      Considering that Mitch McConnell obstructed a Justice appointment for almost a year and then railroaded one through in 2 weeks I think the president could step in remove a Justice and claim Republican obstruction when we were trying to place a judge.

      @@RyanRoberson-gc1op Are you sure? Because a rather clear Constitutional authority that the President has is the power to appoint Supreme Court justices.
      He could quite easily have them all disappeared and appoint new ones, and claim that since the appointing of the new ones fell within his official Presidential duties, disappearing them is close enough that it gets covered by presumptive immunity.

      It's worse than that. What was not addressed by Beau or others about the Chevron decision is that NO government RULE, or REGULATION imposed by the government either via interpretation of a federal law, or in the absence of a law has the force of law, and can be ignored by anyone.
      This means, for instance, that states that don't have laws requiring the use of life preservers/PFDs for anyone of any age, and instead defer to the federal regulation passed down by the Coast Guard are no longer governed by the regulation. Which means some boater in VA or WI can sue the state or feds to get rid of the regulation because they now have standing to do so.
      This is just another bad decision in a string of bad decisions handed down by the most corrupt court to ever sit.

      Authoritarians react badly to even the smallest disagreement. The moment one of the MAGA cult complains about prices, or availability of jobs, or a decision by Dear Leader, the clock starts ticking for them. A loyalist may inform on them, or a neighbor will fink to settle a petty feud. Nobody will ever know if they can trust the people around them.
      And if Dear Leader has a bad day or the Viagra isn't working? Hoo-boy.

      Depending on how you count, we are already either 1/3 or 2/3 the way to a completely authoritarian government structure. Let's break it down:
      Judiciary -
      - Lifetime appointments, virtually unimpeachable regardless of behavior
      - "Interpretations" can broaden laws to the point of impunity, or narrow them to the point of nullification (also, actual nullification)
      Executive branch -
      - virtually unimpeachable regardless of behavior
      - (new) "presumptive" immunity for declared Official Acts
      Legislative branch -
      - (repeated attempts) "Independent legislature" theory eliminating the ability of other branches to review their actions

      @@joansparky4439 A republic is not an "absolute minority ruled state". Its a form of representative democracy. That "minority" represents _your_ interests (or at least is supposed to), and _you_ have the power to replace them if they stop representing your interests. Yes, it's a minority rule in a loose sense, but the majority gets to pick which minority rules.
      The "minority" SCOTUS just enabled lacks those features, or at least has the ability to nullify them. The president is now able to simply ignore or even stop elections, fail to (peacefully) hand over power, or any number of other things that were absolutely illegal prior to this decision. We just never had to test that illegality because no president prior to Trump has attempted to seize power like that. Now that we have had to test their illegality, the court basically said "well we agree that it's illegal, but we like that guy so he gets a free pass and we'll just ignore whatever horrors he or any future president may choose to inflict now that they've got near-zero accountability".
      The US is still a republic - at least for the next few months. But it is no longer a _constitutional_ Republic. This ruling effectively ends any semblance of belief in the ideology of the founding fathers. Their primary purpose above all else was to not have kings (because you know, Britain), and SCOTUS just said "fuck that".

They didn’t say the president has the authority to do whatever he wants, they said he can’t be charged criminally for official acts.       I have not celebrated the 4th of July since SCOTUS made its decision regarding Roe vs Wade. I knew that it was not just about abortion and they would slowly come after other forms of contraception. I knew they would continue to chip away at every bodies freedoms. This is not a drill people. This is our whole country at stake. Do not believe you will be okay. Anyone can and will be hurt by this current scotus. Even the christians will be. If you don’t believe me just read or watch the Handmaids tale. Nobody is free from the cruelty in that story. And if you naively believe the events in that book cannot happen you are wrong. Yesterday, I sat down with them and explained the ramifications of these events. I told them if the time comes that once past the age of consent I will support them entering a marriage, traditional or platonic, in one of those countries with one of their friends for the purpose of fleeing the US to safety. It is a choice no parent should ever have to make. And I will do it in a heartbeat if it ensures their safety.

    At 63 years of age, I no longer trust the supreme court. As an American, I've seen acts that I thought I would never see happening in America. Imagine getting off work on January 6, 2021, turning on the TV and seeing people trying to over throw the government. The ruling today makes me very very nervous. I agree with you.       His new powers don't give him that authority. That would be a _legal_ act and these new powers only give him immunity for _illegal_ acts.
      Plus, he already had that power back in 2021/2022 and chose not to use it. There's little reason to believe he'd change his mind now. Biden may look like a "leftist" in comparison to the fascist crap we're seeing from Trump and his sycophants, but he's actually a center-right conservative if you expand your comparison beyond America's current Overton window.       65 year old Englishman here. The situation is dire if the SCOTUS decision isn't overturned. The criminal Trump and his legion of miscreants can only be stopped by a landslide victory for the democrats so that effective measures can be put in place to prevent the nightmare scenario being played out. The other option would be the immediate incarceration of Trump and all of those involved in his vile plans by Presidential order, which Biden is unlikely to do, even though the Supreme Court just gave him that option.

      Democracy only works when there is an informed, active electorate. When the majority are misinformed or apathetic, they lose their rights (and sometimes their lives) before they even notice that something has gone wrong. As a country we've grown fat and comfortable, so much so that we've forgotten that it can ALWAYS happen here. Before the Night of the Long Knives, a lot of people didn't take a certain Austrian painter seriously either.
      It doesn't help that the current shepherd of the flock isn't the most confidence inspiring (or that the last few choices for shepherd have been so disappointing), but we've already been led up the ramp into the slaughterhouse and are being held down by the butcher. All it takes is enough sheep to keep believing the butcher and ignoring the shepherd and we won't even be able to scream as the blade falls...

