The state isn’t going to pursue charges. They will have to PROVE that you violated. The less evidence the better. If your drone identifies as a dog AND it’s after dusk it’s perfectly legal to harvest.

For your information. Our public officials took an OTH to uphold the constitution. If the law isn't in the constitution it is not the law. Our police departments and judges are at this time upholding what is called establishment law. Establishment law is always written as codes and statuettes. Which is actually committing treason against our country. We the people were never taught the constitution because why? So we wouldn't know what our rights are, the establishment law violates the rights of the people. Which is a crime. Do you know what the penalty for treason is? It's the death penalty. That is the only way we the people can hold our public officials accountable. Judges know what treason is. When a person goes to court for some reason. A judge usually wants a person to write an affidavit pertaining to your cases. Because the judge wants to know what you know about the law. If he can see you don't know anything. And don't know what your rights are. He then knows he's safe in using establishment law without fear. But if people understood their rights, and the constitution, people could put the fear of God back in our government, law enforcement. And our court systems.
As a drone guy I absolutely agree that the use of drones in “recovery” of wildlife should be allowed nationwide. If the animal is already dead then “fair chase” doesn’t apply at all…dead animals can’t run so that goes out the window. We all agree that it shouldn’t be used to find them when we’re hunting and they are still alive… Thanks for making this video guys! We appreciate you all pushing back to amend outdated laws.

I asked my local State troopers up here in Alaska, and I'm allowed to use a drone to look for a shot moose, but I can't use it for looking for moose to shoot. In our law, you have to use any means possible to locate a down animal.

I live in Illinois I'm sorry to say. It doesn't surprise me in the least that they won't allow the use of drones for recovering deer. Illinois also does everything it can to not have new business's in Illinois. Think of all the people that could start a new business and earn a little extra $$$$.

States that don't want to allow drones to find wild game after it has been shot needs to face penalties and I mean very severe penalties. How is the lawsuit in Michigan coming along? And how do we get the laws changed in the state of Iowa. They have similar laws: “Hunting," means any pursuing, hunting, killing, trapping, snaring, netting, searching for or shooting at, stalking or lying in wait for any game, animal, bird or fish protected by the state laws or rules adopted by the commission whether or not such animal is captured, killed or injured. Prohibited Devices: You may not use dogs, domestic animals, bait, radios, automobiles, aircraft, drones, electronic calls or any mechanical conveyance or device to hunt deer, or recover wounded deer.
The problem with this video is logic. You see this state closed boat ramp access to lakes because of Covid and when they opened them back up they said you could go on the lake but only 2 people per boat. They also shut down public land access during youth turkey season. So as a kid with a special hunt area permit you couldn’t go hunt with your family member in the woods because of Covid. You could go to Walmart though.
Proving AGAIN if government is involved it will be broke. They don't care as long as they collect that money from tags both resident and non resident. As far as calling hunting a sport for me anyway devalues the experience. Hockey is a sport, motocross is a sport. Hu ting is a way of life, life lessons, respect, knowing where your meat came from and above all being a conservationist.
Have you contacted anyone for legal advise besides the Agency? From your video it appears that you have a strong case to present before a Judge. Let the court interpret the LEGAL difference between "take" and "recover" so the lawmakers are either going to have to change the wording completely or make a completely new law. And if the the court ruled recovery to be legal they would need to challenge that in a higher court. Good luck to the hunters in IL!!!
This is so irritating. I saw the short clip and had to try to find this full video! I live in Michigan and on page 25 in the handbook that came out a day before bow opener says essentially the same thing as Illinois law. Super irritating because I lost a deer that I would most likely would have recovered.
My cousins are avid coyote hunters here in Indiana. They were given an opportunity to go coyote hunting in Illinois. After looking at all the rules and regulations they had to follow, being they were non-residents and didn't have a FOID, they said screw it and didn't go.

