Difference 👉 Theft 👉 378 (moved out of possession) Extortion 👉 383 (delivery by the victim due to fear of injury) Robbery 👉 390 Robbery = Theft + fear of instant death/injury OR Robbery = extortion + fear of instant death/injury
Buddy he is talking about difference between extortion and when extortion amounts to robbery. Consent is not the difference because in both cases the possessor of property himself delivers property to perpetrator. When this delivery is made in fear of any injury ( body, mind, reputation, property), it is extortion. But when such delivery is made in fear of INSTANT death, hurt or restraint and the perpetrator is present in front of victim while doing so, it is robbery by extortion
sir if in case agr kidnapping ya abduction k case m money ki demand ki jati hai threaten krke us abduct ya kidnapped prson k guardian ya known ko ki agr itne paise nhi diye ek prticular given time pr toh isko maar dunga then yh toh yh theft by robbery k case hai extortion by robbery
In extortion , there are also fear of injury and in robbery+extortion there are also fear of injury . What is the difference between them ?? Totally confused
Theft : Accused took your property without your consent but you are not aware about it. Theft under 382 IPC/307 BNS : Accused came with preparation by carrying any weapon If you try to resist he will use that weapon to harm you but here only preparation is sufficient. Harm may be caused or may not. Extortion : Here accused is threatening to deliver the property by showing some fear. Here delivery is important because you delivered the property with fear. Consent is taken under fear and accused not present here. Robbery : Robbery is the aggravated form of theft and extortion. Due to fear of accused you delivered the property i.e robbery by extortion and accused is present here but when by showing weapon the accused himself took your property i.e robbery by theft. 1.Simple theft : Accused take but you are unaware 2. Theft u/s 307 BNS : Accused came with preparation by carrying a weapon although he may not be used only preparation is sufficient to give him more punishment 3. Extortion : Accused not present here. 4. Robbery by theft : Accused took your property himself by showing some fear. 5. Robbery by extortion : You delivered the property under the fear of accused. Here accused is present.
