To get 40% for the back requires: "Unfavorable ankylosis of the entire cervical spine; or, forward flexion of the thoracolumbar spine 30 degrees or less; or, favorable ankylosis of the entire thoracolumbar spine". With the back injury that is in this video it would be 20% or 30%. That said, you would still get to 80% rounded. Also, 20% bilat on all limbs is 65% total by itself, with the bilat factor included.
Yes, but if you feel pain when you unhinge your back from the upright position, during your C&P exam just explain that to the examiner and don’t lean forward too much into pain and you should be within the 30 degrees. That will be rated at 40%
@@isaiahrasmussen8601 during my CMP exam I barely moved forward a fraction of an inch and the CMP examiner said I moved 60°. That is absolutely false because if I did actually do that my back would’ve flared up then on the repetitive motion estimate she gave me 40° and estimate during flareups she gave me 20°, so it’s easy to say oh don’t bend that far and you’ll get 40% but it actually goes by what the CNP examiner says. Everything else on the exam I feel was excellent. I think she was fair as could be. I just don’t understand why she said I moved 60° forward on the passive and active range of motion test that is just wrong not even close to what I moved, she did use a goniometer. When they rate me I hope it’s rated on the flareup as that range of motion was 20° and that would give me the 40% back rating. I’ve read on several lawyers websites that are all accredited and they say they have to account for the flareup so I should get the 40%. hopefully I will know soon.
Thanks, I broke my back on Active duty. then crushed my right lumbar a year later after an explosion. I'm still fighting with the VA now. My 3rd appeal for back problems, my rating sits at 60% still when I should really be at 100% T&P. I also retired in 2017 from the US Military.

I just last week had a C&P after 17 years (retired 2006). Back and neck focused. I was there for 2 hrs, that could be a good thing. They did my BP when I left, 164/100 I was in pain. Now, I am waiting for the decision to come back. Thanks for the videos.
How did it go? Did you have a private provider do the dbq? Thanks for your time. I've been out since 2001 and have radiculopathy so filed and hoping I can get it connected
Love this info. Thanks. I literally, genuinely deal with all of these issues and mri's prove this. I have headaches, pressure on my brain, swollen nerves and of course it all has caused PTSD anxiety etc, so I appreciate you for this.
Thank you for the great information. I’m sitting at 70% currently. I have 40% for back pain and 20% each for lower L/R radiculopathy and 20% for an umbilical hernia. Question: My neck constantly hurts, my right shoulder hurts, and I do get tingling in my hands and arms as well as headaches and I can’t sleep well. Thats a lot. Should I file a secondary to my back pain for all of these? I heard you should only file about two or three tops for secondary conditions however I’m really hoping to get to 100% and want to be sure. Thanks for your service and advice.
This past year I've been working on getting medical paperwork trail for my lower back, finally got a MRI scan and my cartilage between the disc on lower back is going away, and is also causing me knee pain because of the nerves going down into my legs. I was told i need to get it diagnosed to help me get it claimed better. After seeing this video i hope to get claims for what your saying because it is true. Being in pain sucks, i oray every veteran can get the benefits they deserve.

