released the arresting officer still maintained his firm grip on her causing her to start resisting yet again. Like you're taking the cuff off so why do you still have this need to hold o to me. and then he gave his reason as trying to stop her from moving into the road and followed that up by calling her a daft cow.
      A very badly handled situation all round by the Police Officers.

    A Met Police officer who "manhandled" and wrongly arrested a woman for bus fare evasion has been found guilty of assault.
    Perry Lathwood, 50, of East Sussex, assaulted a woman in front of her young son in Croydon, south London, on 21 July last year.
    Jocelyn Agyemang was dropping her son off at her mother's house when the incident took place.
    Police officers were helping ticket inspectors and after Ms Agyemang got off the bus, she was asked to show she had paid for her journey.
    Ms Agyemang said she told the inspector to walk with her as she was in a hurry. Lathwood then walked over and grabbed her to stop her.
    At Westminster Magistrates' Court, Deputy Senior District Judge Tan Ikram ruled it was "not necessary" for Lathwood to "grab the woman's arm, arrest her and handcuff her".
    He continued: "She was difficult… but there were not reasonable grounds to suggest arrest was necessary.

    The biggest issue I can see, having only seen this for the first time, is really poor communication by the Officer, and at no time does he mention the reason for the arrest. Just saying you're under arrest, twice, minutes apart, with little to no instruction or explanation isn't good enough. Difficult to justify why arrest was necessary or even warranted.
    When watching it a second time, I can barely make out some attempt to caution her, but given this is his body camera, it's shocking that we can barely hear him.

    What are police supposed to do when you have a non compliant person accused of a crime and the police want to confirm whether or not a crime has been committed.
    It seems the more screaming and struggling they do, especially brown skinned suspected offenders, they get compensated for their unruly and loud behaviour.
    Maybe the training the police should get is if the suspect has been accused of or seen to commit an unlawful act, if they shout don’t touch me, leave me alone, the police must immediately release them and walk away.
    Give it a trial, see how that goes.

    This seems normal to me? She isnt providing a ticket and is arguing, shouting, trying to walk away/push through police - her own choices, she ends up detained as a result.
    Someone being "polite" while being held is Plan A for most people so that should largely be ignored & not sympathised with.
    So all i see is an awful example of parenting, her actions have scared her child for life and those scars are the seeds for he himself having issues with the police in later life & theres a cop whose been scape goated due to optics, no wonder people are hesitant to join the police force.
    But the most shocking thing here is the police pressence for a bus ticket meanwhile i can see a dozen crimes a day at my local shopping centre and except for maybe a police car grabbing lunch from maccy d ill never see one.

    She verbally abused the TFL Ticket Inspector who had the audacity of asking to see her ticket. They clearly suspected she had committed the crime of ticket evasion, she wouldn't give details, so they arrested her. Then she decided once she realises she IS going to be arrest, to co-operate... yet the Police Officer is found guilty of Assault. Yep this country is F*CKED! For everyone saying "The Police didn't show up to my petty irritation in the shit hole I live in"... they sure as shit aren't turning up now.

    That poor little lad 😢 This is traumatic for a child to watch. There are some things you don’t do when confronted by police. You don’t start shouting, try to walk off, try to resist. She could’ve just shown the card instead of kicking off and yelling. But it can be difficult for a woman when surrounded and boxed in by men. It’s very intimidating and I wouldn’t blame her for panicking.
    But the officer should not have put his hands on her unless she was being arrested so it is assault. And the poor little boy saw it all.
    Very unprofessional.

    The other officers present now need to be charged too. They stood by and allowed an assault to take place, essentially cooperating with the offence. They could easily have stopped the main offender and moved him away. Thank God they weren't armed police officers.

    First of all, for those who seem to have missed the headline, the officer was found GUILTY of assault.
    Second of all, if you are not under arrest and are not endangering yourself or others, police officers have NO RIGHT to put their hands on you.
    No matter what you feel about the bus ticket, this is an important and fundamental rule of a free and civilised society. We cannot have little thugs going round assaulting people.
    Today it was this woman, another day it could be your wife or child. The laws are there for a reason, don't be so quick to throw them away.

    For clarity, in this particular case the woman had already paid, with the judge stating, "There were not reasonable grounds to suggest arrest was necessary".

      Not strictly true, police have powers to stop and search or stop and account, you can be lawfully“detained” for those purposes and if you attempt to resist police may use reasonable force to prevent you, force used however must be proportionate and necessary, I’m not saying the force used in this case was either of the two for a bus fare inspection

      @@saffire301 the officer only needs reasonable suspicion of a crime to justify a stop and search, a stop and account doesn’t even need that, “May I see your ticket” would be stop and account, you’re not obliged to say anything in this scenario but refusing to show your ticket would give the reasonable suspicion grounds to escalate to stop & search, I.e. search for the ticket, Obviously the force used in this case was unnecessary, I’m not defending the Po-Po but the hysterical reaction of the lady didn’t help her

      his behaviour was appaling too, he lost control of his emotions, which is a no-no, especially if the other part is escalating. it's the job description. you can see the other officers trying to calm him down on the video. if you can't keep your emotions in check during a stressful event like this you can't be an officer sadly. the ability to keep your composure is paramount for any job where you have to interact with the public. it isn't even just a police thing, the service industry is the same.
