I hope you all are doing extremely well. I've made this especially for you guys so that you can have a gist of how is the process related to TRC in Poland. I live in Poland since a year and half now and have a good knowledge of how things work here. Hence, thought of sharing it with you guys.

1) Temporary residence and work permit:
Legal grounds - Act of 12 December2013, on Foreigners - Article 114 and 126 of the Act - along with implementing acts.
2) To whom and for what period of time it may be granted:
Temporary residence permit shall be granted for the period necessary for implementation of the purpose of the foreigner’s stay within the territory of Poland, exceeding 3 months up to 3 years, with the possibility to apply for the subsequent permits.
***Please, note important exception: this permit may not be applied for by foreigners:
being employees delegated by an employer seated outside Polish borders, residing within the territory of Poland on the basis of obligations as stipulated in international agreements concerning facilitation of entry and temporary residence of certain categories of natural persons, dealing with commercial transactions or investments, or
conducting economic activities in Poland,
performing seasonal work in Poland,
residing within the territory of Poland on the basis of a visa issued by Polish body for the purpose of tourism or a visit with family or friends, or
residing within the territory of Poland for the purpose of tourism or visit with family or friends, on the basis of a visa issued by another country of the Schengen area.
3) Where and when to make the application
Foreigner shall make an application in person, not later than on the last day of legal stay within the territory of the Republic of Poland to the voivode competent for the place of residence of the foreigner.
When making the application the foreigner shall be obliged to provide fingerprints.
4) Fees related to granting the permit:
Temporary residence and work permit for an employee:
Stamp duty PLN 440
Fee for issuing a residence card PLN 50
Temporary residence and work permit for a foreigner being board member in a limited liability company or a joint stock company, which shares or stocks are not owned by the foreigner PLN 340. Fee for issuing a residence card PLN 50
However, if you are applying through an agent or consultancy they will charge you around 2000 PLN approx.(NOTE: this amount can vary from where you apply)
5) Necessary documents: Kindly follow the details form the URL above.
6) Residence status after submitting the application: The foreigners stay is deemed legal from the day of submitting the application until the day when the decision in the case of granting temporary residence permit would become final.
7) What to do if the decision is negative: The foreigner is obliged to leave the territory of the Republic of Poland within 30 days following the day, when the decision on refusal to grant the temporary residence permit, the decision on discontinuing the aforementioned case or the decision on revocation of the permit has become final, in the case of issuing the decision by the higher degree authority, following the day of servicing the decision to the foreigner, unless that person is entitled to stay within the territory of Poland on another basis.

Can you appeal if the decision is negative? :
Foreigners, who are dissatisfied with the decision of the Voivode, may appeal to the Head of the Office for Foreigners (UdsC) in Warsaw, through the Voivode who issued the decision. Written appeal should be filed within 14 days from the date of receipt of the decision.
The foreigner may appeal against the decision of the Head of the Office for Foreigners in the administrative court within 30 days from the date of receipt of the decision.
Filing an appeal at the administrative court does not constitute a legalisation of the stay. This means that, unless the foreigner has another valid document authorising them to stay in Poland, they should leave Poland in such case.
Can you apply for dependent TRC on their behalf, without they being physically present in Poland? :
If the foreigner resides outside the territory of the Republic of Poland, the application for granting temporary residence permit for the purpose of family reunification shall be made by a foreigner residing in Poland, who will receive the family member. Making the application by a family member of the foreigner requires a written consent thereof or their legal representative consent, unless the applicant is legal representative thereof. Expression of the consent is equal with granting the foreigner residing within the territory of Poland power of attorney for acting on behalf of the family member in the given proceedings.
Presence of the aforementioned family members shall be obligatory after issuance of the decision on granting temporary residence permit, at making the application for issuance of a residence card, for the purpose of provision of fingerprints thereby.

Rudransh Jain Thank a lot. For work permit one needs to either get shortlisted in a company so that the company will apply on your behalf. One cannot apply this work permit on their own.

Sayali i was a great information thank-you for that, my question is that work permit and TRC are the same ?
No, work permit is different than TRC !!! work permit means company sponsored letter to allow you to work in poland where as TRC helps to stay(Visa) in poland. TRC only can be apply if you have work permit and once you have TRC for 3 years then no need to extend visa every year.
So it mean that, who ever got workpermit to work in poland they should physically apply in poland for TRC for further stay im in correct?
@@MaheshDevara Yes Ideally when you apply for work permit and come to poland then you get 1 year visa and if you want to stay longer more than 1 year then you should apply for TRC

Hello Sayali, thank you very much for your videos. I’m really happy you know that you are are doing great and giving us vital information through your videos. I’m based in Dubai and there is an agency I met who is providing me a trc opportunity staying in dubai. They will give me an appointment after submission of documents in a span of 6-8 months and I’m supposed to visit Poland for the biometrics and stay there for sometime after which I could come back to dubai and be here. My question is does this work this way or do you have any agent that you can suggest who you have worked with and is genuine? Am I able to find a job on a trc permit in Poland then ?

