When is someone under duress by threat and when is someone under duress by circumstances.. where goes the line between the two of them? Can you give an example of when something goes under duress by threat and an example of when something goes under duress by circumstance?
Duress by threat is when someone has been given a threat of personally serious harm or death... Duress by circumstances is necessity like let's say we are in a desert and we have no food and we can't be rescued then we decide to kill one of us for food that is necessity which is also duress by circumstances
Shaveen: Do you have any interest in assisting me with a criminal case in Texas. After watching your videos, and doing a lot of research on the Texas Penal Code, it seems like the whole case should be thrown out and have a Malicious Prosecution case filed immediately. Thanks CA