I went down this road with PA game commission. One of their arguments were what if the animal is still alive and to that I said there needs to be somthing written that if the animal is still alive it cannot be pursued until the next legal shooting light giving the animal time to expire or move on.

In my opinion the meaning of "take" in their law would mean to kill or harvest, not to recover. I would definitely try to get the wording changed to allow drone recovery , there has to be someone in the Legislature that is willing to propose a bill. Good luck guys!

It's federal law that if you fly a drone commercially you have to be licensed. Also the drone has to be within the line of sight of the drone operator.
My buddy shot a big buck Sunday. We tracked him 2 miles found 4 beds with blood then he crossed the highway and we couldn’t pursue. He was going back the next day to pick up the track.
As long as this is not used as a reason to trespass on someones property you have not received permission to be on, or better yet, prior permission to be on, to recover downed game, I would agree there needs to be an amendment to the game laws in my home state of Illinois. A large percentage of hunters, both resident and non resident, are not taking into account the very obvious reaction, especially in archery hunting, the deer are going to run after the shot. Yes, possibly onto the next property. Rather than get ahead of this issue by contacting neighbors BEFORE they hunt, they wait until they have an issue like this, and feel they should have the right to trespass in order to recover. If a neighboring land owner doesn't want you on their property for any reason, you should respect this and take it into account when you hunt. It's also the law in Illinois that you must have permission to cross property lines to recover game. You may have to walk away from your harvest if you do not do your due diligence before you hunt. Most property owners will allow you access to recover, but as a hunter you should never feel you have a right to trespass on any ones property for your sport. I think the definition of TAKE needs to be clarified in Illinois game regulations and RECOVER needs to be clearly regulated. I am a drone pilot licensed with FAA under 107 and drones can cause issues with livestock and pets. By law a property owner has rights to all that is below their property and above it, unless they have severed the rights. They also have a right to privacy and feeling safe. Not sure I would appreciate a drone over my property looking down on me if I wasn't made aware of it first. Drone recovery for down ,or presumed down, game, YES as long as all affected parties are aware of the effort.
United States v. Causby & The Air Commerce Act of 1926 may have you rethinking the airspace above your property. It is not ok to loiter and spy on people obviously, but technically speaking you own about 83’ of airspace above property. A number that seems to have been arbitrarily chosen based on the circumstances of the respondents in this case. I believe there is a right way and a wrong way to search based on given circumstances. I would call a game warden every time on a drone recovery for documentation that could be used to help get this ridiculous law changed. I hunt in Illinois every year as a non resident and would be willing to use this to help recover a deer
If I hunted there and needed a drone to recover my deer I would have them cone out and find my deer and I will and I say again I will go recover my deer. That's an asshole law
Everyone needs to sign the petition that they have linked. I also have started a Facebook group. Petition to change IL drone laws regarding deer recovery. As soon as I get enough people to back it my attorneys are going to start the court process. There is power in numbers.
Is there a petition that doesn’t require a fee? I’m from Louisiana and this doesn’t directly apply to me but it makes me sick knowing that animal went to waste. The way we were raised is that you don’t waste what you kill. I’d like to have a say in this.

A buddy just told me that dogs are now legal to track wounded deer in RI. We are so behind in this state and I think it’s all due to distrust from lawmakers. You’d think they would promote the elimination of waste when it comes to wild game animals. I know guys who just give up when they can’t follow a blood trail any further. The use of tracking dogs was long overdue. The use of drones will suffer in the same way.
As an Illinois hunter, please note there are lots of silly laws here. For gun season, you need to have permission to hunt within 300 yards of a dwelling without permission from the dwellings owner. Essentially, anyone with less than 40 acres is probably breaking a law during gun season. I honestly know of dozens of hunters that break this law every season because they wouldn't be able to hunt their own private property if they follwed this law. We also have to be 100 yards away from another's dwelling for archery season.

