Hmm looking at the map it seems Malaysia’s claim to the Spratlys is due to Sabahs EEZ? For me Malaysia has the weakest claim to the Spratlys. No wonder tried nila sabotage yung arbitration. By reviving this I think mas pinalalakas ng Pilipinas ang position sa Spratlys din.

In 1658, the Sultan of Brunei ceded the northern and eastern portion of Borneo to the Sultanate of Sulu in compensation for the latter's help in settling the Brunei Civil War in the Brunei Sultanate.
Sabah was given by Brunei to the Sulu Sultanate. Sabah is a territory of Sulu Sultanate illegally annexed and occupied by Britain into the Malaysian federation during the 60s.
Philippines claims was based on the CLAIM that Sabah was CLAIMED to be once under Sulu. The descendents of Sulu Sultan CLAIMED that Sabah was given by Brunei to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu (actually only eastern part of Sabah). There was NO DOCUMENT regarding the transfer of ownership of eastern part of Sabah from Brunei to Sulu.

@@sheilatuano9633 , yes, it was true that Brunei did promise to give eastern part of Sabah to Sulu as a gift if Sulu help Brunei to fight and defeat rebels. But Sulu didn't help or they came too late after Brunei had already defeated the rebels by themselves. So according to Brunei eastern part of Sabah was not given to Sulu. When Sulu soldiers returned to their Sultan, they reported that they had helped Brunei fight and defeat the rebels which actually they didn't. They dared not telling the truth to the Sultan. So Sulu Sultan only thought and assumed that eastern part of Sabah had been given to Sulu.
Then Brunei ceded the WHOLE of Sabah to NBCC for 20,000 Spanish gold dollars in one payment, on 29 Dec. 1877. This cession deal was documented. When NBCC went to Sabah to do their business, Sulu CLAIMED that eastern part of Sabah was under Sulu. Just to be able to do their business, NBCC had to make a deal with Sulu with annual payment of 5000 Spanish gold dollars. This deal was a cession deal (not lease) signed on 22 January 1878. It was like a businessman wanted to set up a business in a city, he obtained all necessary license, permit from the authority (City Hall, Municipality) and paid all necessary fees and tax. When he started to do his business, then a group of people from "underworld" came and claim that this part of the city was under their protection. And that the businesses man had to pay certain amount monthly to that underworld organisation.
Still there was NO DOCUMENT regarding the transfer of ownership of eastern part of Sabah from Brunei to Sulu signed by both Sultans.

The people living in Sabah have two options to choose from: 1. They can relocate to Sarawak or return to peninsular Malaysia and retain their Malaysian citizenship, 2. They can remain in Sabah and be affiliated with the Sultanate of Sulu and choose Philippine citizenship.
If they don't want the two options and wants to remain in Sabah and be in Malaysia, what can Philippines do?

Latest as in June 2023:
1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate.
2. June 27th - Dutch Court of Appeal in The Haque had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling, and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision.
3. Paris Court of Appeal also imposed on Sulu €100,000.00 to be paid to Malaysia as legal cost.
4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.
Malaysia had spent around RM32m, equivalent to about USD6.6m to deal with these Sulu claim cases in various European courts, in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m spent.
Now, who is being checkmate?
Now is already 31st December 2023 and still no news about Sulu's claim proceeding in Luxembourg Court. It looked like they really withdrew their case when they acknowledged the Paris Court of Appeal decision.

Malaysia did not help in the peace process brought about in Mindanao but is the very reason why Mindanao was in Chaos. The Filipino People is now awakened and united to fight for it's sovereign rights.
British North Borneo Company (BNBC) signed 2 agreements with the Sultan of Brunei and Sultan of Sulu on 29 December 1877 and 22 January 1878 over the territory of North Borneo respectively. Thus, Sulu claims on North Borneo was given by Brunei as a gift is unfounded. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain in Bases of Peace and Capitulation Agreement. The agreement by Sulu with BNBC on 22 January 1878 is null and void based on his majesty termination letters also dated 22 July 1878 to the Governor of Sulu and Governor General of Philippines who later forwarded it to BNBC (24/7/1878) and Spanish government (20/8/1878) in Madrid respectively. Later this whole episode is override by the Madrid Protocol 1885 that North Borneo belongs to the British.
Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken to court in Philippines, Malaysia or ICJ until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars have a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full.
The above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation.

