Yes 100% would recommend koh Samui over Phuket! Being in koh Samui you could even head over to koh phangan (one of our favorite islands) for a few days
They didn’t ask for it when renting a scooter, only asked for passport. Not sure how it would be if you get stopped by police though. We have one just in case :)

You'll be in the best country to have durian in that case :D it feels like a cultural food for sure.
