There is no law anywhere that permits someone to take silence as consent or agreement. I have no idea where these people had ever came up with that bs. Seriously, what is wrong with these people that they can't stop and think that doesn't make any sense to be true?

I do not know if he believed it or not. I have a feeling that the biggest purpose of this whole thing was just the chance to get out of the jail cell for awhile. I sat on an escape trial for a convict from the state pen. Day 1 was jury select and opening remarks. Day two and the morning of day three was all the prosecutor and his long line of witnesses to show the defendant had been convicted of a crime, transported to prison, entered into the prison population, had escaped while being transported for health checkup, captured running loose, and returned to the prison. The defense attorney asked for lunch break before he began, which the judge honored. We returned from lunch, the judge asked defense council to state his case, and the defense attorney arose and said, "The defense rests it's case your Honor". Yep! A vacation from the pen!