I’m at 90% on my disability rating. I served with an airborne ranger co. None of my service related back injuries have been related to any back pain. I’m now 75 and am desperately trying to get that last 10% 7:44
Told my VA primary dr that my back has been hurting for years, told my PA in active duty my back hurts, years from wearing the issued gear, and the wear and tear they put on your body. His response was that his son is older than my dad and works at a desk, turned and took notes, and then asked what else hurts…last time I went to that prick
I’m excited about your video concerning back neck upper and lower extremities promblems, didn’t know that it was a rating for service connected. I guess old veterans like me miss out on things like that. Praise God for good I for thank you sincerely.
I just stumbled upon your videos and I really like how you break it down so the average person can understand it. I'm an older vet who left the military with reoccurring back pain and other issues from injuries and general work environment some documented and some not and some that should have been documented but don't show up in my medical records. Now I can't hardly get out of bed in the morning without extreme back pain and your 100% correct as goes the back so goes the rest of the body. I was denied recently for SCANT evidence although I have at least 2 documented back issues and was on muscle relaxers for my back the day of my separation physical. I'm appealing their decision with my VSO who seems like a decent guy but not overly helpful. Is there a VA disability for dummies book out there? I've learnt more watching a couple videos on RUclips than I have in 3 years of dealing with the VA.
I appreciate the kind words Rod, it seems like you have a proclivity for visual/audio learning like many people. An appeal is probably the wrong route to go, firing the VSO and doing a supplemental claim with well written personal statements is nearly always the better option. VSO's dont really know anything about lay evidence so most wont be really helpful
Good question can I piggy back off this same? While in service I went to sick call for my back pains long story short can I submit a claim after being out 20 ➕ years? But I got denied 6yrs ago C&P examination saying not enough edvidence between 2001 and present.
@@genebuchanan7878 I got a letter from my ex wife stating that the problems started in the military and continued for at least til the time of our divorce about 14 years after I got out. My vso seems to think it MIGHT help but isn't real sure about it. My problem is that I waited until the pain got bad before I started getting any medical treatment, I got out in 85. More and more I'm thinking about talking to a lawyer , not real sure what my next move will be or even if there will be one. If I hear anything I'll keep you posted.
I have a question. While serving, I had several back issues, simple walking upstairs, moving a couch, and lifting weights each are documented in my health record. Now, 5 years after I retired, I ended up with 3 herniated discs in my lower back, which have been repaired since I was also told that I have degenerative disc disease. I should note that I still have back issues. Do I file a claim for back pain and degenerative disc disease?
Just had my C&P exam for my lower back and plantar fasciitis on 10/23/23. Waiting on decision now. I ensure to stop as soon as I felt pain, and disclosed the numbness and tingling that shoots down both my legs.
Yes, granted service connect on November 21 for Back, plantar fasciitis(bilateral), tinnitus, and radiculopathy both legs. Combine rating 50%. But I submitted a new supplemental for flatfoot on 12/4/23 and the VA updated it to an increase for Plantar fasciitis to include flatfoot. Had C&P exam for flatfoot on 12/11/23.

I’m going through the pains of all this now. Va gave me only 10% rating for my back. I’m barely able to move at times. I can’t even pick up my son at 3 years old to hug him. A buddy of mine told me about your RUclips videos and honestly, everything in this video is everything I’m going through right now. I want to file for an increase in rating and secondary for every thing else. Any advice you could give on this would help greatly.

@vaclaimsacademy I just found your channel, and I am currently my husband's battle buddy ... I am the force behind him getting the care, and this entire video is my life .... my husband is at 80% currently. He has the numbness in all limbs now more frequent than not. We already went through the podiatrist to get shoe inserts and that didn't help. He is in pain management and has been for years with little to no relief. We have been to spine surgeons .. currently being referred to neurologist to see If there is any relief for the nerve damage. The migraines ... the numbness .. (hands and feet, arms and legs) he has had both shoulders operated on in hopes that this would help alleviate pain / numbness in the arms and hands and then we have the mental. .. we have had some serious dark conversations in the last few months as the pain escalates. I will not give up on him ...he is currently trying to work a full time job (aircraft mechanic) and it's getting beyond physically difficult for him to continue. He misses works more often now than ever due to pain levels and its become a point where it gets so bad he now always has an upset stomach (vomits quite often) ... I don't know where to start ... he was rated 80% in 2018 and I fear if we try to push the rating higher he will lose benefits, not gain .. he is age 52 .. so I am not sure which path to take. We have copies of all military medical records during service (this is a unicorn file lol not sure how he got the entire thing but he did) along with all records from outside docs in community care ..... where do I start ?
Glad I found these useful videos this one fits my situation, just don’t know how to go about or where to start. Hard to convince the doctor or Va rep that hasn’t been in our boots.
Also for the lower back/legs you should claim the femoral nerve separate from the sciatic nerve, if you have the appropriate symptoms. Basically pain for sciatic and numbness for femoral. I would recommend claiming these when you file and not wait until C&P to mention them to the examiner. For me I was awarded 20% IVDS thoracolumbar spine, 20% radio. lower left (sciatic), 20% radio. lower left (femoral), 20% radio. lower right (sciatic) and 20% radio. lower right (femoral).
This is excellent information. Top notch info. Thank you so much. Everything is connected and ifeel every bit from the back to my feet and from my neck to right above my elbow. This is all true. I was recently diagnosed with Morton's Neuroma and receive pain management shots. Could you please do a video about that as well. I'll be truly appreciated.
Oh gosh. Thank you for your information. I can only ask for what I need but have had a nightmare with VA in just getting the care alone, especially for my back.
Recently separated, no STR's, have back pain with VA X-Rays with some findings, in Florida. I can't find anyone to do a DBQ. I really don't want to leave it up to the C&P examiner, any tips? Definitely the most underrated VA Claims channel, my favorite by far.

