  • Very often our justice delivery poses multiple barriers for the common people, that the working and the style of Courts do not sit well with the complexities of India, and that our system, practices, rules being colonial in origin may not be best suited to the needs of Indian population- CJI NV Ramana
    The Chief Justice was speaking at an event organised by the Karnataka State Bar Council to pay tributes to Late Mr. Justice Mohan M Shantanagoudar.

    What he is saying is 100 percent correct but to bring all these changes we require ministers who understand law.

    The example of rural litigants was very apt... In the context of procedure, I absolutely agree... Whatever is logical should be done without thinking strictly in terms of "Indian" or "Colonial"... If it's logical, it should be done..

    The system isn't so much the problem as are the people running it. Everyone treats their post like it's their own bloody kingdom. Unless the people learn what a professional should behave like, there's no hope for our country.

    We took 70 long years to realise that we are continuing still British India Acts and rules. Even our Constitution is drawn from 1935 British Act

    While framing, law should be simple also. For example, for claiming to recover compensation for damages caused to goods in transit, it is found that the Hong Kong District Court rules and procedure, are simple, of course that is under the Common Law System. In India, laws are often made complicated and difficult for the common man to comprehend...adv. T. M. Nadar

  • @tsnegi7500
    @tsnegi7500 2 года назад +1

    The CJI invariably mentions the plight of the common man and the citizens of India expects a lot from him particularly the accountability of the judges right from subordinate court to the apex court. I would like the drastically change in the justice delivery system during his tenure..There's absolute need for responsibility and accountability of judges e.g. in the covid the judges remained idle without taking up the cases and the cases were adjourned for fairly long periods..Secondly there is an urgent need to limit the adjournments to reduce the pendency.Thirdly, the procedure for writing judgments needs to be revamped..There should be one majority and one minority judgments only..The precedent of writing separate judgments is completely useless and wastage of time and energy..Lastly the judiciary can only be made accountable only if it is brought under the purview of Right to Information..

    The system is not the problem. The courts depend on the police reports. When the police forces are biased either in respect of loyalists towards political parties or religions or castes or money etc, delivery of judgements depending on such reports must be wrong. Another allegations are against judges, who eyes on post retirement assignment like MP, GOVERNOR etc. during delivery of judgements. I also ratify Hon. CJI Sir,s observations.

    The collegium system derived from British colonialism incorporated in article 50 in constitution in 1950 granted temporarily by Lord Mountbatten viceroy of interim government made by people not authorized for 75 years which is subject to cancelation by Government of Independent India by direction of President of India MS Droupadi Murmur. Collegium system void ab initiio illegal .the Supreme Court chief Justice is heredatory Monarch not acceptable to people in democracy.