You can travel in Schengen countries if you have valid visa but once your visa got expired and your TRC card is not arrived then you can not travel outside of poland
Once we got TRC can we travel to home country and come back to poland

Now, after me landing to Poland we both can apply for a TRC or he needs to apply a TRC first?If he alone needs to submit for TRC first, in that case what if my travel visa expires? I don't think its possible to check work permit status online but you can check with embassy on call per request.
Hi, i find your video very informative...how about if i already submitted my documents to voivode and I got a letter from them after 4 months stating that the decision will until July 2021. Also states there that by that letter I can apply for a TR card But they didn't interview me yet, they only interviewed my neighbors. Should I wait for them to interview me then I can apply for the card? I am spouse of polish citizen.... I hope you'll answer my question. Thank you.

@Sayali, job well done, however, a factual correction, @7:11 you say one cannot apply for TRC without being present, because of biometric, which I am afraid is not correct, biometric takes place at time of TRC collection and not application, secondly in case of family reunification (this is a request to apply for the spouse/children TRC for a blue card {niebeiska karta UE} TRC holder), one can apply for the TRC on behalf of their spouse, without the spouse being present, once the TRC is approved there will be a short visa given for the spouse/child in home country and they can arrive in Poland to collect the card, yes, at that time their biometric will be taken. So in summary, you need to be always present for TRC collection and may/may not be during application (on case by case basis). Moreover the "physically present" condition is not applicable for less than say 4 year old kid as well...Nevertheless, I must say a good initiative, keep it up !!!

If you have plans to say in Poland more than one year as you will only get D visa for 1 year then yes you need to apply for TRC.
TRC validity depends on your application it can be 6 months, 1 to 3 years anything.
Yes you can appeal for your negative decision.

Passport stamp will be done at Immigration office in poland once you submit all your valid documents
Foreigners can submit applications and required documents on their own. This all without a need of an assistant that charges extra money for their presence.
The stamp duty (administrative fee for TRC) can be done at cash counter, called “KASA”, in Department of Foreigners or via bank transfer (a printed confirmation should be attached to the application form).
Be aware of unreliable and pseudo attorneys and good luck to your application forms. Congrats on your videos. 🎊💪

Hi, very good video, I got a doubt.
If someone holds one year visa and applies for TRC in the very first month after coming Poland. As you said decision can be negative and may take 4-5 months time, and if decision is negative, has to leave Poland within 30 days of decision. But in this case visa will still be valid for rest 7-8 months or visa will become invalid for stay?
Mostly people appeal for negative decision in such cases and try to get TRC with all valid documentation/process

Hi, You said that for a dependant to apply for trc , he/she has to wait for the original trc holder to get the card. Is it applicable for blue card as well? As me and my wife are going for applying for a blue card and blue card dependant.

Not possible. Your TRC is only valid for poland and your company. You need blue card in such case if you are looking for job in different Schengen country

2. What is the minimum and maximum duration of TRC?
There are no categories actually, TRC is Just like temp residency documents and using it you can stay legally in Poland. Duration of TRC varies from 1 to 3 years

Apply for job in germany and get work permit done. Poland TRC does not have any connection or advantage towards german employers
and when you deposit your passport for the TRC are you given a paper that allows you to go out or move around the country?
They just stamp on your passport which is enough to move around country (inside poland)

I live in gdansk, I do my 2nd TRC application through a lawyer, and the lawyer did my fingerprint in warsaw with direct fingerprint date 20 Dec 2023. Now after watching your video I came to know that application has to be made in the same voivodship. Now my lawyer does not respond to me properly.
Please let me know what can I do now? My 1st TRC will expire on 26 January 2024

Is it true that the process is so hectic and people get denied a lot? Secondly, can you name some genuine consultancies for the trc process? I highly appreciate your help!!
Deb USA Hello, the process is not hectic if you submit your documents on time. It’s just that to receive the card it take a long time of at least 4-5 months. And now due to COVID I’m sure the immigration officers are gonna have a lot of backlog. If you keep all your details clear and submit all the docs on time without they having to remind you then I don’t think there should be denied.

Deb USA yes definitely. Because there’s a strict and mandatory quarantine for people entering Poland especially if one is from USA or Asia.

For student if the course duration is 3 years the visa is given for one year.If there is a stamp in passort, the question is that the student may be allowed to stay till he gets trc
