    She 100% needs to be retried. I watched the interrogation video. She fully admitted to pushing her baby's face into the mattress and holding it there. Because she wanted her to stop crying. She was acquitted on a technicality. She deserves to rot in a cell for the rest of her days. The fact she's got the audacity to show her face and do an interview like this- acting like she's innocent- is just flat out repulsive. I hope that retrial comes swiftly and that she's put away for a long, long time.

      She says I guess maybe I could have the medical findings still said sids even after an autopsy. So autopsy and hospital findings were both the same most likely detectives lied about the finger marks on babys neck and thats why the jury didn't find her guilty for 1st murder because the findings were not there

She starts off laughing and giggling and asking about her baby's life insurance money so she can put it towards the house she was in the process of buying.. She goes on to admit to killing her baby.
      The autopsy report found the baby died of asphyxiation. The only one saying that the asphyxiation could be related to SIDS is her defense attorney. Because that's literally what he's paid to do.
      She was acquitted on a technicality. The charging papers did not specify an act of negligence on the part of the mother. “The specification alleges that Appellant murdered (Scarlett Flores-Guerra) ‘by asphyxia’ without further identifying an act or omission.” That's what her appeal was granted for. She was only released because the paperwork wasn't specific enough.
      You can look any of this up for yourself. It's public information.

    Shouldnt be out. She admitted yo swaddling a 5 month old and too tight putting her face down. Spoke about cashing in the babys life insurance to pay for her house.
    Theres no justice. You dont get to escape the truth when you cross over

She talks about wondering when they would collect the insurance money because they were moving into a new house and wanted to use part of it for that.       One of the very first things she asked in the interrogation was about about the death benefits not being processed. She stated they were building a new home and were hoping to pay for it with the money as well as paying down their debt. She also definitely said that she swaddled the baby tightly and that she pushed her babies face into the mattress. They also brought up that in one of their conversations that she said the baby looked like her face had been smashed into the mattress. Not sure how this got over turned but I’m very curious!

      Yes, they did. That is why the jury found her guilty of 2nd degree murder and also because of her internet searches of "what if I want to harm my baby." She also admitted to shoving the babies face into the bed. She was let out after serving only 2 years over a technicality in the paperwork, not because they acquitted her. That is why they can re-try her if they choose to.

      @@John-tp5gc It's actually a really good idea - can you imagine losing a child and then on top of that having to worry about the expenses of the ambulance that couldn't save them and the funeral?! I couldn't. I was sick about getting policies on my children but did because the thought of having to focus on anything but grieving in that awful circumstance was something I just wouldn't want to worry about. That said, I can't imagine it even TOUCHING my priority list, especially when you don't even know for sure what happened to your baby and then to say you're going to use it to pay off house expenses?! Are you kidding me?! That's not what it's for.... it's gross.

      @@soupnfresh the problem is, she never said that in her interrogation, she admitted to shoving the babies face into the bed when she put her to bed (there were marks on her neck and the back of her head) and had made internet searches for "what if I want to harm my baby," and "what if I hate being a mom." She was found guilty of 2nd degree murder, but was let out after serving 2 years on a technicality over paperwork, not because they acquitted her of the charges, thus why she can be re-tried if they choose to. It came out in court that the dad was out with friends when the baby died and that is why he was never a suspect.

      Exactly!! She ADMITTED she shoved the baby's head into the bed and there were marks on the baby's neck and the back of its head. The coroner said it was NOT SIDS, it was a homicide by suffocation. Her conviction was overturned on a paperwork technicality. They can choose to re-try her, sadly, they probably won't and there will never be justice for the poor baby murdered at the hands of its own mother. When they interrogated her, she was much more concerned with when she would get her insurance pay out, because she wanted to use it to help build their new house.

      My family use to make fun of the fact my son was deprived of a blanket that’s why he’s obsessed with soft blankets now. He has atleast 5 soft blankets in his bed and many others that he loves. I don’t actually think he was deprived of a blanket , it was safety and I gave him his blanket and monkey when I felt comfortable and he loved them from 6-9 months ish to 4/5 years old. monkey and Blankey came everywhere and it was a pain in butt to remember everytime we left house but it Was a sad day when he stopped carrying monkey and blanket everywhere and didn’t need them to sleep ❤❤

      Infants under 1 shouldn't have a blanket AT ALL, they can use swaddling devices (they actually make swaddlers that velcro) as long as the infant can't roll yet.

      smth about the charge of causing asphyxiation not being specific enough, a technicality as I understand it. I am also surprised at what she is saying here as it seemed like the marks on the baby and what she said in the interrogation implies she pressed the baby’s face into the mattress out of frustration to stop her crying.