Love these videos i am getting out of the navy soon and i am currently going through the Va process im so nervous and scared from all the stories i here of denied claims, i am still going to medical every chance i get because during my entire career i avoided medical just because of the back lash we get for appointments. also alot of my claims dont have complete Diagnosis history so i am trying to play catch up and get alot of things documented. so wish me luck i have C&P exams next month.
My initial claim and supplemental claim for my low back were put under my already neck diagnosis which has been sitting at 20% since 2019 and diagnosed in 2013. Both c&p exams were for my low back and radiculopathy. No where near my neck. The supplemental claim did add 10% radiculopathy left but doesn't say what body part nor did it add my right left leg even though it's in my nexus and medical record. Now its sitting at higher level review so maybe the third times the charm.
A good personal statement is the missing piece here, this is a classic example of what I often talk about. In reality, they probably skimmed through your medical records and didn’t read the part about radiculopathy. The key is to anticipate the laziness and give yourself a voice to exert your interests and influence over the process. This is where bulletproof personal statements come in ♟️
Good video please be careful what the VA will do. I’ve had several back surgeries, permanent pain unit, pain pump . Back stenosis, arthritis, degen disc, ridc both legs, no range forward. VA combined everything and gave me 40 for back. They put it all together. I fought it they didn’t budge. Please watch what they do. They will be those that say impossible, believe me. Take care of each other.
Retired in 1994 so this may be unrealistic to even mention, but I ran almost daily on hard surfaces including flight lines, streets, etc my entire 20 yr career to meet weight and other physical standards. Fast forward to 2018, first back surgery (fusion L4-5) Second fusion operation (L2-3) in 2022. Now, I have constant lower back pain and shoulder pain as well. I am already rated for Headaches (30%) Asthma/Apnea (50%) Depression (50%) Tinnitus, 10% for Glaucoma, 10% Hemorrhoids, 10%, 0% for broken ankle way back in 1967 on active duty. Worth filing or not? @@alfredtineo3023 There’s almost always something that can be done with denied claims. I hate to give a vague answer but it just depends on what’s in your service treatment records as far as what you can build a winning claim on top of. I can tell you that 80-90% of denied claims are filed suboptimally. So while I cannot guarantee a win per se, I can guarantee we submit a damn optimal claim. The key to maximizing your claim is taking the strategic and optimal route, and that’s the clear path the course outlines so well

So how do you get from 80 to 100 it’s been a 8 yr battle no dental you have to be total or unable to work, so I quess you have to wait for your dental problems to affect other issues before they see your dental problems caused other health issues so how does that helps the vet? This is something that really needs to be looked into if it hasn’t already and probably has with no positive results, I’m sure it will change at some point when enough vets are dead from issues that came from dental problems.

