New Florida law ends squatters' rights, NY state assembly attempts similar measures

  • A rise in high-profile clashes between squatters and homeownersis causing some concerned state lawmakers to take action.
    This week, Florida's Gov. Ron DeSantis signed the new law effectively ending squatters’ rights in the state. The changes go into effect July 1.
    "You are not going to be able to commandeer somebody’s private property and expect to get away with it," said DeSantis during a press conference.

    I pray it goes sooner since this is an emergency and I pray that this will be all worldwide, espcially in the United States. We are supposed to set the example. Allowing criminal activity shows weakness in a country.

    People should save more to cover housing insecurity, but they never will. Like with Social Security, a risk pool is necessary. Now it is time for WAY more subsidized and low income housing zones to deal with the reality of rental insecurity. Wishing, complaining, and moralizing won't fix the problem. Like insurance, government risk pools are the best solution we have at reasonable cost. Plus, it always the innocent children who suffer. Food, shelter and medical must be universal. It is not fair to dump the responsivity onto people who invest in real estate for retirement.
    Bottom line, if there was a place to move people, they could just relocate them and require a new lease so they can't lie their way out.

      I had a marshall remove someone in NYC and they come in two and with guns. One says check and the other moves. No cars can be parked in the front until they tell you it is okay.

    I have mixed feeelings about this.
    If the owner abandons the property, finders keepers rule should apply.
    No owner should be allowed to abandon or leave the property unattended.
    Once the owner abandons the property, they need to lose ownership.
    No property should be left unattended.
    If the owner doesn't want to use the property, then the owner has the obligation to rent or sell or lend the property so that someone else can use the property.
    Or the owner should ask family or friends or neighbors to take care of the property.
    It is really socially unacceptable that a property is left vacant when so many people have no place to live.
    A squatter should be allowed to take possession of a property if nobody claims it after a certain period of time.
    The owner has the obligation to take care of one's own possessions.
    Even if the owner is paying taxes, it doesn't mean that the government has the obligation to take care of the owner's possessions.
    The whole point is that the owner should not leave the property unattended.
    It is very disturbing to have laws that protect rich people and punish poor people.
    A squatter is a homeless person that goes into an apparently abandoned property.
    That in itself is not a crime.
    I agree that squatters are not tenants and should not be treated as tenants. Squatters should not have the same rights as tenants. And the law should be changed to reflect that.
    But at the same time we have to think about who is responsible for this situation. The responsibility goes to the property owner. It doesn't matter what the law says, as long as the owner abandons the property, there will be squatters. Squatters will not disappear simply because you changed the law.
    One thing that could and should be changed is the speed of the legal process. Owners should not be forced to wait almost 2 years to get a legal resolution. Proving that they are the legitimate owners should not be that hard. Ideally a legal resolution should be achieved in less than a week. Then, with a proper court order, the police should be allowed to evict the squatters.
    Apparently the law is being changed to allow the police to evict the squatters immediately on the spot.
    But I feel such a law is going to backfire.
    The police has no way to know on the spot who is the squatter, who is the tenant, and who is the owner.
    It is quite possible that the police will end up making mistakes and evicting the legitimate owner or the tenant instead.
    You don't want the police to have that kind of power.

      Let's suppose a swimmer is attacked by sharks. Who is to blame? Are the sharks to blame? Should we kill all the sharks?
      Or is it the fault of the swimmer, who wants to swim unprotected in shark-infested waters?
      Squatters are a symptom of larger problems like unemployment, homelessness, social and economic inequality.
      Just by changing the law will not make squatters disappear.
