A Strong Case Why The Sovereign Citizen Argument Is Complete BS

  • In this segment we look someone being pulled over for not having a legitimate license plate displaying current registration in Riverside California and how he makes a case that his vehicle is a private outside of the jurisdiction of them and that he is a Sovereign Citizen.

    He's acting like a statute isn't a law. It *is* a law. It's just one kind of law, specifically it's one passed by the legislature, unlike, for example, an ordinance which is passed by a municipal government.
    Also, a "national", by statute, is a non-US citizen from American Samoa. When the US acquired American Samoa in 1900, the treaties confirming it did not confer US citizenship upon Samoans, so the category of "non-citizen national" was created for them by Congress. Contrary to what sov cits erroneously believe, you can't just declare that you're a national, Congress makes that determination and if you're not American Samoan, you aren't one.
    "Passports are only issued to nationals" - completely false. American Samoans can get US passports that will bear a designation of non-citizen national, as just mentioned; otherwise, US passports are only issued to US citizens.

      More to unpack because I deal with sov cits a lot (I work in US citizenship law) and they never cease to be obnoxious little shits.
      I looked up the California Vehicle Code (and "code" in this context doesn't mean a secret language to conceal messages, as he not-so-subtly alludes - it means it's a collection of related laws, put together in one place for ease of access).
      The section with 260 is just a laundry list of definitions, and 260 defines what a commercial vehicle is as far as the code is concerned. It's not a blanket statement that applies to other forms of vehicles; laws tend to start with a list of definitions so it's clear what the law is talking about when you get into the meat of it, and this is no different.
      When you get into the actual law... Division 3, Section 1, Article 1 literally starts off by ordering that ALL motor vehicles must bear a state-issued registration plate. Full stop. "Motor vehicles" is defined in line 415 (same definitions section as the 260 he keeps citing) so we know exactly what the law is talking about.

    • @BobOsso67
      @BobOsso67 Месяц назад

      Wrong. Only Congress can make a law. States, in their sovereignty may create codes and statutes.
      I find this in the definitions found in Garners 9th Blacks Law.

    • @TheDarthbinky
      @TheDarthbinky Месяц назад +2

      The legal information institute at Cornell Law School (and every online dictionary) defines a statute exactly how I said - it's a law that is passed by a legislative body, such as Congress or a state legislature. Federal statutes exist, whether you like/agree with it or not. A legal code, as I said above, is defined as a collection of laws, usually relating to a certain field, which allows for ease of access.
      Likewise, an ordinance is defined as a law passed by a municipal body (eg a city council).
      Those are definitions.
      You did not post a definition of any kind - you made an erroneous statement of fact. Nor do I believe that Black's even says what you say it does. And where I have no interest in getting into an argument with someone who is sympathetic to this sovereign citizen idiocy, this will be my final response to you.

      @@odinisnotthesomefather4687 "Sov Cits think the only valid laws are the US Constitution. "
      Some do. Some actually don't and believe that the Articles of Confederation are still the law and the Constitution is illegal. Some do but don't believe in the Amendments (particularly the 14th, 16th, and 17th). There's no uniformity among them, it's just a lot of cherrypicking, quote-mining, and half-reading legal documents. Most of them just find stuff online and repost it without understanding it or why it's not accurate. Like Bob here, who probably doesn't even have a Black's Law (considering he misspelled it).
      "And the only valid law enforcement are County Sherrifs."
      That's the Posse Comitatus movement that formed the ideological basis of the current sovereign citizen movement. Not all sov cits believe that either (although a lot do).

      I don't think he's rich. They give all their money to their gurus to game the system, which never works. They claim to cancel all contracts, meaning they turn in their licenses and tags, they quit or get fired from their jobs, they lose their homes because paying rent or their mortgage is a contract with the US corporation, and some even lose their kids. There was one video where the Moorish sovereign citizen gave birth at home (she didn't want her baby to be "registered under the straw man") and, I'm not kidding, she boiled the placenta and fed the juice to the newborn. The baby was not covered up and was shivering and was still connected to the umbilical cord. The sovereign citizen's rationale was that the placenta had all the nutrients in it to sustain the life of the baby. She was too stupid to realize that once it hit the air, it became dead tissue. She recorded herself doing it. I couldn't watch the whole video without gagging and crying. That poor baby. But I did see where someone saw the vid and reported her. They took the baby away (she said the government kidnapped the baby). She was allowed visitation but started harassing the foster family. That's just one of many of these idiots out here.
      And I live in MD. I have encountered my fair share of them and debate them happily, debunking all the bullshit they said to me. One of them said that I should be ashamed because we're indigenous (no we're not, we're black) and this is our land. I calmly asked why he couldn't be proud to be black? Why take on the culture of the true indigenous people? Why deny slavery? They don't believe that they are descendants of slaves. They believe they are from Northern Africa hence the Moorish part. Anyway he didn't have a comeback so I left.

Walk or get a horse." slides nicely into "Without a licence or insurance, prove to me that this is your car."
      Now you have to justify, on the spot, that not only are you American, but that the vehicle has been legally obtained. The script is vital to these creatures.... forcing them to either respond to something they dont like, or face doom in the prospect of being deported :) breaks their rhythm... and allows for the types of mistakes that get someone tazed for our entertainment

And all your arguments and objections can be taken to the judge and you can state your case in court. You don't need ID to travel(foot, car, bicycle, train, ect) but you do need one to operate(act as the driver, perform driver duties). What thar means is you don't need to carry identification to be a passenger in a privately owned vehicle traveling on public roads, but you do need a license if you are the operator of the vehicle. If he were in the passenger seat he would not be required to provide identification. But, as he was in the driver seat, operating the vehicle on public roads, he is required to own and hold the license/ID(active Driver's License), and must provide that when requested by law enforcement.

    These people ALMOST understand how the State works as a social construct, and then take a crazy turn off the cliff at the last moment.

    There are absolutely bad cops… cops that escalate too quickly or become violent when violence is absolutely not called for… that being said, props to these officers for remaining calm, exercising patience, and continually trying to de-escalate the situation even when someone is continuing to demean, disrespect, and is constantly resisting lawful orders. These police officers are doing it right. Good for them. I hope justice is served.

    Gotta love the "the streets WE paid for" by a guy who explicitly refuses to pay for them.