Good luck my friend, I’m pulling for you. Don’t be afraid to fall back and reattack with a different strategy if you keep hitting a wall
Awesome Coach Jordan..!! I followed your video to the T… on October 6,2023.!! Of course I had all the ailments and injuries…. But your coaching of when to stop at the point of pain…..and to mention the radiculopathy.
Results… no increase for lumbar strain..10%… Left side radiculopathy 40%
Right side lower radiculopathy 40%
Bilateral factor…??
Left side hip… 10%
Right side hip..10%
Thank you for ALL of your very EDUCATIONAL AND INFORMATIVE VIDEOS….. I have reached the top, but I will put every veteran that’s in need on your videos.
Thank you so much for this information I’ve been trying to fight to 100% for the last two years I’m currently at 80% now that I looked at this video I have faith to get to 100! So thank you. 🙏🏼
God answers 🙏. Served for the Glory of God. God Bless America. God Bless You. Amen🐾. ...
Never knew this and VA has been told of all of the things you mentioned and I only got rated 40%, I'm going back to appeal my rating. Thanks for good information!
I just last week had a C&P after 17 years (retired 2006). Back and neck focused. I was there for 2 hrs, that could be a good thing. They did my BP when I left, 164/100 I was in pain. Now, I am waiting for the decision to come back. Thanks for the videos.
Hoping for a favorable rating for you. Cheers
How did it go? Did you have a private provider do the dbq? Thanks for your time. I've been out since 2001 and have radiculopathy so filed and hoping I can get it connected
update?
Update?
Being in pain sucks, i oray every veteran can get the benefits they deserve.
heard anything back yet? I resubmitted for back pain recently where I was denied, this time with a MRI/ diagnosis of bulging disc and a pinched nerve
@@jessiesineath7702 got seen by a specialist and was told I should get %20 minimum just for the back. But still working on setting up exams to get seen and talked with.
@@jessiesineath7702 I got 60 percent this week took over 40 years had about the same problem you got that MRI is good I believe that what got me my 60 percent and 8,600 dollar back pay less than 6 month do not give up try to get a C&P examiner she look out for me it really up to them it some good out there as well as bad.
God bless you and all the vets!
I’m at 90% on my disability rating. I served with an airborne ranger co. During the Vietnam war I served two combat tours and was medivac’d back both tours and was awarded 2 Purple Hearts. 50% is for PTSD. with the other 40% awarded for other issues. None of my service related back injuries have been related to any back pain. I’m now 75 and am desperately trying to get that last 10% 7:44
🙏
You earned 100% Veteran, God Blessed America. God Bless You. Amen🐾. ...
I have all the symptoms you mentioned in the video, and I only have 20% for lower back pain. Gonna go for that 100%. Thanks for the information.
Thank you much. They did an xray and saw the issue with my back and I was denied. I now know how to express this in proper terms.
I’m excited about your video concerning back neck upper and lower extremities promblems, didn’t know that it was a rating for service connected. I guess old veterans like me miss out on things like that. Praise God for good I for thank you sincerely.
Hope you are well Allen
@@rodlively1413 thanks brother for the information we got to stick together on these VA issues!!
Can you do a video secondaries to migraines?
Just had my C&P exam for my lower back and plantar fasciitis on 10/23/23. Waiting on decision now. I ensure to stop as soon as I felt pain, and disclosed the numbness and tingling that shoots down both my legs.
Great work, you should be getting some good news in a couple months
Any update?
Yes, granted service connect on November 21 for Back, plantar fasciitis(bilateral), tinnitus, and radiculopathy both legs. Combine rating 50%. But I submitted a new supplemental for flatfoot on 12/4/23 and the VA updated it to an increase for Plantar fasciitis to include flatfoot. Had C&P exam for flatfoot on 12/11/23.
Been on preparation for decision since 12/12/23 for the increase
Thank you for the information! I will be reopening up my claim asap!
Thank you for posting this it help me get the words I need for my back it helps me explain everything I'll let you know how my appeal goes trying to go from 80% to 100%
This is a great video I need to get back in and do this again I’ve got 10% for my back pain I never even considered the sharp shooting pain in my arms to be connected
Keep it simple Steven, file for that increase and be more aware during the new exam
Thank you SOOO mcuh getting out this enlistment soo many health problems thank you for the info GOD BLESS!
Guy no one on the internet beats your video your back system claims are the easiest way to 100 percent you just got to say the right thing at the c&p exams dam vet this is spending no money with the pay to get to 100 you know what i mean
Thanks for the kind words as always GTO Express, and yes, once you know how to phrase your true story, it’s really not difficult to consistently win. It’s like taking an open book exam
Range of Motion detecting pain
Your so right and an excellent explanation too.
Cheers Kevin! ♟️
@@vaclaimsacademy I have my 50% for PTSD. Now I am working on my secondarys.
Thank you 🙏 learned something new. I’m at 50 for back i didnt know that it led to the neck i’ve had tingling in my left arm.
Oh gosh. Thank you for your information. I can only ask for what I need but have had a nightmare with VA in just getting the care alone, especially for my back.
Thanks for this video. I’ve got my comp/pen coming up soon. I broke my back during my enlistment and I have all those symptoms you mention.
Recently separated, no STR's, have back pain with VA X-Rays with some findings, in Florida. I can't find anyone to do a DBQ. I really don't want to leave it up to the C&P examiner, any tips? Definitely the most underrated VA Claims channel, my favorite by far.
Thanks for the kind words, your first move should definitely be to download your STRs from Tricare Online
Thank You. My Back was injured as a Young Private in The Field in Germany, Lifting Heavy equipment. Ofcourse i would get denied for My Lower Back problems. And in Desert Storm burning Wooden Restrooms.
This is tremendous!! Thank you
Thanks I like the way u broke it down .....
Great information Sir,thank you
Lots of great information. Thanks .
Thank you Wayne
Thank you so much for everything you do!
Is that 20% rating for mild, moderate or severe neuropathy?
20% is moderate
I'm combined 90%. Thanks for all you do!
Hell yeah! Go get an MRI. Also, let your VA PCP know you are experiencing tingling and numbness. Are you service connected for your ankle?
Yes 0%, so nexus not an issue. The injury was 55 yrs ago!

