  • The Family Court - A balance of probabilities
    When self representing in a family court. Things can be overwhelming. But there is a very simple principle which will help you compiled your body of evidence and make your case. The scale of ascertion.
    Is something fact, probable or just likely to be true?
    Is it merely possible.
    It may be improbable or entirely impossible. Its your job to make the case for everything you are asserting to be true.
    This simple illustration will help you navigate those things for your case.

    if the mother alleges something which enacts the s47 where no evidence has been provided and very weak groundings, how does enable them to stop access?

      They do a section 47 for almost everything. Any allegation has to be investigated. Sadly, it does mean it causes loss to the relationship in the meantime.

      Depending on the details of the case, Motoring cases can be either criminal or civil or a combination of the two.
      The details in this video pertain to making a clear and concise case. But the concept of a balance of probabilities is not present in a criminal case. In criminal law, things need to be proven beyond reasonable doubt. its briefly mentioned in the video. So the burden of proof is much higher.
