Indian High Court Bows to Islam: Judge Denies Interfaith Marriage

- In a controversial ruling that has sparked outrage among legal experts and activists, the Madhya Pradesh High Court in India denied protection for an interfaith Hindu-Muslim couple seeking to get married, declaring their marriage invalid under Muslim Personal Law. Citing the interpretation that a Muslim man cannot validly marry a Hindu woman considered an "idolatress or fire-worshiper," Justice G.S. Ahluwalia stated "As per Mahomedan law, the marriage of a Muslim boy with a girl who is an idolatress or a fire-worshipper is not a valid marriage. Even if the marriage is registered under the Special Marriage Act, the marriage would no longer be a valid marriage, and it would be an irregular (fasid) marriage." The ruling directly contradicts the intent of India's secular Special Marriage Act of 1954 which aims to enable interfaith unions, with critics arguing the court's definition of "prohibited relationship" under the law is flawed and discriminatory towards non-Muslim partners.

If the Babri Masjit was not destroyed, it would have been created 20 years ago. That is why the Supreme Court said the vandalism and destruction were unconstitutional.

Even if there’s a marriage, after a birth of a child he’ll make her change over to “his side”. His family will join in. When women still don’t, they get “neutralized”. These cases r common. @@mowgli2071 it applies only to this specific case and this province. If the couple can get their marriage registered in other state then this ruling will be meaningless. If supreme court ( which is the apex court of india) rules in favour or against this ruling then that will be applicable to all the states and can set a legal precedence.

Unfortunately, we have Sharia and Beth Din courts operating in Britain. All the people - mainly down-trodden women, who may not even speak English, far less know their legal rights (this applies to Muslim immigrants rather than Jews) - do not know that the Civil Law of England or Scotland gives them very many more rights and protections than the Sharia Law that their spouse, male relative or 'community' tells them that is the only law that applies to them.

Hindu muslim marriages have happened even in the past through an act called special marriage act. But in most (but not all) cases, there are risks of Hindu partner being murdered by his/her spouse’s family members. Sometimes even the Hindu family members try to torture the couple. But they mostly disown their children. Also on the contrary there are many Hindu celebrities who have married muslims and vice versa. But in celebrities cases, there’s no such issues. Everyone happens to be tolerant towards it.

23:56 Armin is wrong, Indian Courts are correct here in that courts cannot go rogue and make laws. Their job is to interpret and enforce laws passed by the Parliament, and MP High Court's interpretation is arguably a correct one. The problem lies with Left law makers who not only made these laws but also stand in the way of abolishing them. Susanna said that initially she opposed the UCC, that's because the Indian left over the decades has found success in spreading their porpaganda via the western media. For example, UCC which isn't even codified is labled by the left as a "bhramin law", an "upper caste" law, a law that will take away rights of religious minorities and dalits - some of this garbage gets picked up by mainstream western media without basic scrutiny leading to liberal folks like Susanna being put of by UCC, atleast initially till they dig deeper which isn't something everyone does.
Also, Susanna repeatedly said inter faith marriages were prohibited by personal law. That's not accurate. A person from any faith can marry into any other faith, the problem is regrading what legal rights and protections would they be afforded. Here there is a lot of ambiguity which is by design as Law makers (mostly leftist) never intended to protect individual rights but to appease minority conservative voices to secure votes.
