  • Scotland's new hate crime law has been put into effect but critics fear it may limit free speech, while senior police officials expect a surge in complaints about online content.
    The Scottish government defends the law, arguing that it safeguards against hate and prejudice while allowing for individual expression. However, Victims and Community Safety Minister Siobhian Brown's claim that the law was unanimously passed in 2021 is inaccurate. It was approved with 82 votes to 32 and four abstentions after heated debates.
    The Hate Crime and Public Order (Scotland) Act 2021 introduces a new offense of "stirring up hatred" concerning various protected characteristics, with a maximum penalty of seven years' imprisonment.
    The law prohibits communicating material or behaving in a manner deemed threatening, abusive, or insulting with the intent to incite hatred based on protected characteristics. While similar offenses were already illegal in England and Wales under the Public Order Act 1986, Scotland's law expands the scope by including "insulting" behaviour and requiring only a likelihood, rather than intent, to incite hatred.

      This new law on the official page mentions the abolition of blasphemy. He's a super progressive and the complete opposite. I blame social media. He's always on his phone. His own comments about too many lighter groups in Scotland in the past however could come back to bite him in future. In reality though the law means little as people in US, Europe and England are already being arrested and fired for saying the wrong thing

      Female =she/her gir/woman and I shall be continuing to use such terms.
      This law is literally trying to get me to respect and silence my criticism of both these examples of delusional, intolerant and hate filled ideologies that I indeed have no respect for.
      This is a dangerous route for society to go down and I will not be complying to any such tyrannical, irrational and insane law.

    A man not elected by the people is making laws that no one wants. I have a feeling this law is more about stopping any criticism of islam more than anything. At some point in Scotland it will become an offence to eat in a public place while others could be fasting, then they will target shops, then certain books will be banned, then...well, look at Germany in the 1930s if you want to know where Scotland is going in the 2020's.

    My sister, who is a retired social worker and in her late 70's has had one of the first convictions under new legislation! As a social worker she has always had strong values against racism, bullying etc and it counted for nothing because the court wanted to get that conviction on the books!
    I was in the court! They preferred to believe a Polish woman and her partner that my sister made a racist remark (and I know she would never do that). The whole procedure was disgusting!

    The reason why Westminster didn't oppose this new law is because it is heading on down to England in the near future. This law is there to create the proof required to justify the need for it, as the number of silly people reporting so-called offending speech and thoughts increases so do the numbers to prove the problem is on the rise. The only way to make this point is to allow more people to do so. The SNP are playing a game and the people are more than happy to play along with it, not realizing that the game is stacked against them, the SNP House holds the cards

    It should be interesting to see how Government deals with full prisons and vacant job positions, obviously it will implement more laws and restrictions.

    An ex of mine told the police I assaulted her and took me to court, in court she showed pictures of scratches and rashes that were not caused by me, I was then given a 1 year deferred sentence and a criminal record
    Now she can do this to anyone, claiming they offended her etc, people like this exist, some people will report you to the police just because they don't like you, and even if you don't get a criminal record, it is going to be a pain

      My point was more that if someone doesn't like you, and they want you to get caught up in legal trouble, this is a very easy way to do it now, as this is a subjective act that means anyone can be offended and call the police, but someone doesn't need to actually be offended to call the police and say that they are, making claims saying that someone said something when they didn't, and getting them into trouble for it, is now possible

      ​@@hannahcallow6374Yes, that's the point. REAL trans people are a small minority. But now, if ANY man r*pes a woman and gets caught and sent to prison, he can CLAIM to "BE" a woman and can be transferred to a women's prison even if he's 100% intact.
      _This is already happening, and some women prisoners have been r*ped by men who are _CLAIMING_ to be women just so they can be put in women's prisons. Most women prisoners aren't even in prison for violent crimes, because violent crimes are vastly more often perpetrated by men.
      I have genuinely trans friends, who have had surgery as adults, and I accept REAL trans women as trans women. But letting _ANY_ man claim any sex he wants to claim, is unfair and potentially extremely dangerous.

    I think if we examine the core functions of the police, it may serve to illustrate how we’re treading on very thin ice, civil liberties wise.
    It is the duty of the police to guard, watch and patrol so as to prevent crime, protect life and property and preserve order.

    What happens if you are English, on holiday in Scotland, say something that meets this criteria, then go home. Can Scotland get you to return to be prosecuted even though what you said in England isn't a crime?

      @@deja-view1017 I get the feeling the consequences of this legislation haven't been thought through properly. If someone, who lives in scotland, says something that causes a complaint from someone in England then how does that work?. Can Scottish police ask an English police force to arrest that person or does this law only apply to Scots living in Scotland and the accusers living in Scotland also?. It is going to run foul of the English legal system but maybe that's the reason this legislation has come about?

      If you live in England and say something online that someone in Scotland doesn't like you can still be reported, investigated and prosecuted according to the experts.

      @@spartacusforlife1508It seems pretty unworkable. There are UK laws and ECHR laws that supercede Scottish law. Cases will be bound up in the courts for years (costing millions).

    This law will not be able to switch off what an individual dislikes or even hates, it will only add oil that fire. Humans can't switch off their emotions, just because a law says so. I am beginning to wonder where this is supposed to lead to? Will he cook up a law that outlaws love next year? Seems he has the power to do as he pleases.

    In my opinion hate speech should have a very narrow definition and be limited to only threatening to harm or kill someone. Anything else could be considered rude, but I don't think it should be a crime, and shouldn't involve the law or police.

    I decided to play an April Fool joke on an acquaintance whom I know to be a self-proclaimed "liberal" and whom I suspect to be an SNP supporter, possibly voter. My idea was to make him think about the local conclusion of this legislation, so putting on my best English accent (I'm a Glaswegian with a practised English accent pulled out on 1 April every year 😀) I rang to introduce myself as representing a Company outsourced by all the major mobile phone providers. As from today, I said, given the new Hate Crime legislation, mobile phone users in Scotland must accept a new condition to continue with their contract; nobody in Scotland would be allowed to converse about any of the protected characteristics. It's not about you being forbidden from criticising anything, but you must not even speak or write about them using your phone. The protected characteristics are age, disability, race, religion, sexual orientation and transgenderism so, since the Government want to wipe out hatred in Scotland, the phone companies want to make sure nothing is said or written using their phones which might break the new law. You'll receive a text right after this call to make sure you can confirm that you understand this new contract... He hung up 🤣

As an Englishman, I dare Scots to say anything to me that would cause alarm (I'm kind of joking, but not really, I do love the Scots and they deserve better than this bed that they made themselves)

      We don't hate the English that's a stereotype, I genuinely don't know anyone here who doesn't like the English. My country is becoming unrecognisable I genuinely wish I could leave the UK. But its a much harder thing to do know.