I was told by my local conservation officer that “you are in pursuit of the animal until you know it is dead. Therefore you are pursuing that animal with a drone because you don’t know it is dead.” That is how it translates
Ok so then why are dogs allowed to pursue a track, wouldn’t that be harassing the deer if it is bumped as they bark and startle the deer. Now to mention the tracker putting another shot on deer so now they used a dog for hunting. With a drone you can’t harass it at 400ft or finish it off if it tries to get up and run.
Still doesn't make sense. If that were the case, they shouldn't allow the drones at all then. But they clearly allow the drone to confirm it is dead, but once confirmed, can't remover it. Bass ackwards.
So if I fly a drone for the reason of taking pictures of my property for a sale. That would consider pursuing deer or harrasing deer if you happen to have a deer near your house or barn. Or just taking aerial pictures of a food plot you have and adding that I to the real estate listing. The rule is so ridiculous! New York has the same law! Another absolutely ridiculous state and I honestly do believe these law makers don’t have a clue and don’t know the first thing about wildlife or conservation!
The only problem i have is you say it should be legal to use a drone to find deer if you hunt the following day. As a hunter for 61 yrs. now in Pa. where a drone is also not legal to hunt many big bucks find one place to hide where hunters won't go. So once found the following day makes no difference you have found a live deer in it's bed where most hunters would never look. So you may have a problem there I like the idea of using a drone why let a deer lay & rot makes no sense!

I watched the neighboring farmer spray a fungicide on standing corn this year about 15-20ft. above corn. Witnessing 3 deer run out. This I say is harassment!!! I've not heard IDNR issuing any tickets for this to date.
Based on the IL interpretation I would seem that if film-makers used a drone while producing a hunting video, they would be committing an unlawful act.
I would think the best bet of getting a firm interpretation of the IDNR law would be to send a letter to the Illinois State Attorney General and getting an opinion from them. If they put out an opinion that drone recovery of the deer doesn't fall under IDNR's law then the IDNR pretty much can't enforce it as they interpret it.
see I feel when they state the definition of take from the DNR I feel like drone deer recovery would not fall under that category just like the other ones and you could use it to recover a deer as it wouldn't fall under any of those actions
I feel some of the laws are made from distrust of hunters. They won't allow recovery with a drone because they believe hunters will start using it to locate animals to hunt. Here in SC it wasn't legal to night hunt hogs or coyotes, now it's still heavily restricted and only allowed outside of deer season plus you have to register with DNR. I'm sure it's because they believe hunters will kill deer at night if hog and coyote night hunting is openly allowed.

Sounds like in Illinois, you need to provide service as "is it dead or alive". It doesn't tell the hunter where it is, just whether they should keep looking or not.

You should push the tax implication more. If the hunter could retrieve the deer, then the hunter would possibly buy another tag to go get another deer. If they can't retrieve the deer, then they are still able to use the tag that they already bought. Retrieving deer means more tax revenue.
In Illinois if I shoot a deer, call you in to locate it, you find it alive and feel it’ll live. You leave and go home. Regardless of how hard that deer is hit, is he immediately legal game for anyone to hunt?

In your description you say to contact your state's official wildlife agencies and authorities. I would argue that it's better to search out the legislative actions to know what draconian, anti-freedom " laws" have been enacted because state agents and DNR officers are not only allowed to lie to the tax cattle, they are trained to do so
I am pro-drone for recovering deer. DNR and lawmakers have a lot of what if scenarios to consider. Mike is presenting the cleanest situation... deer is dead, hunter couldn't find it, drone finds it, deer gets recovered. One step toward gray area would be drone finds deer suffering with eventual mortal wound and hunter uses intel from drone to finish off the animal. Grayer still would be drone finding a live deer and it can't be determined if hit will be lethal or not and hunter finishes off the deer. Getting into the darker side is drone finds a deer with non-lethal wound and hunter uses info from drone to locate and shoot the animal. Total dark side would be people illegally using drones to locate and kill deer they hadn't previously shot, stick it again with an arrow and claim they used the drone to track it after it was wounded. I've hunted for 45 years and again, I'm pro drone... just trying to open the thinking a bit about why many states may have hesitancy toward the technology.
The exprnse of a thermal drone should hinder most people from illegally using it to hunt. But I'm with you that there is a gray area. But them again there always is. Maybe the pilot can locate it, but can't give coordinates or watch the recovery process, unless the deer is confirmed dead by the operator. If confirmed wounded, maybe could give a general area