@@vaclaimsacademy Jordan I value your time and thank you for your commitment to help are fellow vets. I'm also AF, Security Forces. HUAAA. Can this work on denied claims? I thought VA records counted as well. I guess they only care about military. I will be the man under your guidance. Im just waiting one more week and getting the course. Double dip? took me out .😄
@@alfredtineo3023 There’s almost always something that can be done with denied claims.
The key to maximizing your claim is taking the strategic and optimal route, and that’s the clear path the course outlines so well
@@vaclaimsacademy thank you for the feed back. My case is different because im Guard that happened to acquire over 3 years active duty time including deployments to Iraq. I could sworn having them documented in my VA medical meant something. Definitely with your guidance we will figure it out. Thank you Jordan.
Thanks!!
Im confused what to do over a 15 plus years in the reserves and guard with two tours in Iraq and tons of training exercises over the years. I submitted so much and all I have SO FAR is 50 percent for PTSD. My body is shot, I went and got x rays and MRI of my lower back. I got x rays and a letter from my chiro from my neck pain, my neck has lost its natural curve which shows in the x rays. Denied for the neck pain. I just added the MRI from my lower back where it shows I have a pinched nerve and bulging disc and resubmitted that. I wish I would have resubmitted for the neck pain too.
Amazing job!!!!
Back (crushed L5, herniated discs); radiating pain down both legs; left arm numbness, irritated bowel =?
Great Video.
Hi Coach Jay, thank you for the video's! I have two back injuries and a neck injury documented in my service records. I have suffered lower back pain and neck pain since leaving service. Besides the personal statement, is there anything else I need to submit with my claim? Thank you in advance for your response.
Make sure you have an updated diagnosis showing that you are still getting treatment. Other than that, you’re good to go!
Love the videos
Good advice and strategy...i have this claim in already with MRIs, Xrays, Nexus and DBQs...all have been diagnosed by C and P examiner so hopefully the rater makes a decision in my favor...if not i will do higher level review...only one i dont have is SSD but I got MDD

Coach, First loved this video! Currently at 90%SC (true 85%), In 2016 I was awarded 20% SC on a lumbosacral strain, They denied a cervical strain, due to lack of diagnosis. I have no rating for Radiculopathy. However, I do have physical coming which I plan trying to start the process to achieve a diagnosis for the cervical strain. It's clear in your video, if I can achieve the diagnosis, I have a clear pathway to 100%. THE PROBLEM IS THE VA DOESN'T LIKE TO GIVE DIAGNOSIS'. What's your thought I getting the VA to actually diagnosis?

