      Kinda makes me curious. _Do_ Canadians have applicable rights in this situation? In the US she could have refused to answer questions, and the cops can't detain you like that for long periods of time without charge, but is that true in Canada?

    • @ironhead2008

      @RobertLutece909 iirc in Canada, you can assert your right to silence and right to a lawyer, and they'll call the lawyer, but they aren't required to stop questioning when you invoke your rights. Besides that I think it's mostly the same as the US.

      @@RobertLutece909 This "In the US she could have refused to answer questions, and the cops can't detain you like that for long periods of time without charge" is absolutely not true while it does vary by state the mean average period for detention is 24hrs without probable cause i.e. without charges being levied, some states go for longer mine in particular is 48hrs and if no charges are levied against you within that time they legally cannot detain you for longer.
      When it comes to refusing to answer questioning that part is largely correct, once they begin to ask questions you can invoke your right to a attorney, at which point they will take you down to the station and wait for your attorney to show up before they resume questioning. Alternatively you can stay silent at which point you'll likely be read your Miranda rights and the same aforementioned process will enfold, they absolutely will not let you go if you take either of those courses of action, since they assume you've got something to hide/be defensive about.
      Suffice to say you are better off just answering their questions on the spot, otherwise you're just gonna drag out the process and annoy the LEO's to the point where they will try to find something to press charges with, generally speaking if your cooperative, polite and honest the LEO's will tend to give you quite a bit of leeway out of courtesy for not making their job more difficult, since while not true in all cases but the majority of LEO's tend to prefer not to screw with people if they do not have to, you get some bad apples among the bunch just like in every occupation, so you just gotta gauge the situation if it happens to you.
      While I'm not versed in Canadian law, given the situation Dizzy took the right approach here by being cooperative and from my understanding iirc she has stated before that shes in BC, which does have quite the substance abuse problem and given what she said of her appearance at the time, she very likely fit a profile and likely why she was stopped to begin with, especially if the LEO was asking her stop before she heard him this likely raised the LEO's suspicions of her.

      @@HypnoticChronic1 Yes, in the US the cops can arrest you and detain you but not unless they have cause to believe a crime has occurred. A cop who just happens upon you holding a box of cookies can't hold you for 24 hours. In my state it's an hour or two (I forget the exact time). Once you announce you don't want to answer questions and force the cop to say he's detaining you, the clock starts.
      If, for example, he's waiting for a dog for a drug search and the K9 unit is too far away to arrive in time, he has to cut you loose.
      Incidentally, it's never, ever a good idea to talk to the cops. Even if you've done nothing illegal ever in your life:

    "I probably have rights" 🤣
    But, seriously, that's understandably unnerving! I mean, I'm autistic, so I tend to talk to myself out loud, and make certain movements in public that I fully understand look weird to the outside world, as well as being male and, even though I don't think I come across as threatening, I'm not very tall, small-framed and when I was younger looked a bit more androgynous, but at the same time I'm still aware that you have to be careful about how you act around women and children in public as an adult male, so I can understand how the authorities might assume you're maybe on something if you behave slightly unusual in public, but dear God, TWO HOURS!!! Seriously, how much of a threat to public safety is a slim Asian woman walking down the street in Canada to merit that level of intrusion?!

    • @jamiearmstrong3487
      @jamiearmstrong3487 Месяц назад +13

      I think it was more of an easy pick, than actual threat.

    First mistake dizzy was not calling him a Muni Mall cop. Vancouver police are not the RCMP; and the RCMP abducts native girls. So the only response that you should give as a women is, am I under arrest? what are my charges? You may not search my belongings. I do not have to provide you with identification. What is your Government issued ID, and 'officer number'.
    Once had a Vancouver cop pull his handgun and laze my face, for having an open beer on the streets... while a women was foaming at the mouth from shooting up right beside him. I correctly informed him that threatening one of the kings men was a federal office with life in prison... he escalated.
