Personally i feel like the mlb and the player himself can also get involved in the lawsuit if they felt like as they would have higher rights to the ball but it may hurt them that they let people take the ball for themselves. Be interesting either way
Ironically this court case will increase the baseball’s value. Given that there is going to be a court ruling on definitive ownership increasing the province of the item.
If there's video of this, the scumbag who did it needs to be charged with assault and robbery of the appraised value of the ball. Not that I expect the justice system to actually work for the innocent or anything.

Wouldn't this be conversion according to the letter of the law? It really sounds like someone stole something that belongs to someone else and is now attempting to convert it into cash. That's the civil side of it. But whether or not this kid's injunction is granted, where are the criminal charges against the alleged thief? Since we know that civil and criminal have two different standards of proof, why not let a jury decide on both. Obviously grant the injunction in the meantime if its warranted. But the buck should not stop there. Also, the person(s) responsible should be banned from attending future games. Anyone who wants to make excuses for them can join them at the sports bar because there should be no place for people like that amongst fans who know how to behave themselves in public. It just ruins the experience for everyone.
He won't win. The video is either inconclusive or disproves his case. What I see is the teen standing upright with a man to his right on his knees obviously with the ball between his legs. "Florida law defines battery as intentionally touching or striking someone without their consent, or intentionally causing bodily harm to another person. Battery is a first-degree misdemeanor, punishable by up to one year in jail and a $1,000 fine. However, there are several circumstances where the charge can be upgraded to a felony...."
Broke my heart when that little kid caught a foul ball, right on the TV camera, and some POS grabbed it away from him.
There are good people left, though. Just saw a video where an intoxicated gentleman at Disney was verbally abusing a young woman with Down's Syndrome, and was immediately pounced on and beaten by angry onlookers.
IF the ball was indeed Ripped out of the hand of the 18 year old, wouldn’t that be something that could result in a Felony Burglary Charge??
(I’m not a lawyer, but I’ve watched a lot of “Lehto’s Law”)
PLEASE keep this updated! And I agree, the ball should be given to the birthday "boy!"
Personally i feel like the mlb and the player himself can also get involved in the lawsuit if they felt like as they would have higher rights to the ball but it may hurt them that they let people take the ball for themselves. Be interesting either way
its clear to me that the kid should have been ARMED when the ROBBER STOLE FROM HIM!
Those guys obviously STOLE the ball from the kid. They should be forced to give it back, and be charged with grand theft.
Ironically this court case will increase the baseball’s value. Given that there is going to be a court ruling on definitive ownership increasing the province of the item.
Have the umps been called in for a ruling?
If there's video of this, the scumbag who did it needs to be charged with assault and robbery of the appraised value of the ball. Not that I expect the justice system to actually work for the innocent or anything.
Its like Frank Barone pushing a kid out of the way at the Hofstra University football game to catch the record game winning 68 yard field goal and then wanting to sell it to the college to give to the kicker. Lol
If you catch it and get mugged I would call that stolen. People don't do that to 99% of baseballs because they aren't worth anything.
Reminds me of the very first case in my very first class as a 1L: the property law case of Pierson v. Post (who owned the chased wild fox) … the first person to take control & possess has the ownership rights.
I'll be honest, if you could steal a small object from a child and get life changing money most people would do it.
He won't win. The video is either inconclusive or disproves his case. What I see is the teen standing upright with a man to his right on his knees obviously with the ball between his legs. Perhaps not in his grasp but obviously trapped. The teen then reaches down between the man's knees blindly grasping for the ball. I don't see the ball until the man stands up with it in his hand. The teen didn't go after it like the others and simply saw an easy opportunity for an easy snatch. Not once do you see the teen with the ball or even a clear opportunity for him to actually have the ball.
If this kid had the ball and it taken from him the guys involved should be banned for life from all attending Baseball games.
the dude clearly stole the ball from this young man and really should be locked up. glad this young man is standing up for themselves
Give the kid the ball back and arrest the older guy for robbery and assault,
Wow Steve, you are so hip in your Moose's Tooth T Shirt. Now you need one from Kaladi Brothers.
Who was the original owner of the ball before it was hit. I wonder at what point they stopped being the owner. Would the ball be considered a gift?
Jomboy had a breakdown on this. It’s pretty clear the kid never had the ball.
Now now steve you might be on to something, i say the strongest get to keep the ball. It'll add excitement to the game you get baseball + mma all in 1 sport
Yeah, but i've seen so many grown adults ripping balls out of kids hands on television.
Hope the 18y/o kid who appears the rightful owner gets the baseball back!
And he should sue the guy that took it from him, for mental anguish etc!
Criminal charges should be brought against the guy that took it too!
🤔🤞🙏

TEXAS
HAVE A GREAT WEEKEND EVERYONE!
I thought it's a free-for-all at games? Stronger man wins?
Sounds like assault, battery, robbery and felony theft to me.
The judge may need to refer to the definition of a catch in the official baseball rules, and cite case law by Joe West
Simple solution: balls hit into the stands still belong to the team, and must be returned to them. Then there's no reason to resort to robbery to get a ball.
Going to the review official to see if the kid had both feet down when he established control.
I saw the video yesterday, there was no visible evidence that the kid had the ball at all.
We just need football referees in the stands for baseball games.
How would you know if you ever got the actual ball at this point?
Yes Steve, there never be anything like Tiger Stadium again.
Hope he wins. They caught a lady doing the same to a kid.
Seahawks vs Greenbay, tie ball goes to the offense.
The video shows the adult stealing the ball.
The kid had the ball ripped out of his hand. He needs to sue!!!
It looks like he didn't have control of the ball
You send the MMA guys to the ball thief's house
How is it ok to steal bases multiple times but not one little ball?
I have seen similar things happen at baseball games
Slo-mo instant replay, please!
Charge him with assult and theft
Why not show the video?
Steve very rarely shows and video or pictures
Copyright claims and time editing.
I hope we get an update on this story
Darn you should show the video
Possession is 9/10's of the law
The kid should be the winner!
Finders losers /finders weepers .
