    Gongratulations Salvatore! and thank you for providing us very important informations. Oscar, according to your video, seems like it's not recommended to mention "Labor shortage." but seems like it could be good evidence for the prong 2 in this particular case, right?

    Hey Oscar, thanks once again for an inspiring and helpful talk with Salvatore. Many congratulations to him! I have a quick question about what he just mentioned about 'personal touch' in recommendation letters. According to my research and readings over the requirements of the recommendation letters, I understand that it is always better to have 2-3 independent recommenders and only 1-2 dependent recommenders (please correct me if I am wrong). My question is if we have more independent recommenders, they would talk more formal stuff such as publication and professional achievements, nothing personal. What are your comments on this. Thanks.

      You are right on everything you said Sumera. Independent recommenders will definitely be more formal and aseptic, I don't agree they need a personal touch. They do need to very very specific showing your achievements and contributions and how you can impact the US. Always with details! I am actually releasing a video on this matter today or tomorrow ;)

    I will share my thoughts. I am happy for Salvatore. I am not being pessimistic. And I am sorry for my English ahead of time.

    Well, based on the denial rate of EB-2 NIW cases on the FAA website it seems like it is a lottery then...
    I reviewed 5 cases with filed appeal (there are a lot) and USCIS (Appeal of Texas Service Center Decision) explains that just being a professional pilot with 10+ years of experience and a degree is beneficial only for a pilot and their worker, but not for the Nation. All cases were filled with the same information (pilot shortage, I will be an instructor, I will pay taxes), and it is denied because USCIS is asking: How will you cut the pilot shortage for the USA? Not for one airline or flight school, but for whole nation. The other words "We will approve your I-140 if you have solution for the national aviation problem".
    Also he has no Part 121. Will UAL, DAL, AAL hire him? You know the answer.
    It seems like story of Salvatore is based on luck, even though I am happy for him.
    Here is conclusion for cases like that one:
    "Because the Petitioner has not met the required first prong of the Dhanasar analytical framework, we
    conclude that he has not established eligibility for a national interest waiver as a matter of discretion.
    The appeal will be dismissed for the above stated reasons. "

      Hi Pavlo. I understand the frustration. From what I understand piloting is a profession where it is hard to get approval, similar to teaching, because USCIS pushes back on the national importance aspect. The officers are trying to apply the criteria and they follow a similar approach than for everyone else: you need to show broader impacts, beyond your organization. That is true also for software engineers or scientists, to name two different fields. Now, if you ask me, I disagree when it comes to piloting endeavors being rejected so easily, because one should recognize the broader impact of training others, particularely if the instructors are exceptional individuals with a track record. But I agree with USCIS that they cannot just give green cards like NIW to fix labor shortages, because there are other mechanisms to do that.
      If you are interested, try to find a specialized lawyer to work with, like Salvatore did. Perhaps they can give a better evaluation and potentially work with you. While I don't know the name of Salvatore's attorney, I came across with a lawyer named Seth Finberg on LinkedIn (you can search for him there) and he seems highly specialized on those profiles.     Oscar, I think one very important part about Salvatore’s case should be clarified. His academic degree and his master’s degree. Because in most countries, a pilot’s license is considered a technical degree that cannot be validated as an university degree. Most pilots I know of just possess a license but no title (diploma). In some countries, pilots are applying for an EB2-NIW based only on their flying skills (abilities) and experience (10 years or more) but so far nobody has gotten approved because of this. In my case (also a pilot), we had to rely on my extracurricular experience (training and teaching background) because my lawyer didn’t see enough evidence for support. Also, major airlines have very strict hiring policies and most will not even have an interview with an applicant unless he/she already has a green card and an ATP license. I wish I could tell you my case has been approved but it was just recently submitted, so I’m in the waiting timeline. Great work you do on your channel. Thanks!

Regarding your comment, I have seen people using training as a way to strengthen their case and show national importance beyond pilot shortage. Salvatore is the first one I am aware received approval without this point. However, I don't everyone who applies (well, nobody does, really) and since the data is not public I dare not say nobody is approved with that strategy. Again, thanks for commenting and watching!

      @@OscarsGreenCard In latin american countries it is (at least it used to be) the case that professional pilots for flag carriers are former national airforces, who are graduated from their academies with a professional degree either in Humanities (History, Administration) or Engineering.

      I’m also a pilot from South Asia with double Masters Degree (Including MBA in supply Chain Management) with a background in Budgeting department.     I have undergrad and grad degrees from United States and I have 2500 hours on narrow and widebody jets with 6-7 years of experience. Do you think I have shot at this or should I not bother at all. Great videos btw. Thank you🙏🏻🙏🏻

    Oscar, yes lawyers are expensive but good ones have the latest info from immigration, we don’t have access to that. How costly is it to meke mistakes and have one’s request denied?
    Make sure you go with a Lawyer who’s an expert on pilot aplicants. It’s well worth it

      I think it's a personal choice depending on many factors including your profile and field . For me, I'm very happy of not having used a lawyer for NIW , but I know for other people an attorney may be a good idea .

    I have more than 10 years of experience with 4000 hours on wide body jets. With a four year degree but without any extraordinary works other than just being a line pilot. I have been told that my chances are low in getting NIW. Many lawyers would advertise on meeting 3 requirements as a minimum to apply for NIW but in reality you need much more than that. Like savatore who has 2 master degrees with 20 years of experiences.
