Hey for your particular situation, as long as the insurance company pays for some of the damages that the other party caused they can legally pursue subrogation.
my situation is I had my insurance company repaired the car for me, I filed a Diminished Value claim with the at-fault insurance company. The at-fault company says they're waiting on my insurance company to send their subrogation demand before they can release the payments. My question is, should the cost of repairing the car be separated from the diminished value payment?

Unless it is worthy of a call as some drivers should not have a license. You would probably should be more afraid of their and your own insurance company as they are ones that need to go to jail. My problem is that Alpha Insurance company says their insurer is 100% at fault; but they don’t have enough coverage for the damages since they totaled my 4-month old car 😢 Anyways, working with my insurance now and “subrogation” came up, I had no idea people were allowed to drive with so little coverage. Thanks for the explanation in a way that makes sense.