Great video. I hurt my back and shoulder when I fell after getting electrocuted while working in The Navy. I was young and figured it would get better but now at 50, those old injuries from that day are coming back to haunt me. Is it to late for me to be able to file a claim?
ty very much i understand you better than anyone else doing what you do.
I’m really glad to hear that Melvin, cheers
I was in a car accident while on AD i was back home when i got into the car wreck does this count for service connected? Ever since that car accident my back been bad and had bad whiplash as well. If i can come up with the police report would that help my back claims??? Ty! Love the videos been watching nonstop 🎉
What documentation (other than the C&P exam) is needed to prove service-connection. Would a recorded car accident work in a POV?
Learning a lot from you.
Do I need to go through my primary physician at the VA , in order to see specialists for my disabilities?
Thank you.
You just described me
Great classes Jordan! I have learned so much watching your va claims academy videos. For ROM you demonstrate the bending forward in a few of the videos. I had to bend forward, sideways and backward. Do those other movements effect the claim? Thanks for providing all this information for the veteran community!
Great question Corey, the other bends do NOT impact your rating according to 38CFRs language.
Thanks for the kind words my friend ♟️
That's great info a friend sent me. I wish I had this when I retired in 06 and got denied. Thanks for sharing.

So I just got my rating and I know for sure my fingers didn’t cross my knee caps and they gave me 10 percent! Not 40 and yes I had records of back problems while on duty
Should I fight it?
I spoke to the C&P examiner about the bilateral radiculapothy and she shrugged it off
Do you have a diagnosis?
Awesome video
Thanks Kev!
I volunteered the information during my C&P exam and they didn't add anything. It was on the paperwork that I filled out for the VA. My legs went numb during the C&P exam and I nearly fell when she asked me to stand and I didn't get any bilateral nothing.
You need a VA Disabilty attorney, call Berry Law they're great. You need case law
I just got 10% for having a service connected actual _fractured vertebra_ with arthritis and scoliosis.... WHERE did I slip through the cracks?
I believe i claimed back and neck. i dont think i claimed SSD. From what i was told, i have 90 percent so SSD will probably give me my 100 hopefully. Im medically retired today so waiting on the fine print raring.
0:07 did ge say "for your F&&king fsmily" LOL
I tried claiming neck pain secondary to lumbar strain, and they denied due to case law that lumbar strain or pain does not cause neck issues, which in my case was degenerative disc disease.
I just got a phone call from my vso stating I will be getting 60 percent for my back pain.Thank yes I did what you said do it works I was at 10 percent would it be 70 percent.
What should the diagnosis say. Because Ive been having pain forever and my Dr has not written it as a diagnosis.
Do you have to file a claim for each one of those or just tell the c&p examiners? Also is this something you would explain in your personal statement?
I hurt my back in the Army went to sick call several times had X-rays done given paid medicine and instructed to use a bed board and during this time MIR technology was not yet out, all this medical instruction was documented on my medical file while in the Army. My case went to the BVA after I appeal my deny been waiting now for 3 years. It was sent back remand and a CP was done my total ROA was 85 and diagnosis with degenerative arthritis that was on my CP report. What is your opinion on my case with the information I have given??
I want to submit a claim for an injury that I had to my ankle in 2004. The orthopedic surgeon at the time commented to that the injury was probably related to my military service since I was a sports active person prior to my military service. Could you possibly go through the claim process for a Osteochrondritis dissecans to include osteochrondral fracture to the ankle bone. Thank you for your expertise in this area. I appreciate anything you are willing to do.
I just did my C&P and when I did my range of motion I didn’t really move at all they only gave me 20% again
I followed step by step and still got denied, currently in the appeal process
How would i make this look on personal statements ?
What if i didnt say tell my (representatives for my case) that for my documents(evidence), is it still possible to say it for my c&p exam?
Can you file all these claims at the same time.?
yes
I am at 10 for tinnitus and 10 for back pain. How do I articulate all these extra pains linked to these conditions. Can your course help me out? Thanks!
What if they awarded 10%, how do I get more?
Is the back and neck a separate claim....I get that it's all connected but I thought those were separate claims
Should i include Radiculophy in my lumbar personal statement?
I have 10% for LUMBOSACRAL STRAIN and throughout the years the pain has been getting worse. So I can do this but where do I go or who do I contact to get my rating review to increase? Do I call the VA or hire an attorney?
