    Fali Nariman says that the four judges should come out and clarify to the nation as to whether they doubted the integrity of the Chief Justice. Especially Gogoi who can perhaps be a next Chief Justice after the retirement of present Chief Justice. I do not think this is possible as Gogoi can never be a candidate for the next Chief Justice due to his misbehavior to demean the Chief Justice and inadvertently though demean the constitution of India and the National. Now regarding the desperate efforts of the sixty pro motion MPs my following comment may kindly be read: "CJI who is the highest judiciary power is a protector of law and justice and hence must have ability as well as purity in his personal, private as well as public life. Whereas in the article 124 clause 4 of the constitution the word "Incapacitated" relates to the Judge's ability (sound mental and physical condition) to perform his duty, the word "Proven Behavior" relates to the purity the judge has to show in his personal, private and public life. If a judge say is alcoholic (personal life) or say involves in domestic violence (private life) or say has committed public offence / crime so that local police has filed FIR against the judge (public life) then misbehavior can be considered as "Proven Misbehavior" So the word "Proven Misbehavior " according to my understanding is a deterrent so that a judge who is a protector of law and justice would show purity in his own life . If the judge shows "On Duty" misbehavior then it is the internal matter of the judiciary and they must be having internal mechanism to address such matter. So in my opinion there is no FIR against CJI and hence the notice for Impeachment has failed to satisfy the "proven Misbehavior" . No notice or writ petition can become admissible therefore on the basis of alleged misbehavior. Otherwise there would be political invasions in judiciary. Nation expect some strong resistance or deterrent to stop such political "proven Misbehavior" so that there won't be any dirty political attempt to damage the dignity and honor of the judiciary and the Nation. Probably some punishment to such over adventure can be contemplated. New India which has taken the birth need such reforms so that in future judiciary does not stand on political crutches or stick."

    Chief Justice of India is a very authoritative and powerful figure. No agency or institution can investigate a matter regarding him with complete independence or effectiveness - precisely the reason, you can't wait for anything like a substantial proof to come up before impeaching him. Proof or No-proof will only come up after inquiry, which is not made to happen. It's the classic chicken or egg problem.

    He says " Impeachment motion" is very serious matter. Which needs to be resolved seriously.
    Wheather, the constitutional processes are followed or being followed to resolve such serious matter. If yes, what is the constitutional processes?
    Why it is not followed, If considered it as " Respectfull Institute!
    Is the chairman of Rajya sabha alone can reject the " Motion" without followed the due legal process? Is it not amounts to misuse of power arbitraterly?
    Are all elected members of parliament are useless? Is it the constitution provides previlage to MPs in India?
    So many doubts generated in minds of public by highest authorities of GOVT institutions. Is it fair?

    She is not prepared for an interview. Nariman is frustrated because she is asking irrelevant questions. Important questions like the independence of the judiciary, political interference, public perceptions about the judiciary are not raise.

    Serious Charges "existence" is more important than as to when it was raised.
    Merely because it was not listed by 4 Judges in their allegation or the Motion was not signed by former PMs is not relevant in entertaining the Motion.
    Higher the Position the Harsher are the standard of rectitude expected.

    Kapil Sibal had answered already that Congress didn't go to Manmohan Singh for signing.
    Mr. Nariman backtracked on his stance that charges mentioned in petition are not serious.He then says that they are serious, but there's no substance in it.
    Also, he didn't answer whether VP is a quasi judicial or judicial authority to decide on the substance of the petition or not.And it's surprising that NDTV, even after getting the point of view of Kapil Sibal, as to why the VP order is illegal, did not ask Fali Nariman the same.

    It's incorrect on part of nariman that next CJI would be within the 4 senior judges.
    Wait and watch the next CJI of A.C would certainly be " SIKRI".
    Confirms from past 2 years of his judgements.

      Shashidharan ---- when some say that certain benches are fixed without proof they ARE FRAUDS. In cases heard by more than one judge -- often different conclusions are given by individual judges AND THE MAJORITY VIEW PREVAILS ----- that may not be always right --- BUT THAT IS THE LAW AND WE HAVE DECIDED TO ACCEPT THAT

    Mr.Nariman , let allegations against CJI should be forwarded to inquiry committee to decide the Merritt of allegations, suitable or not for furthering the requested process . Rather motivated opinions of some authorities .

    Some of the opposition parties led by Congress do not have any people's support and have now come up desperately with some vague, unproven and facetious charges for their own ulterior political motives without any regard to the harm it is trying to bring to the country's top Judiciary in the process.