50 years living in IL. Beautiful state. Ugly politics. We have many rules and Regs that don’t have the hunter or genuine conservation in mind. Don’t mention gun laws! But hey people only come here to hunt deer, so we have lots of peace and quite till gun season…
To use a drone commercially you need to be licensed. Also the law in all states is that your drone must be within your line of sight at all times. So legally you can't do this as I understand it. To do this legally you would need to start with the FAA. Not your state department.
There’s always some sort of person that agrees with every law no matter how unconstitutional. It’s his property he should be able to do what he wants he’s not hurting anyone or bothering anyone man just wants to feed his family.

I am from Alaska, I use the drone also to go up a steam before I go fishing to check for bears not to have a bad surprise.

I went down this road with PA game commission. One of their arguments were what if the animal is still alive and to that I said there needs to be somthing written that if the animal is still alive it cannot be pursued until the next legal shooting light giving the animal time to expire or move on.
They werent trying to hear it...sold my drone and moved on...depressing because I absolutely had a blast doing it

Great video Men, and thank you for highlighting the shameful stance of the IDNR in not allowing the use of drones for recovery. DDR does not go against statute. The interpretation of the statute by IDNR Officers is wrong, and it could have been allowed. Who made that call? Was it you, Jed?

In my opinion the meaning of "take" in their law would mean to kill or harvest, not to recover. I would definitely try to get the wording changed to allow drone recovery , there has to be someone in the Legislature that is willing to propose a bill. Good luck guys!

There should be absolutely 0 limitations to the recovery of game short of trespassing. I don’t know how a dead buck rotting on especially private land does any good for anyone

It's federal law that if you fly a drone commercially you have to be licensed. Also the drone has to be within the line of sight of the drone operator.
My buddy shot a big buck Sunday. We tracked him 2 miles found 4 beds with blood then he crossed the highway and we couldn’t pursue. He was going back the next day to pick up the track.
As long as this is not used as a reason to trespass on someones property you have not received permission to be on, or better yet, prior permission to be on, to recover downed game, I would agree there needs to be an amendment to the game laws in my home state of Illinois. A large percentage of hunters, both resident and non resident, are not taking into account the very obvious reaction, especially in archery hunting, the deer are going to run after the shot. Yes, possibly onto the next property. Rather than get ahead of this issue by contacting neighbors BEFORE they hunt, they wait until they have an issue like this, and feel they should have the right to trespass in order to recover. If a neighboring land owner doesn't want you on their property for any reason, you should respect this and take it into account when you hunt. It's also the law in Illinois that you must have permission to cross property lines to recover game. You may have to walk away from your harvest if you do not do your due diligence before you hunt. Most property owners will allow you access to recover, but as a hunter you should never feel you have a right to trespass on any ones property for your sport. I think the definition of TAKE needs to be clarified in Illinois game regulations and RECOVER needs to be clearly regulated. I am a drone pilot licensed with FAA under 107 and drones can cause issues with livestock and pets. By law a property owner has rights to all that is below their property and above it, unless they have severed the rights. They also have a right to privacy and feeling safe. Not sure I would appreciate a drone over my property looking down on me if I wasn't made aware of it first. Drone recovery for down ,or presumed down, game, YES as long as all affected parties are aware of the effort.
United States v. Causby & The Air Commerce Act of 1926 may have you rethinking the airspace above your property. It is not ok to loiter and spy on people obviously, but technically speaking you own about 83’ of airspace above property. A number that seems to have been arbitrarily chosen based on the circumstances of the respondents in this case.
I believe there is a right way and a wrong way to search based on given circumstances. There’s alot at play for sure, and alot to be considered. Great comment
I would call a game warden every time on a drone recovery for documentation that could be used to help get this ridiculous law changed. I hunt in Illinois every year as a non resident and would be willing to use this to help recover a deer