    She is very lucky. I don't want to place judgement, only on a police interrogation. It could have been SIDS. But also, it could have been, Kate being totally lost for a few minutes, not getting sweet little Scarlett, quiet. It is something, Kate has to live with rest of her life, but I can understand not wanting to face that. I wish Kate the best. Deepdown, she knows, if she smothered little Scarlett.

    As an investigator, I absolutely knew during her interrogation, she was absolutely not guilty or at fault. I had no doubt and I wanted so badly to reach out and get in tge case, as a defense investigator. Retrospectively, I wish I woukd have.     Just being honest and I know ppl wont agree byt when watching the interrogation she never said she smotherd her she seemed genuinely upset thinking she accidentally killed her child and the cops were trying to talk her into what they thought happened so idk just not convinced she intentionally killed her baby

      There were red marks on the back of the baby's neck where she pressed her head into the mattress. It is hard to get around that fact. Plus, the first thing she asked about was the insurance money to build a new house with and there were those disturbing google searches.       So you obviously didnt watch it then because she clearly says that she flipped her daughter over and pushed her head down into the matress she said she coukdnt remember how long she had pushed her head down for !!! She said she was angry because the baby was crying.. her internet search history was i hate being a mother and that she wants to hurt her baby. She admitted pushing her babies head into the matress they even found blood on the pacifier the postmortum said there were injries on the back of her neck and back of her head that were consistant with a human hand pushing down hard. !!!! Shes murdered that poor baby!! She is a monster!!!

The things she said was her repeating what the investigators said to her!..the INVESTIGATORS said the baby had HAND marks on the back of her neck…NOT the coroners report!     Why are they dismissing the hand print on the back of SCARLETTS head???? Does anyone care about this baby. SHE never bought up her husband drinking tequila on the couch. During the interrogation, she was worried about being away from him while going into the mental institution, so if you're worried about your husband being away from you but he could possibly be the killer of your daughter because he was drinking tequila on the couch. It's unacceptable.

    Wrongfully convictions?? Im disgusted that because she had post partum she gets off. She knew exactly what she was doing, she shoild have just laid the baby in the crib, not swaddled amd left the room to calm down. She should be in jail for murder

    Why wasn't the husband charged since he was with her daughter drinking tequila when the baby died... It was probably negligent to put the baby on her stomach which resulted in death but the husband could have been fed up with the baby crying and smothered her. Hmm

    what a disgrace...no justice for the innocent baby...who suffered a terrible death at this narcissist's hands. You are an adult...you knew enough to get mental help and not leave yourself alone with the baby. You knew the baby was at risk being with you. You wanted to abort this baby.....so you knew you were not the motherly type. You will be re-tried and justice will be done.

    I don't understand why you swaddled her, put a pacifier in her mouth and then place her on her stomach? Didn't they teach you safe sleeping habits? I don't believe you killed but all of those things don't make any sense.

    Wtf was the husband even questioned like she was? Or maybe he was because he was drinking and wouldn’t remember what he did when being alone with the baby?
    She didn’t kill her baby , I don’t have that feeling after watching all the interviews of her. Very sad.

    Its astonishing after hearing the interrogation that people have no common sense to hear that these people were saying and doing ANYTHING to make her feel safe enough to confess to murdering her child after she continuously kept telling them in many ways she could NOT remeber doing what she was accused of and she couldnt understand HOW her death happened, to the point of exhaustion and desperation to get passed the torture. If these people who beleive she is guilty are chisen to be jurors then we need to demand a common sense test be given to every juror in the world. Yes she asked twoo ths later about her childs benefits like anyone going through emotional and financial situation. My daughter has had post partum depression after 8 children and never murder any of them. Doesnt mean she was guilty of murder. She was convinced and promised anything if she went along with the story they kept beating into her head. Reminds me of a child when accused of doing something and the child in weak state of mind decides to confess indeed they are guilty of eatinf the cupcakes yet the family pet is the one who ate them. Only to have punished the child for it. The point is knowingly willingly and she kept saying she didnt know and giving honest explanations as to what xould of happened. Smh!

      Give it up! She knew what she was doing, she was frustrated and tired and instead of leaving the baby and calming herself down, she smothered her, pushing her into the mattress, she had internet searches about killing her baby, and why do I not want to be a mother, post partum mothers who murder should still be charged and put into prison. This I'd disgusting that she's out!!! That poor baby

    I survived 911...building ONE: I suffer terribly from ptsd......but I don't think of hurting people....I only think of helping or saving people. Stop blaming ptsd. And you didn't lose your child, you took her life. You could have saved her by calling your husband to come home ASAP! No...she did not die from SID....she had the markings of your hands on her neck and head. ER said that becuase they didn't have enough info. Specialists examining the body found she died from blunt force of smothering.
