    Hi, thanks for the informative video, much appreciated! I have a question from a landlord's perspective: I have a tenant who is moving during June - he is in the process of applying for a permit, so obviously all depends on that. If he is able to move, how do I, as the landlord (no agent involved) get a permit to travel (different town, same province) to do the exit inspection? Do I take the requisite documentation to my local SAPS?

    Hi. Obviously it won't always be possible for tenants to take their existing lease agreement with to the SAP, as some tenants may have been renting in terms of an oral lease. Do you expect that to be an issue for the issuing of a permit?

      Lydia Steffens We suggest that they obtain a letter from the landlord confirming their occupation of the current unit.

    What if we do the move ourselves? with a private trailers and truck?

    GOOD QUESTION: What happens in the event that a sales agreement has been entered into between seller and purchaser prior to lock-down (Feb) and the agreement states occupation (occupational rent) is to take place during this window period before 7th June. According to the OTP there is a rental clause which constitutes the same as a rental agreement. Comments???

      In other words, my question: Can the Offer to purchase also be used to obtain the moving permit from police station should the date of agreement of sale be prior to 30th April and date of occupation along with occupational rent be stipulated in the agreement for example 1st of June or prior to 7th June?

      This would be a new rental agreement so a permit may very well be granted, yes. For further advice, please email out legal team on legal@tpn.co.za

    Good day, please advise further in terms of eviction notices? We have a tenant that was serviced eviction papers prior to lockdown; does this classify as part a "new" lease agreement?

      Sean Harris it is best that the attorney who handled the eviction continues to advise on the matter. At present though, the Sheriff is not actioning evictions under Alert Level 4.

    Hi Michelle & Peter, thanks for the info - appreciate it. Question: How do we as agents get to these properties to facilitate the handover of keys and assist with the ingoing inspection? I'll have to cross districts. Thus we'll have to be in possession of a permit as well?

      Shani Teepe that is correct, you need to get a permit ... an estate agency can apply to register as an Essential Service Provider via CIPC. Please see our latest video on this or our blog post on how to do that here: blog.tpn.co.za/2020/05/estate-agents-how-to-get-your-essential.html?m=1

    Are Landlords allowed to issue us with an edict and locks us out/cut electricity and water like we have just been threatened with?

    So if you've signed a lease in May and move in date is 1 June, these tenants cannot move in?

      Tracey Bock that is correct, it applies to leases signed prior to 30 April ... so during lockdown. We are out of lockdown and in Alert Level 4 technically speaking since 1 May. Please feel free to get in touch with our legal team at legal@tpn.co.za