If I hunted there and needed a drone to recover my deer I would have them cone out and find my deer and I will and I say again I will go recover my deer. That's an asshole law

Everyone needs to sign the petition that they have linked. I also have started a Facebook group. Petition to change IL drone laws regarding deer recovery. As soon as I get enough people to back it my attorneys are going to start the court process. There is power in numbers.
Is there a petition that doesn’t require a fee? I’m from Louisiana and this doesn’t directly apply to me but it makes me sick knowing that animal went to waste. The way we were raised is that you don’t waste what you kill. I’d like to have a say in this.

A buddy just told me that dogs are now legal to track wounded deer in RI. We are so behind in this state and I think it’s all due to distrust from lawmakers. You’d think they would promote the elimination of waste when it comes to wild game animals. I know guys who just give up when they can’t follow a blood trail any further. The use of tracking dogs was long overdue. The use of drones will suffer in the same way.
Some group needs to file a suit against the state regarding recovery.

As an Illinois hunter, please note there are lots of silly laws here. For gun season, you need to have permission to hunt within 300 yards of a dwelling without permission from the dwellings owner. Essentially, anyone with less than 40 acres is probably breaking a law during gun season. I honestly know of dozens of hunters that break this law every season because they wouldn't be able to hunt their own private property if they follwed this law. We also have to be 100 yards away from another's dwelling for archery season.
Thought about getting into your recovery business last year but knew as a resident in this ridiculous state it was illegal! Ill keep using my Blood hound for now. Sucks!!!

I was told by my local conservation officer that “you are in pursuit of the animal until you know it is dead. Therefore you are pursuing that animal with a drone because you don’t know it is dead.” That is how it translates

Ok so then why are dogs allowed to pursue a track, wouldn’t that be harassing the deer if it is bumped as they bark and startle the deer. Now to mention the tracker putting another shot on deer so now they used a dog for hunting. With a drone you can’t harass it at 400ft or finish it off if it tries to get up and run.
Still doesn't make sense. If that were the case, they shouldn't allow the drones at all then. But they clearly allow the drone to confirm it is dead, but once confirmed, can't remover it. Bass ackwards.
So if I fly a drone for the reason of taking pictures of my property for a sale. That would consider pursuing deer or harrasing deer if you happen to have a deer near your house or barn. Or just taking aerial pictures of a food plot you have and adding that I to the real estate listing. The rule is so ridiculous! New York has the same law! Another absolutely ridiculous state and I honestly do believe these law makers don’t have a clue and don’t know the first thing about wildlife or conservation!
The only problem i have is you say it should be legal to use a drone to find deer if you hunt the following day. As a hunter for 61 yrs. now in Pa. where a drone is also not legal to hunt many big bucks find one place to hide where hunters won't go. So once found the following day makes no difference you have found a live deer in it's bed where most hunters would never look. So you may have a problem there I like the idea of using a drone why let a deer lay & rot makes no sense!

