Great video and info. However, I will mention that I just went through the CCW application process in California (LA County) and previously had a non-violent felony conviction 21 years ago. I filed a petition for expungement after my probationary period, and the order PC1203.4 was granted a few months later. I was then able to again purchase firearms and vote, but I didn't have an interest in getting a CCW permit until after the Peruta decision in 2014. However, I had that application denied in 2016 because I did not satisfy their requirements for "existence of good cause" at the time. I then waited until the Bruen decision and reapplied in 2022, and after a long & exhausting path (and dealing with SB2 rules that required another training session of 16 hours since my 8 hr course was now void), I was ultimately approved for a CCW permit through LA County in early 2024. My background did come up in the interview and I was forthcoming with all of the information and not hiding anything. I explaining how I learned & changed from the experience and didn't have any issues during the application process from the previous felony conviction.

He is 100% wrong on the waiting period in CA. Once you have purchased the new gun, you go thru a mandatory 10 day "cooling off " period, then if your background check has not been completed, you are then subject to another 30 day waiting period. At the conclusion of that waiting period, if the state still cannot approve you, You are then put on "UNDETERMINED STATUS " At which point it is left to the FFL (gunstore owner) to decide whether or not to deliver the gun.
Another problem is, If I Already Own a firearm,
and are buying a 2nd or 3rd, Why would I be subject to a cooling off period?
The cooling off period was instituted so that you could not buy firearm and take it home the same day, giving the buyer time to "Cool Off". If I ALREADY OWN AND HAVE IN MY POSSESSION MULTIPLE FIREARMS, HOW DOES THIS LAW APPLY TO ME?

That flawed opinion is a great way to end up convicted of a felony. I agree that 90% of gun laws violate the Constitution. But as we see with some challenges to California gun jaws currently in Federal Court, it takes years to get those cases adjudicates. Meanwhile one can sit in prison fighting it. My advice is until the laws get reversed don't break them.

L.A. County still maintains the same status quo as before, and the current L.A. Sheriff is under investigation for CCW corruption. Only the privileged few will get CCWs like retired police and fire, judges, and VIPs. Money is better spent on training. I did everything plus I took the required CCW class BEFORE applying. I was denied but I learned several valuable lessons. So it wasn't a total loss. I later experienced an imminent threat where I also had to protect my handicapped mother. If that had happened outside of my home, my mother and I would have been at a major disadvantage. A right doesn't require a permit, which won't be given to the average person anyway. Only you are responsible for you and your loved ones' safety.

Some factual inaccuracies in this video. This video portrays the live fire qualification like it is some hard impossible test to pass. Every issuing agency has a different test, some are easier than others, all are easy if you know basic fundamentals. For example, one issuing agency requires you to hit a B8 ring target at 3, 5, 7 yards (17 of 24 on each target). Another requires B8 at 5, 7, 15 yards (21 of 25 hits 10 on 5, 10 on 7, 5 on 15).
Also - renewal does not require you to do everything over again. It will be a 4 hour refresher course (versus the initial 16 hour course) every 2 years.

  • @B007-g4e
    @B007-g4e 2 года назад +14

If I was an attorney, I would argue before the US Supreme Court that the issuance of CCW permits is illegal and restrictive and does not fully embrace the US Constitution Second amendment. Even if a CCW permit is issued, you are restricted by state to state riprocity laws. This is bogus. There is absolutely no state to state restrictions with the United States Constitution Second amendment. More importantly, why do we need permission from a government agency to protect and defend ourselves and loved ones? Is law enforcement legally liable if they arrived too late and a death or multiple deaths have occurred???
People need to wake up and realize that government is controlling, killing freedom at every corner possible.
The only licensing authority is and should be the United States Constitution Second amendment.
BTW...the United States Constitution Second amendment is not applicable to liberals and members and voters of the Demonic National Party.

