- Adverse possession describes a situation in which someone can legally claim ownership over another person’s private property - and you don’t want it to happen to you.
While it is indeed possible for a squatter to claim ownership over a property he or she has inhabited under certain circumstances, it’s probably not a likely scenario in your home. But adverse possession can also apply if your neighbor infringes on your property line with a fence or driveway. If you don’t take appropriate action, the same legal loophole that bestows squatters’ rights could end up forcing you to forfeit part of your property to your neighbor.
In this Real Estate Minute, I run through the general rules governing adverse possession. These laws are often highly variable from state to state, so you’ll want to consult an attorney if you’re dealing with an adverse possession case on your property. It is not that easy now since 2008 ..even some dividers are not considered structures ... for you to claim adverse possession u will have to pay around 5000 or more to start the process ...

I'm sure she would do whatever possible to resolve that problem if she had a crystal ball 🙄 what the fuck. How about offering a solution and/or spreading the word about the site and valued information it provides rather than trying to compliment the creator by pointing out a negative 😉...just a thought

How about a neighbor who buys a house next to you a few months after you buy your house then they come onto your woodland which is out of ight of you house and weedwhack your streambed when you are not home and voila, a buried, plastic 4 inch pipe is exposed, sticking out of the bank of the stream bed? It is a buried downspout extension tat runs to a stream on our land. It was buried when we bought and may have been buried when the neighboring house was built. Would that constitute continuous, open and notorious use of that land the pipe is on? Over 99% of the pipe is buried as it crosses their property and our land. The video says if you do nothing about it, but if you challenge it, you affirm the hostile nature. the law is so counterintuitive. My lawyer just wants to send them a permission letter via certified mail and hope they sign it -- he says they dont sign it, all we can do is start sending demand letters. Seems like we're screwed either way. they want the whole area the pipe is on.

I hired an attorney and all he wanted to do was give the neighbors a permission letter so that their downspout pipe I found buried on my land could remain on my land and they could continue hanging out on my land. No way. I told them to please move it. If they do not, I'll dig it u and move it. They buried it on the backside of my trees but 30 feet into my property to dump out into a stream that runs on their land too. Some people are so entitled.

The state I live in has 21 year on adverse possession I recently had survey done discovered he has. 6 feet
I have a situation where I purchased several machines located at businesses. At one location I was informed that the business owner was now the owner of the two machines at his location since the previous vendor did not service the machines for two months. I purchased these two newer machines from a bank. The bank went to talk to this business owner several times with no luck on selling the machines to him or getting the machines back. The business owner had broken into the machines and changed the locks. Any advice ?

This is how my aunt’s husband’s family took her property. They put her in a nursing home after he passed and moved into her house. Had the nieces husband file the paperwork and it went uncontested

Person A owns a parcel of land and is paying taxes on it but person
B who joins with the property forces a easement across person A's property. And then claim all the parcel of land. Can person A do anything to stop the encroachment and end the forced easement?
What do you mean by, "forces a easement across"? B is trespassing across A? Put up a fence or a gate and send B a letter telling him he can't cross. If it's just started, then B hasn't acquired any rights. If B has been doing it for 20 years, then maybe he has.
Are you sure that B doesn't already have deeded rights to cross?

This is a situation in which ownership is not ownership. Another situation is what the law calls an “easement”. On one hand, you own the land. On the other hand, there are restrictions, sometimes extensive, on what you can do/on the land. Is why you need a lawyer in a property line dispute.
