‘You don’t have the power to conduct law from the bench’: So-called sovereign citizen again

  • SPOKANE, Wash - A Stevens County man accused of aiding in the kidnapping of a child in foster care again told a Spokane judge Thursday that he doesn’t recognize Washington law.
    Police say Howard Padden pretended to be a lawyer and intimidated a Spokane foster family into handing over a child to her biological parents.
    The child’s father is accused of assaulting her.
    Police say Padden handed the family fake documents and said if they didn’t comply, they would be deported and even executed for treason.
    Through several court appearances in Spokane, Padden has made it clear he doesn’t recognize the U.S. Constitution.
    Padden says he’s the chief justice and the postmaster and judges and police have no power over him.
    When he first appeared in court, Commissioner John Stine told him, “Save it for somebody else who’s stupid.”
    Back in court Thursday before a different judge, Padden refused to cooperate with the process.
    “I will not enter a plea,” Padden told the judge. “I will not step down to your jurisdiction.”
    Judge John Cooney was trying to determine if Padden could represent himself or should be appointed an attorney.
    Padden said he wanted his own counsel and refused to enter a plea, saying “no comment” to the charges against him.
    “You don’t have the power, sir,” Padden told the judge. “For the record, you don’t have the power to conduct law from the bench.”
    Cooney then told Padden he was there to make sure his rights were preserved, prompting Padden to say, “I do not have constitutional rights, I have God-given unalienable rights.”
    Padden remains in jail as the charges are pursued against him.
    He also faces 32 counts of intimidating a public witness in Stevens County.
    In that case, prosecutors say he threatened to seize property from elected officials if they tried to make him pay his taxes.

Happens all the time and there is zero significance. Trials are administered using a process of civil procedure and reading the case files and speaking to the clerks working the case is all a judge needs to handle an already in progress case. See these sovcits seem to think there is some midevil lord of the land type thing with judges, when its simply a well informed person in the law, with education who is able to run a court.

      I once heard something from some customs and border enforcement (Or whatever they call themselves these days) that once in a while they'll do a regular stop and some sovereign citizen tries their B.S. and they are deported to some other country because they claim not to be citizens of the U.S.

      I have always wanted to hit them with contempt charges if they try to obstruct the court process - but then you'd have them serving YEARS without being brought on their original crime, and they'd easily claim that the contempt charges are 'retaliatory'.

      The system is protecting his rights, since he won’t enter a plea then the judge, according to the law, must enter a plea of not guilty so that he can have a fair hearing in a court, that is protecting his rights. The charges though are not trivial, if he was a man he would face up to these charges, he is being obstructive and thinks he is above the law, only democrats in the whitehouse seem to have that privilege.

    I'm not sure what the sovereign citizen stuff is all about, but the judge doesn't have the authority or right to enter a plea if he doesn't have power of attorney or hasn't been appointed assistance of counsel, and that judge is to remain impartial pursuant to his oath.

      Incorrect, the judge may enter a plea of not guilty. It can then proceed to trial where his guilt would have to be proven since he is assumed innocent. It prevents people like this making a mockery of the legal system with their nonsense. If what you said was correct, no one would ever enter a plea so they could then not be held accountable for their actions.

      Umm, wrong. The judge absolutely can enter a not guilty plea for the defendant if the defendant refuses to plead. Or do you suggest that every criminal can just refuse to make a plea and escape ever being tried or sentenced for their crimes?

      @@mrsentinel4911 At this point it doesn't matter because it's an arraignment. He could make those arguments at the pretrial hearings or at the trial. Though the burden of proof isn't that high. He would then have to provide something substantial to counter the evidence the prosecutor provides concerning jurisdiction.