CCW's aren't the same as our right to keep & bear arms. It's not really a permit, it's more of a mandatory registration. A data base of not only of the individual but also a data base of weapons types & calibers.
So, basically your when you get a CCW, your are paying that state to put you in a data base of armed citizens, & as we have seen with Red Flag laws across this country, ATF & other Law enforcement agency's they are using it to go after guns

You might want to look that one up...... You don't have to have your ammunition separate from your weapon I can have a fully loaded magazine next to my weapon in a lockbox just as long as it's not inserted into the magazine well.... You should probably know that since you're a lawyer..... And if I was coming here for the first time not knowing the process I would think it was nearly impossible the way you describe it it's nowhere as hard as you're making it out to be..... So if you're looking for a CCW in your reading this just know it's nowhere close to how he's describing it as far as difficult... All the literature is common sense... You could spend a few hours handling a firearm and figure it all out a fourth grader could..... Go get your CCW it's easy
Penal code 2016..........“California law does not recognize concealed weapon permits from other states; therefore, they would not be held valid. If you wish to transport a handgun during your California visit, it should be carried unloaded in a locked container. In the absence of a suitable container, you may secure the unloaded handgun in the locked trunk of a passenger car. ((((((Ammunition may be kept in the same container))))) or trunk, but the handgun must remain unloaded with (((((no rounds in the cylinder and no loaded magazines in the magazine well.”)))))) -CHP’s website.

Do you Sir give a damn about the Constitution of the United States? As a "lawyer" do you care? It's interesting that it wasn't really prominently talked about. It is the law of the land. The law is keep & bear Arms & shall not be infringed. So there is no stipulation regarding mental illness or prior criminal conviction. SHALL NOT BE INFRINGED. So all the little laws you are describing are all unconstitutional. This is not the movie Minority Report. You cannot "prevent" crime. The spirit of the law is to punish those that infring upon the rights of others.
Permitless carry as you stated would be changing. Now 25 states have Constitutional carry not 21 as stated in your video from 4 months ago. More & more the Constitution will be uphled & followed instead of being ignored by tyrants.
You also misspoke about purchasing a fire arm & then going through a background check. You cannot "purchase" a fire arm without a background check. You can place a deposit while the background check is being done. But the unconstitutional law of having to get a background check 8n order to own a gun prevents purchase before the check is complete.
Just that alone puts into question your capabilities as a lawyer let alone the ignoring of the Constitution.

He didn't make the California gun laws, he's just explaining the various California penal codes covering firearms and offering advice and guidance on how not to go to jail because of those laws. I am retired law enforcement and used to issue CCW permits. I too didn't't agree with the laws and feel the Second Amendment states "keep and bare arms" and "shall not infringe" means exactly that. A right to carry built right into the Bill of Rights. But with that said I wouldn't advise someone to break our current unconstitutional laws, as they'll end up in jail or prison and placed on a restricted list,, leaving a person arguing the injustice of it all with an assigned cell mate.

Respectfully, this is the kind of attitude that has put this nation on the brink of being lost.
He didn't make the laws, he's just explaining.
Every single lawyer that has to defend someone being charged with an unconstitutional law should be working to get the law over turned. But they are not. The people we need to stand up are not standing up.
You are retired law enforcement? So you are a former judge? The moment a law is enforced is when a judge issues a sentence on a person convicted of breaking the law.
Officers are not supposed be judge, jury & executioner of sentences. Officers take an oath to Support & Defend the Constitution of the United States, and Support & Defend the community they are being paid to work in.
How can an officer, tasked by the state, to seek out people that are supposedly breaking this law or that law & issuing fines supposed to support & defend?
They are not. That's why we repeatedly see officers out of control, violating the rights of the citizens they swore to serve.
Putting officers in the position of "law enforcement" directly pits them against the citizens they are to support & defend.
I have deep respect for anyone that puts their life on the line for me & my fellow citizens. I have deep disrespect for people willing to be brown shirts for the Bureaucratic state.
It isn't supposed to be this way. I shouldn't be paying my hard earned tax money to have someone stop me on the street to take more money because they believe I did something wrong. Officers, true officers, that want to help their community shouldn't want to do that. Officers should group together & fight for change in support of the community, instead they join the state union. It's a travesty & our nation is about to be lost because of it.
Citizens have no where to turn when the citizens that swore to support them side with the state.