1640; Spain under a treaty entered into with the Sultan of Sulu and Maguindanao recognizes the Independence of the two Sultanates
1704; Sabah ( Formerly North Borneo) which used to be ruled by the Sultan of Brunei, is ceded to the Sultan of Sulu Jamalul Ahlam, in gratitude to the latter's role in suppressing a revolt against the Sultan of Brunei.
1878; The Sulu Sultan lease Sabah to the British North Borneo Co. Represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak ("leased") in which the company would pay 5, 300 Mexican gold pieces to the Kingdom of Sulu
1936; The payment stops when Sultan Jamalul Kiram 2 died. Sultan Punjungan kiram crown prince of the Sultanate at the time of Jamaluls 2 death, goes to the British Consulate in Manila to demand the resumption of payments. After Jamaluls 2 death, The British Consul in Manila reccomends the suspension of payments because Pres. Manuel Quezon did not recognize Jamalul 2s successor.
1939; The High Court of Borneo issues a decision naming the nine principal heirs of the last Sultan of Sulu, Whose descendants had been pressing their claim to Sabah. After the Court decision, The British North Borneo Co. Comply for several years.
1962; The Philippines stake it's claim to Sabah after the heirs of the Sultan of Sulu and North Borneo gave the Government, then headed by Pres. Diosdado Macapagal, Legal Authority to negotiate on their behalf. Macapagal files with the United kingdom the Philippine claim of sovereignty, Jurisdiction and ownership of North Borneo.
1968; Pres. Marcos recruits Filipino Muslims for a covert force to zeise Sabah from Malaysia. But when the recruits complain, at least 23 of them are killed in what would be reffered to as the Jabidah massacre, the incidents helps radicalize Filipino Muslims.
1999; Princess Denchurain Kiram, daughter of Princess Tarhata, writes Malaysian Prime Minister Mahathir Mohammad trough Pres. Joseph Estrada to request for an increase in the annual rental. She dies in September the next year without receiving reply.
2003; The heirs send Pres. Gloria Arroyo another letter asking for help in requesting the Malaysian Government to increase the rent.
2008; Reports say that Jamalul 2s heirs had "dropped" their Sabah claim, which the heirs dismiss as untrue. In the reports Malaysian Datu Omar Ali Datu Backtiyal told a local newspaper in Malaysia that he had obtained the signatures of the nine heirs for the relinquishment of their claim to Sabah. The heirs dismiss the report as lies.
2013; Followers of Sulu Sultan Jamalul Kiram 3 go to Sabah from Tawi Tawi and occupy a village in Lahad Datu.

On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain in Bases of Peace and Capitulation Agreement. The agreement by Sulu with BNBC on 22 January 1878 is null and void based on his majesty termination letters also dated 22 July 1878 to the Governor of Sulu and Governor General of Philippines who later forwarded it to BNBC (24/7/1878) and Spanish government (20/8/1878) in Madrid respectively. Later this whole episode is override by the Madrid Protocol 1885 that North Borneo belongs to the British.
Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken to court in Philippines, Malaysia or ICJ until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars have a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full.

Malaysia took advantage of this failure by the Phl government, annexed Sabah and integrated it with the Malaysian federation. Malaysia knew that Sabah was only LEASED from th Sultan of Sulu, and did in fact, continued paying the ridiculously cheap lease yearly even after the federation was formed. that is why they refuse any discussion because Malaysia cannot defend its land grab of Sabah.
The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says:
"I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia"

1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate.
2. June 27th - Dutch Court of Appeal had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision.
3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost.
4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.
God bless Teodoro Locsin who has the courage, guts, the balls to declare and to claim it openly as belonging to the Philippines, not Malaysia which repatriated a large number of Muslims even during this covid-19 pandemic. Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, after the second point above, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay.

Based on the context of attachment of UN General Assembly 1541 (XV), number 4 principal 9, and evaluation of UN Secretary General (at that time held by Bhutan); the three countries, Malaysia, Philipine, and Indonesia HAVE TO WAIT SABAH STATUS DECISION BASED ON TERRITORY OWNER VOICE (FROM SULU SULTANATE), OR RESULT OF LOCAL PEOPLE VOTES IF SULU SULTANATE WITHOUT BEING FORCED HANDED OVER THE DECISION OF SABAH STATUS TO LOCAL PEOPLE WHICH WOULD BE SUPERVISED BY UNITED NATION; because it is related to law order of territorial tenure or decolonization (on the basis of rent document as a proof, SABAH IS NOT BRITISH COLONY, or IS NOT OWNED BUT RENTED BY BRITISH, SO THAT SABAH IS OWNED BY SULU SULTANATE, and BRITISH HAS NO RIGHT TO HAND OVER SABAH TERITORY TO ANOTHER COUNTRY).
Generally, INTERNATIONAL LAW, decision to certain Sabah status (attachment of UN General Assemby 1541 (XV), number 4 principal 9) MUST BE BASED ON ONE OF THE ALTERNATIVES BELOW:
a. return back Sabah teritory to Sulu
Sultanate as the owner of Sabah,
or
b. (if) Sulu Sultanate without being forced
handed over voice right to local people
for voting Sabah status certainty, then
the decision of Sabah status would be
certained by one of the following
choices:
- join to Malaysia
or
- join to Philipine
or
- join to Indonesia

