2 sign of Second pillar is calling of the Athan, - If the Athan was heard the Sahabas Radiyallahu anhum would not invade. This matches the hadith don't fight your rulers as long as they pray.
Narrated Humaid:
Anas bin Malik said, "Whenever the Prophet (ﷺ peace and blessings on him) went out with us to fight (in Allah's cause) against any nation, he never allowed us to attack till morning and he would wait and see: *if he heard Adhan he would postpone the attack and if he did not hear Adhan he would attack them.* "Anas added, "We reached Khaibar at night and in the morning when he did not hear the Adhan for the prayer, he (the Prophet ) rode and I rode behind Abi Talha and my foot was touching that of the Prophet. The inhabitants of Khaibar came out with their baskets and spades and when they saw the Prophet (ﷺ peace and blessings on him) they shouted 'Muhammad! By Allah, Muhammad and his army.' When Allah's Messenger (ﷺ peace and blessings on him) saw them, he said, "Allahu-Akbar! Allahu-Akbar! Khaibar is ruined. Whenever we approach a (hostile) nation (to fight), then evil will be the morning of those who have been warned."

So in this sense this is the Minimum outward Muslim state. The rest is Ihsan and corrected by Dawa!
3 Zakat was collected, Yes Abu Bakr fought the people who withheld Zakat however among some of them was Musailimah al Dajjal and was Zakat given personally during Uthman Radiyallahu anhu's time?
4 Fasting is a special act of worship with Allah that one does personally.
5 Hajj is only done in Saudiyah.
On the authority of Tameem ibn Aus ad-Daree (ra):
The Prophet (ﷺ peace and blessings be on him) said, “The deen (religion) is naseehah (advice, sincerity).” “To Allah, His Book, His Messenger, *and to the leaders of the Muslims and their common folk.”*
- Sahih Muslim 55, Kitab Iman.
The Leaders and common folk were separated due to mannerisms of dawa to them being separate!
There are the 5 protected pillars in Shariah - Din, Life, Mind, Family and Wealth.

For a judge, if ijtihad is correct its 2 rewards, if he is wrong he gets one reward. - so after affirming the law, if they error they still get a reward, so its not an Aqida issue...

Husain & ibn Zubayr are note Muhajirun or Ansar & didn't revolt & excused!
This shows how colosally ignorant the kawarij are!

ibn Abdul Barr in Kitab Tamhid Vol. 16 pag 358, that oppressive rulings is major sins, one who does it by accident is less.
Bro the leaders or today don't just "not rule by shariah".
Rather they have totally removed shariah and replaced it with a completely different law(un law, French law, english law, tribal law etc) ... Their situation is comparable to that of the mongols who claimed to be Muslims but ibn taymiyyah encouraged to wage j against them as they ruled by their own tribal laws😊

How much removing changes it from beyond a major sin. Quran 5.47 says who don't rule by sharia is a fasiq.
Keep in mind prophet Muhammad peace and blessings be upon him waited for the athan being missed before going to kaibar, so isn't the athan along with a Muslim ruler who believes in hadith Jibril the minimum to recognize a Muslim state?

every unjust takfir comes back to oneself. This is very scary. Imagine doing all this takfir but you pray, fast, give zakat. Then you stand before Allah, the most high, as a disbeliever because you couldn‘t hold your tongue.