I see you also spray agricultural fields with drones. Have you done any here in Illinois? I watched the neighboring farmer spray a fungicide on standing corn this year about 15-20ft. above corn. Witnessing 3 deer run out. This I say is harassment!!! I've not heard IDNR issuing any tickets for this to date.
Based on the IL interpretation I would seem that if film-makers used a drone while producing a hunting video, they would be committing an unlawful act.
Here in New Jersey you are not allowed to do anything related to deer with a drone!
I would think the best bet of getting a firm interpretation of the IDNR law would be to send a letter to the Illinois State Attorney General and getting an opinion from them. If they put out an opinion that drone recovery of the deer doesn't fall under IDNR's law then the IDNR pretty much can't enforce it as they interpret it.

see I feel when they state the definition of take from the DNR I feel like drone deer recovery would not fall under that category just like the other ones and you could use it to recover a deer as it wouldn't fall under any of those actions
I feel some of the laws are made from distrust of hunters. They won't allow recovery with a drone because they believe hunters will start using it to locate animals to hunt. Here in SC it wasn't legal to night hunt hogs or coyotes, now it's still heavily restricted and only allowed outside of deer season plus you have to register with DNR. I'm sure it's because they believe hunters will kill deer at night if hog and coyote night hunting is openly allowed.

First, if you want to ban something ban wireless game cameras. Second, this is one of those laws that you break because it has no sensible function. Wasting the animal is wrong in every way.

Sounds like in Illinois, you need to provide service as "is it dead or alive". It doesn't tell the hunter where it is, just whether they should keep looking or not.
Do you have a " united state's map " on your website, where - showing what states allow drones and what states dont??? If not, there an idea, to input on your website, to inform people!
Does fair chase apply to when the state uses technology to hunt down people that are suspected of violating one of the one 10,000,000 laws on the books in the USSA, or does it only apply to people that use it to feed their families?

You should push the tax implication more. If the hunter could retrieve the deer, then the hunter would possibly buy another tag to go get another deer. If they can't retrieve the deer, then they are still able to use the tag that they already bought. Retrieving deer means more tax revenue.
In Illinois if I shoot a deer, call you in to locate it, you find it alive and feel it’ll live. You leave and go home. Regardless of how hard that deer is hit, is he immediately legal game for anyone to hunt?

In your description you say to contact your state's official wildlife agencies and authorities. I would argue that it's better to search out the legislative actions to know what draconian, anti-freedom " laws" have been enacted because state agents and DNR officers are not only allowed to lie to the tax cattle, they are trained to do so

I am pro-drone for recovering deer. DNR and lawmakers have a lot of what if scenarios to consider. Mike is presenting the cleanest situation... deer is dead, hunter couldn't find it, drone finds it, deer gets recovered. One step toward gray area would be drone finds deer suffering with eventual mortal wound and hunter uses intel from drone to finish off the animal. Grayer still would be drone finding a live deer and it can't be determined if hit will be lethal or not and hunter finishes off the deer. Getting into the darker side is drone finds a deer with non-lethal wound and hunter uses info from drone to locate and shoot the animal. Total dark side would be people illegally using drones to locate and kill deer they hadn't previously shot, stick it again with an arrow and claim they used the drone to track it after it was wounded. I've hunted for 45 years and again, I'm pro drone... just trying to open the thinking a bit about why many states may have hesitancy toward the technology.
The exprnse of a thermal drone should hinder most people from illegally using it to hunt. But I'm with you that there is a gray area. But them again there always is. Maybe the pilot can locate it, but can't give coordinates or watch the recovery process, unless the deer is confirmed dead by the operator. If confirmed wounded, maybe could give a general area

I can understand the laws for the simple aspect of poaching laws.some fly in states prohibit hunting the same day as landing but loss and rotting of a game animal it should.be were you or someone else can claim and either tag or permitted a animal same as a road kill mistake kill with penalty.

50 years living in IL. Beautiful state. Ugly politics. We have many rules and Regs that don’t have the hunter or genuine conservation in mind. Don’t mention gun laws! But hey people only come here to hunt deer, so we have lots of peace and quite till gun season…

To use a drone commercially you need to be licensed. Also the law in all states is that your drone must be within your line of sight at all times. So legally you can't do this as I understand it. To do this legally you would need to start with the FAA. Not your state department.
