Every truck driver knows the rules and the consequences for breaking them, and you cannot blame anyone for trying to talk their way out of situations. However, as professional drivers they should be held to the same or higher standards, and the penalties should be strictly enforced.

For those of you who are unaware of the EC tacho regulations. The law ALLOWS drivers to drive to a safe stopping place i.e a motorway/dual carriageway service area if 4h 30m driving time cannot be avoided because of a road traffic accident or a sudden road closure. This is classed as an unforseen circumstance. The reason for the circumstance MUST be written on the back of the drivers analogue paper disc or digicard receipt and signed/dated and then kept in a diary incase of an inspection. To prevent a breach of 4h 30m driving from happening as a regular occurance a professional drivers journey from A-B can be broken up by service stations or truck/coach parking area along the route. If your journey takes 4 hours driving time or slightly more to drive and your not confident if you can do it in one stint. You can easily use a concise road atlas to locate a service station marked as 'S' on the map that sits roughly around half-way inbetween your A-B journey so you can spend 45 minutes there instead of risking it. Or, you can find two service stations and spend 15 minutes at the first stop, then 30 minutes at the second stop. In my experience of doing this job. There is no need to do what this **** is doing which is deliberately run your driving time out all the way to the limit of 4h 30m then knowingly pick a dangerous place to take a 45 minute break and then argue your point with officers. Your breaks can be split up legally and very easily if you plan your journey properly. Any experienced driver knows how to do this to avoid tacho infringements and inappropriate parking aggravation. When truckers do what this trucker is doing it shows that they are inexperienced and don't know how to plan a route.

Not really. He's pulled in to a lay y, or at least what he thought was a layby. It clearly stated end of motorway restrictions on the slip, there was no signs saying he couldn't be there. And he needed his 45 break. If you don't stop and take your breaks according to the drivers hours regulations then it's a £1500 on the spot fine. He was just trying to do the right thing. Drivers are under so much pressure especially these days.

A few comments on here saying he's doing it in on purpose, maybe he is and maybe he's not but at least he's highlighting the fact that the UK is a joke when it comes to parking HGVs.
Most services are full and you have to pay and many lay-bys now aren't big enough for the amount of traffic we now have on our roads!
When you drive on the continent there's plenty on parking in between services which is all free with toilets and sometimes showers, I don't miss driving lorries one bit as the majority of the British public think trucks are on the road to piss them off and their food magically appears on the supermarket shelves over night!

This site has a VOSA vehicle examination station on it, therefore the land is owned by the Ministry of Transport making it 'Crown Property'. Trespass on crown property is a criminal offence, not the usual civil offence, obviously it is up to the officer dealing with the matters discretion as to how they deal with it, but they do ultimately have to power to arrest the driver of any unauthorized vehicle on the site or it's access roads and remove their vehicle.

it is a little thoughtless of the driver but he is the easy target for police-ish it is a joke that on the motorway in front of them there are laws that say do not travel in the outer lanes unless you are overtaking but since this law came in i see them used more and more as a cruising lane and the fast lane as a special lane for BMW/audi,s and 4x4's this and hgvs using the outer lane to overtake on duel carriageways and taking 1 or 2 miles to do it holding every one up ,if the police want to sort traffic violations out start there, the police are useless

There is no enforceable signage nor road markings to say he cannot stop there. Was he blocking the access to the works area? No. Was he blocking access from the works area to the A1M? No.
I expect you were the power-tripping womble that took it upon yourself to "report" him even though he was not breaking any law, and it really pissed you off that the driver didn't argue back and just said "ok that's fine". Not satisfied with that you had to have another go and threaten him with VOSA instead because he didn't massage your ego like you were expecting.
Good on you Mark. Someone needs to stand up to these jumped-up little Hitlers throwing their weight around, abusing their authority and making up rules as they go. They expect everyone to buy their bullshit and just say "yes sir, no sir" with no arguments.

"it's a legally enforceable offence to fine you for parking there". Please quote the exact section and number of law that your fine would be based on.

This one is used to get up to speed. To merge on to the motorway. Even after being instructed to move this too is questioned! Man, get out of it! Learn the code of conduct and why must there be such a condescending attune on display towards those who are attempting to correct you? What kind of example are you setting to theirs also wanting to defy authority. What example to the youth who would learn so much from their elders? This is a pitiful demonstration of rebelliousness towards authority only ever really seen among self proclaimed delusional sovereigns. Time to literally start ‘acting your obvious years of seniority!

The road closure officers demonstrate their ineffectiveness and their ignorance of the current legislation, provided the HGV does not block access to other users he was within his lawful right to be parked their, it is clear from the ground that it is frequently used for HGV parking, i HAVE NO DOUBT THE ROAD CLOSURE OFFICERS ARE AWARE OF THIS AND HAVE LORDED IT OVER MANY A DRIVER IN THE PAST, instead of liaising with highways to designate the road as not for parking.
