Sakeliga attacking ‘next-level’ BEE, advises more State-proofing no matter who wins Election’24

  • In this powerful interview, Sakeliga’s CEO Piet le Roux unpacks his organisation’s fightback against the ‘third wave’ of BEE typified in efforts to make it compulsory for SA’s 40 000 estate agencies. Despite Pretoria’s growing legislative encroachment, Le Roux is upbeat about South Africa’s future: ‘State-proofing’ is being rapidly adopted by businesses and is laying the foundation for growth in the collective power of businesses to counter a weakening and increasingly ineffective central government. He told BizNews editor Alec Hogg that the next decade will be turbulent, but is confident the nation will emerge a lot stronger.

      @@somerandom1888 BEE has benefitted nobody but the elites. The majority is suffering because of the incompetence it created. I can generate my own income, but the majority not in that position. Democracy means equality for all, not suppression of certain groups. Affirmative action has proved to have a negative effect where implemented. Just look at the state of our country. Preferential treatment to gain votes instead of taking care of the economy which will benefit all. Good governance it is not.

    Cyril spoke years ago about the "frog boiling" Eskom is a good example of BEE - they lost all the white skilled people. You should get a job on merit, not on your skin colour.

      The problem is that race and political loyalty became the criteria for getting management jobs instead of competence and performance. One result is that the best candidates for the job don't want it because they do not want to work in an environment that does not have excellence as a standard. Unfortunately, the way you frame the problem is that it comes across as 'whites competent, blacks incompetent', and reinforces the white mentality that whites are superior.
      Remove the racial way of framing the problem and think of it as the system not only reduces competence and excellence as a standard, but discourages the best, of all races, from wanting to work in such an environment.
      Whites believing they are superior creates the same problem when a company is biased towards hiring whites because of 'cultural fit' when a black person may be the better candidate. During apartheid, we had job reservation, which excluded non-whites, even if they were the best person for the job.
      I don't know if this new form of job reservation, done in a more complex way, being driven by Ramaphosa is because he hates whites or because he has not freed himself from the brainwashing of apartheid (one group of people can flourish at the expense of another, for a while at least).
      I dream of the day when all South Africans transcend racial bias!

    This has hit home and I stand behind this 100%. More frustrating is how people can justify creating a new company with a trust to comply as say this is the way to do it!! They are part of the problem. You don’t right a crime by another crime.

    The thing that frightens me the most about these BEE laws is that multiple senior government officials MUST have reviewed them before trying to implement them. And nobody seems to have thought "Hey, this sounds really racist" or "This is really unjust and we shouldn't do it" or anything like that. Instead they thought "Yep, I'm good with this" and tried to implement blatantly racist and unjust laws. This speaks volumes about their mentality.

    Forcing BEE in an environment where the SA Economy grows slower than its Population surely goes contra to The Universal Declaration of Human Rights which states in Art 23:1: 'Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment'?

    Can businesses not write a charter together by which they make an oath to competency and excellence over other measures? If enough do this in the very least the ANC etc. would bump their heads against the same answer from multitudes of businesses - better if it all sounds like the same tune.
    "Sorry, we don't allow racist hiring and procurement practices in our company - only merit based".

    SOMETIMES BUSINESSES NEED TO THINK OUTSIDE OF THE PROTECTION BOX. BLACK PEOPLE ARE IN THE MAJORITY AND WILL IN FUTURE BE THE MAJORITY BUYERS OF HOMES. YOU EITHER NEED BLACK ESTATE AGENTS IN YOUR BUSINESS OR IT WILL BE A BIG MARKET FOR BLACK ESTATE AGENTS TO SET UP AGENCIES THEMSELVES..

      Which is good. Let the Black People start their own Real Estate Businesses. Let them be responsible for their Progress through the Real Estate business, NOT Forced by BBEEE. Asking existing Companies to hand over or Give Away their businesses, that is THEFT !!!!

I personally would want the BEST service provider to perform the sale irrespective. Plenty of dodgy agents around already and this policy can only make it WORSE. Selling privately with the documentation handled by a lawyer will become the NEW METHOD of property transactions.

    This didn't address the question of the bind estate agents will be in with this new law. They can't operate in a legal twilight zone. I certainly wouldn't want to use one who did to buy my home.
