Best success we had in these situations is letting the shipper know that we’re willing to cut a deal to bring us to break even but if they keep ignoring us we’ll happily file in small claims court… which will result in them spending more in legal fees than what we’re willing to accept, no matter how strong their paperwork with the broker was to absolve themselves, they’ll still have to pay a lawyer(s) to look it over and come to court to explain it to a judge. That’s a minimum of 5 billable hours for any lawyer. Make it clear you won’t be the only loser in this transaction especially since you performed on it.
Collections is useless bc whoever you hire will be working for a percentage of the settlement so they’ll always price gouge what they ask for to the point where no shipper will accept it. They won’t negotiate on your behalf in good faith and will ultimately tell you it’s uncollectable without going to court and it’s not high enough of an amount for them to go that route.
Some people opt out for collection agency, they give you 40% on your amount, and it's not your problem anymore. Better to have a little of something, than whole of nothing.
File a lean on the shipping and on the reciver company then you can sell the debt to a collection agency. You will take a hit on what you get keep in mind this will cause the shipper and reciver big issues with the banks and borrowing money
I would consult with an attorney. I have no idea if you can sue the Shipper/Receiver or not. As for the broker, if they filed CH-7 all you can do is contact the trustee appointed by the US District Court and make your case to him/her. If there’s any money or assets that can be sold that the Broker has that can be dispersed to creditors . Otherwise CH-7 Bankruptcy protects the Broker and wipes out all debts. I would make sure the Broker is qualified to file CH-7. If his/her income is too high they won’t qualify for CH-7 and would be forced likely to have to file CH-13 in which you may receive some money overtime although likely only a portion of the total owed you.
What kind of a gimic is that, they make you drive without paying. You would think in US things like that shouldn't happen, making you work without paying...
Is it just us or brokers have been short paying some of you as well? We’ve been driving since 2015 and never had an issue. In the last few months our factoring company has emailed us about three brokers short paid invoices for no reason.
You really have to be firm concerning your money hold the freight chage for storage tell them get that sh.t off your truck sell the freight they had no attention of paying you call around people will buy a load it's legal

I can help with commercial debt collections for this load. Title 49 indicates that all parties are responsible