      Who again voted for this Supreme Court makeup? It was a single Senator from a single state, placed as the head of the Senate by his party who decided to not hold hearings to confirm a Supreme Court Justice nominee as the Constitution lays out. A relatively small group of people are responsible for this, not the citizenry, and arguably not even the majority of the citizenry of the country.

      The appeals court did a good job of providing existentially-terrifying examples of "official acts", but I think they should have made it even more personal by naming examples with more specificity -- not just "a political rival" but "a senator who votes to override their veto," or "a judge who rules unfavorably to them".

Hundred-year floods have become a weekly occurrence, after all, while there are still people debating whether climate change is even real. Now? We may lose the country well before that. Sure, we can vote in Biden next year. But assuming that works, what about after that? Someone will get in there eventually and abuse this power. All of this is paving the way for Project 2025's implementation as it is.

Democrats ostensibly control the Senate still, as Sinema and Manchin still caucus on their side of the isle, but those two in particular have - even when they were still in the party - generally sided with Republicans when it comes to things like that. They're pretty staunchly conservative in every way other than social stigmatization (ie: they generally go along with things like gay rights, but they have zero interest in reigning in corporate overreach or - more relevant to this issue - changing how government functions).
      That said, the idea of kings in America may well be enough to sway even a few of the more traditional Republican senators, so it's plausible that Sinema and Manchin may be willing to go for an expansion simply in response to this specific decision. There's a good chance, perhaps even likelihood it will end up overshadowing Dred Scott as the worst decision in SCOTUS history and most senators - even Republican senators - are aware enough to understand the potential future implications of essentially removing all checks and balances from the executive. They may like Trump, but Trump is an old man. He ain't going to be around forever. Biden has indicated he won't abuse his new powers but he is also an old man who won't be around forever. 2028 will likely see new candidates on both sides of the isle, and 2032 almost certainly will (if there's even still elections by that point). Nobody today - not myself, not you, not Beau and not SCOTUS - can predict who those candidates will be or what they might choose to do when given ultimate authority and a near-complete lack of accountability to reign in that authority.

      Jefferson disliked the Judiciary the most. Power for life was a concern. He understood generational power. Baby Boomers too long in power have doomed the babies. If North and South colonies could get along to form a nation, why cannot left and right get along to preserve it? Because of one generation in power has failed. #BabyDoomerism is the culture they created by ideologues of zero sum gaming and a Commons destroying-as if by an invisible mind-"Me first" mentality.

      SCOTUS' job isn't to uphold the law - that's for the lower courts. SCOTUS' job is to interpret the constitution. And with this decision, their interpretation seems to be "who needs that old rotting piece of shit?"

    Biden now has the power to do the following:
    1. Issue an exective order to have the DOJ challenge this ruling. With the standing of the following executive order.
    2. Issue an executive order a Presidential Finding to 'liquidate" 6 members of the SCOTUS pending the results of the above DOJ challenge. If the DOJ loses the challenge, the order is executed, creating six vacancies.
    3. Nominate 6 candidates for SCOTUS.
    4. While the above works its way through the courts, draft a Constitutial Amendment with no ratification deadline that firmly places the rule of law onto all branches of government and the people who sit in office.

      A few Constitutional Amendments, hail-mary though they are, are DEFINITELY necessary going forward.
      - Nullify the "lifetime appointment" ruling and establish stricter standards for maintaining a judge's tenure. Maybe even lower the threshold for judicial impeachments slightly (3 of 5?).
      - Attach a firm time limit to judicial appointments: we're in this mess in no small part because McConnell refused to _do his damn job_ when Obama named two SCOTUS nominees in 2016. Those nominations were Obama's to fill, not Donald's.

      But that's what we had/have with the Constitution until these magats in robes got ahold of it. Seems like we need more specification of the limits of each branch, especially SCOTUS; codified ethical standards/background checks across the board for these positions as we have for other federal employees; A statute specifically stating that no one is above the law; new stronger conflict of interest, gifts, investment, etc, policies; specified process for violations and consequences.
      It is pretty ironic that these legal nimrods just mad Biden effectively a king. 🤔

      If we can get enough of the traitors out, impeachment might be a possibility. Either that or expand laws governing ethics/conduct for other branches/federal employees to them.
      Such hypocrites. Nothing in the Constitution says anything about anyone, let alone the president being above the law.

      @@Stratelier Thus far, yes. It always has been and likely would be here too, but it's about the only mechanism available to counter this because the decision has already been made. Unless they pack the court up to fifteen before Il Duce Arancione can appeal again on individual counts about definitions of official acts whereby they could overturn this one. Given the drawn out procedure of appointments to the SCotUS though that's even more unlikely, especially given the reluctance to even float the idea of increasing the number of justices to offset the absurdly unbalanced conservative majority.

    My heart breaks for everyone in this country. But, most of all, my heart breaks for our military veterans, some of whom fought and died for our Constitution and the rights it has afforded us.
    Today, six rogue judges on our Supreme Court have shat all over our Constitution, and have marched us closer to the end of our Republic.
    God have mercy on us all.

    The Magna Carta was issued in June 1215 and was the first document to put into writing the principle that the king and his government was not above the law. SCOTUS just blew up that core principle the US was founded upon. Truly a dire sign of where this nation is heading.
