Depending on your case, you can get like a 7 day ban or sometimes you can get banned for like 30 years. I know that because I got banned for like 30 years in FH4 and recently got a warning in FH5.

You can get a hdmi splitter, it duplicates the video feed from the xbox to the tv and connected pc, which you can record from.
