    A few PA specific clarifications-
    1) An EIN is only required if you have employees, even as an LLC. It is not a legal requirement to operate a food truck in PA. It is worth getting if you plan on doing B to B catering rather than giving business customers your SS# though. It is often easier to open a business banking account with one as well, but again not required(depends on the bank).
    2) There are no taxes on foods in PA except those that are pre-prepared or 'ready to eat' and soft drinks. When you buy raw ingredients, whether it's meat, bread, fruits or vegetables from a distributor or grocery store, you don't pay sales tax. For those items that are taxed(such as soda), you can deduct what you paid from the sales tax you collect and remit to the state through E-Tides.
    3) E-Tides automatically calculates and collects any applicable local sales tax for you then distributes it to the county/municipality.
    4) The free state issued 'license to collect sales tax' also functions as your 're-sellers permit' for those few items that are taxed.
    5) There must be at least one person with a 'food managers' level certification present when in operation. Nobody else needs to be certified. A 16yo working the fry-a-lator at McDonalds sure ain't.
    6) In most of PA a local license isn't required for a 'retail food facility', even a mobile one. A single license from the Department of Agriculture(DoA) covers huge swaths of the state. IIRC, there are only 7 counties(out of 66) in PA with their own health departments and also a small fraction of municipalities. There may be permits required to vend on public property(use Ecode360 to find them) but those can be avoided by setting up on private property zoned for retail with the owners permission.
    7) A license from the DoA isn't required, and doesn't help you, in counties/municipalities that do have their own HD. It is worth spending the $108 for one though. It will greatly expand the areas you can operate. Some counties/municipalities with their own HD/licenses will honor both DoA licenses and licenses from other jurisdictions for temporary events like county fairs but don't count on it.
    8) For the DoA license you must submit a commissary agreement with you application package or they won't even look at it. It's one of the first things you need to get.

      Not you coming in with the save 🫡🫡 In all seriousness, it’s actually very beneficial to have an EIN regardless if you plan on having employees. On the SS-4 form it tells you if you’re starting a business. It makes everything so much easier and let’s you use that instead of your social security for security purposes. If you don’t mind it being available for business, then definitely no need.

      @@jenayriscedillo6845 I did address the benefits, such as not needing to use your SSN and for opening bank accounts under the business name. The video said it was a 𝘳𝘦𝘲𝘶𝘪𝘳𝘦𝘮𝘦𝘯𝘵 in PA which is only the case if you have employees. Since an EIN is free by all means get one but again not a legal 𝘳𝘦𝘲𝘶𝘪𝘳𝘦𝘮𝘦𝘯𝘵 here(other states may vary).

    How does open food trailers work? Open BBQ ones? Trailer with a smoker mounted and a 4 sink wash combo...canopy covering everything, it's a grey area for what else is needed, a hood or stove cover won't be needed the smoker has a lid. Thanks in advance

    Great video! Im looking to start a food truck myself, but im worried about the "separate kitchen" part. Im a noob at owning a business and my idea is to cook everything on the truck's kitchen, as it's simple stuff. Do i absolutely need a separate kitchen in a building? The truck im looking to buy isnt meant to drive. Its been in the same spot on a campus for 20 years

    Does anyone know how this info applies to a Food Trailer MINISTRY (not a truck)? I'm looking into starting a FOR PROFIT ministry via a Food Trailer (basically a food truck, just in a pull behind trailer form) in PA. Does one need all of these permits or are there more/different permits needed if it is a for profit ministry? Thank you for your help! God bless.

    Thank you for the information!! I am in process of opening my food truck. The only thing I have left to do is deal with the heath department here in PA. I have a quick question, does the health department go and check your commissary kitchen or do they just want the commissary agreement?

      normally they will need only the letter. The kitchen itself MUST have their own inspections always separate from you

    Thank you so much for this amazing content. Do we have to have a business license for every city that go to? For example if I decide to go to different festivals in different cities in PA, do I have to get a permit first?

      I checked the states website and I saw nothing indicating there be a separate for each city BUT I would look into making a call to the cities you wish to be in and simply ask them if that city requires a separate individual permit.

      It entirely depends. Some municipalities and counties have their own health department, others(most in PA) don't. In those that don't a 'mobile food facility' license is obtained through the state Department of Agriculture and is usually the only business license you need.
      Some municipalities and counties without their own health department might still require permits to operate on public property*. That permit is separate from the state business license.
      You can look up current codes/ordinances for towns you wish to operate in on Ecode360. Always keep in mind, besides operating on public property, they can't legally enforce codes on a food truck that they do not also enforce against McDonalds**.
