Basically, under Defamation the person making the statement has to have made it with the knowledge that what they are saying is false. This would fall under Actual Malice, because the person making the defamatory statement made it knowing that the statement was false. Reckless Disregard applies to when a person makes a defamatory statement without knowing that what they are saying is 100% false. However the statement that they are making in this instance should be obvious to the person making it that the statement is false, even if they don't know for sure. Like even the lightest of research would show whether a statement made with reckless disregard is accurate or not. For example: Coffeezilla says in a video "I heard Logan Paul only started Cryptozoo with the express intention of ripping people off." In this scenario, if Coffeezilla knows for sure that this is not true and makes the statement anyways, that's defamation with actual malice. For reckless disregard: Say Coffeezilla says "I heard Logan Paul planted the body that he found in Japan." In this scenario, Coffee has no idea if what he's saying is true or false, but he makes the statement anyways without verifying anything. This would be Defamation with Reckless Disregard. However, ultimately none of this will matter because the Truth is an Absolute Defense to Defamation, and Coffeezilla likely has mountains of receipts and research to back up all his statements. So regardless of the veracity of the statements, none of them were made with knowledge of their falsity or without verifying claims first. Logan's case is dead in the water.

@@kjaze From what I've seen from others, the specific district court that Logan is suing through has previously not allowed state laws (like anti-slapp laws) to apply to federal cases, so there's still technically a small chance they can argue it, but it's unlikely. (Coffeezilla's lawyers might not even bother trying to argue it because they think it'll just drag things out needlessly, but I'm not a lawyer and certainly not one of his, but in this case where Logan is intentionally going to try and hold out and drain Coffee out of as much money as possible, it's probably not worth trying to intentionally do that.)

I have encountered sociopaths in real life, and most people tend to believe them until it is too late. On some level they believe their own BS creating an unjustified air of sincerity. Basically, under Defamation the person making the statement has to have made it with the knowledge that what they are saying is false. This would fall under Actual Malice, because the person making the defamatory statement made it knowing that the statement was false.
Reckless Disregard applies to when a person makes a defamatory statement without knowing that what they are saying is 100% false. However the statement that they are making in this instance should be obvious to the person making it that the statement is false, even if they don't know for sure. Like even the lightest of research would show whether a statement made with reckless disregard is accurate or not.
For example: Coffeezilla says in a video "I heard Logan Paul only started Cryptozoo with the express intention of ripping people off." In this scenario, if Coffeezilla knows for sure that this is not true and makes the statement anyways, that's defamation with actual malice.
For reckless disregard: Say Coffeezilla says "I heard Logan Paul planted the body that he found in Japan." In this scenario, Coffee has no idea if what he's saying is true or false, but he makes the statement anyways without verifying anything. This would be Defamation with Reckless Disregard.
However, ultimately none of this will matter because the Truth is an Absolute Defense to Defamation, and Coffeezilla likely has mountains of receipts and research to back up all his statements. So regardless of the veracity of the statements, none of them were made with knowledge of their falsity or without verifying claims first. Logan's case is dead in the water.

Coffee needs to sue that insurance company and/or the broker. They both knew what type of coverage he wanted and one or both of them intentionally misled him and took his money. It's insane that Amber Heard's insurance paid *_MILLIONS_* for her lawyers *_AND_* paid out the judgement when she *_LOST_* her defamation case, and yet Coffee gets *_NOTHING_* after paying 10's of thousands of dollars for years.
I get what you're saying. And if righteousness always won, I'd be right there with you on this. But we're talking about an insurance company. They have lawyers carefully craft agreements that let them get out of a lot of situations. Not only that, but this is a legal insurance company. If you indulge in mukbanging and that shit or keep it to some areas of interest (I find the music big -and not so big- creators' content landscape remaining relatively fresh and not self-destroying) your mileage can vary.

Coming from someone who was in extreme debt, due to my irresponsibility, I sold my assets, and even tho I lost my job, my primary priority was paying back my debt. Tbh, I he were to speak up about his inconsistency and explain why he didn't pay those people back, and his net worth is high, and he has a business in other things. He has the assets to pay it off.
Its hard to give him the benefit of doubt, when hes caused another person to struggle financially instead of just taking the advice and fixing his situation.
Thats the thing though - poor people are lectured at about their lack of responsibility, while rich people casually waste unthinkable amounts of money and suffer zero consequences. That is not a just society, and I refuse to believe we should consider this acceptable.

@@kjaze From what I've seen from others, the specific district court that Logan is suing through has previously not allowed state laws (like anti-slapp laws) to apply to federal cases, so there's still technically a small chance they can argue it, but it's unlikely. (Coffeezilla's lawyers might not even bother trying to argue it because they think it'll just drag things out needlessly, but I'm not a lawyer and certainly not one of his, but in this case where Logan is intentionally going to try and hold out and drain Coffee out of as much money as possible, it's probably not worth trying to intentionally do that.)