- establish a new country.
BUT MALAYSIA DIDNOT OBEY THE AGREEMENT and IGNORED UNITED NATION RULE ABOVE through DECISION TO ESTABLISH FEDERAL STATE OF MALAYSIA AT SEPTEMBER 16, 1963; ANNEX SABAH WITHOUT RESPECTING THE OWNER VOICE, OR LOCAL PEOPLE WILL (if Sulu Sultanate handed over the decision of Sabah status to local people) AND WITHOUT RESPECTING UNITED NATION RULE ABOVE THAT WAS COMMITTED IN THE AGREEMENT. This Malaysia’s decision ignite anger of two countries (Philipine and Indonesia), so that in 1963 Philipines and Indonesia cut off diplomatic relations to Malaysia, and was followed by conflict and confrontation by Indonesia that was called “Ganyang Malaysia” at that time. Generally, INTERNATIONAL LAW (based on attachment context of UN General Assembly 1541 (XV), number 4 principal 9), enforces rule that TAKING OVER A TERITORY TO BECOME A NEW COUNTRY MUST BE OBEY THE RULE BASED ON ASPIRATiON (VOICE) OF THE TERRITORY OWNER’S DECISION. IF NOT, THEN THAT TERITORY IS PERMANENT BELONG TO THE OWNER. Because British was not the owner (rent document as a proof), then SABAH IS STILL OWNED BY SULU SULTANATE (British only as a renter to Sulu Sultanate according to agreement). SULU SULTANATE AS THE SABAH TERRITORY OWNER HAS THE LAW RIGHT TO DO ANYTHING RELATED TO HIS OWN TERRITORY.
Ha ha ha ha. You manipulate the agreement stated in the Manila Accord and put in much of your own opinion. What important is to look at Section 10 and 12 in the accord. Section 10 is binding and all agreed to ket UN to make the decision on the aspiration of the peoples in Borneo. But Section 12 just PH stating their position on the claim to Sabah which is not binding. Now after UN did their job, why PH oppose? Who do not obey or adhere to the accord? Be honest in your writing.

Philippines claim on North Borneo based solely on historical and legal rights is very dubious without any evidence.
First, Sultan Sulu claimed Sultan Brunei gave North Borneo to Sulu as a gift in assisting Brunei’s civil war is without any proof. Earliest historian like Sir Stamford Raffles (History of Java) in 1830 said it is only a claim. The agreement between Sultan Brunei and British North Borneo Company (BNBC) on 29 December 1877 which is 3 weeks earlier than the agreement between Sultan Sulu (22 January 1878) and BNBC show that North Borneo was still belongs to Brunei. The onus is on Philippines to proof it otherwise.
Second, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement). On the same day, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the agreement (22 January 1878 agreement) between Sulu Sultanate and BNBC. The agreement between Sultan Sulu and BNBC on 22nd January 1878 is null and void. Thus, issues whether it is a rent or cession and translation either in English or Tausug is no more valid. On 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. The issue was later raised by Spain with the British Government. Finally, the issue on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. Again, on the 25th November 1957, the latter Sultanate of Sulu declared termination of the lease between Sulu and BNBC effective on 22 January 1958. Thus, the agreement is null and void.
Thirdly, there is an instances whereby Philippines claims to North Borneo been brought to ICJ for the court decision. In 2001 during the trial between Malaysia and Indonesia on the islands of Sipadan and Ligitan. Even Philippines is not a party to the trial but requested to intervene. To comply to Article 62 of the Statute of Court, Philippines stated 3 objects for the intervention namely to safeguard and preserve Philippines historical and legal rights over North Borneo, to inform the court the affect or effect of the court outcomes on its claim to the territories and on the procedural issues in the court. After many deliberations, the court found the first 2 objectives are appropriate. Later Philippines lawyers presented their case and provided documentation especially the Sulu-Ovenbeck 1878 agreement and related information to the court. On 23 October 2001, by 14 to 1 vote, the court rejected the Philippines request on the ground that there is no interest of legal nature. Refer to ICJ record published in 2001.

Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken to court in Philippines, Malaysia or ICJ until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars has a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full.
