@@roselitovillar9611 On Monday 11 July 2022, two subsidiaries of the Malaysian state-owned company Petronas, were seized in Luxembourg. Specifically, with the subsidiaries Petronas Azerbaijan (Shah Deniz) and Petronas South Caucasus, which manage the state energy company’s gas interests in Azerbaijan and could be worth more than USD 2 billion. Luxembourg, one of the countries party to the 1958 New York Convention, recognises and enforces the award rendered by Spanish arbitrator Gonzalo Stampa in Paris on 28 February 2022, which awarded the Heirs compensation of USD 14.92 billion from Malaysia.
It is important to note that as long as Malaysia continues to ignore the ruling, the money owed to the Sulu heirs will increase. The arbitrator in France decided that for each year unpaid, Malaysia’s outstanding liability to the heirs would increase by 10%.
Bernardo Cremades Jr (pictured), of the law firm B. Cremades & Asociados, which represented the heirs of the Sultan of Jolo in the arbitration, said: “The legal steps laid down by international law have been fulfilled. The next step was the recognition of the enforcement of the award in any of the 170 member countries of the 1958 New York Convention, and in this case in Luxembourg. Under this convention - to which Malaysia is a party - recognition and enforcement (and consequent attachment of property) could be sought despite the defendant’s objection. This risk was highlighted by the former Attorney General of Malaysia, who was in office for much of the arbitration and even sent 2 letters to the sole arbitrator, Stampa.”

Kasi daw ayon sa mga Ibang mga political and law experts, State Immunity daw is not Absolute..And Malaysia was part of the 170 countries who signed sa New York Convention na State Immunity will be under Restrictive Immunity if that country will enter into a Commercial transactions.. Siempre kung may commercial interest yung bansa na iyon sa Ibang bansa at may nilabag sila, it will fall under Restrictive Immunity..Kaya their State Immunity is not absolute..Kaya na checkmate ang Malaysian Government dito kasi Kailangan ng I enforce yung ruling para mabayaran ang heirs ng Sultanate of Sulu..

I think it doesn't matter either their is no document or has document of transfer of Saba ownership from sultanate of Brunie to sultanate of sulo for as long as British Dutch company recognise sultanate of sulo as owner when they sign a contract for renting saba from Sulo sultanate without opposition from sultanate of Brunie when both party sign a contract .is that not enough evidence whose the real owner.

@@MANGYANSINGER , first of all there was no such an entity called British Dutch Company. This showed that you don't know anything. The Company involved was BNBC - British North Borneo Company aka NBCC - North Borneo Chartered Company.
"....without opposition from Sultanate of Brunei...". Brunei didn't oppose because as the real owner, Sultan of Brunei had ceded the whole of North Borneo to BNBC on 29 December 1877 and it was documented. Concurrently Sultan of Brunei appointed Baron Van Overbeck the co-owner of BNBC as Maharajah of North Borneo and Rajah of Sandakan and Gaya.
The above event was before the "pajak" agreement between BNBC and Sulu which was signed on 22 January 1878. This led to an overlapping issue on North Borneo. BNBC signed the agreement with Sulu not as a recognition that Sulu was the owner but just that they would not get into trouble with Sulu. Their main objective was to do business and exploit the resources.

If we're talking a Commercial arrangement bet. the Sultanate and the British entities were the Sabah was leased back then, we can probably say that in its legal standpoint of view the Sultanate and its heirs has all the legal rights even if the Sabah territory was transferred to the Newly formed govt. of Malaysian Federation in the year 1962. The sovereignty can not be involved legally for transfer that's why the Federation of Maylaysia govt.was still paying the Sultanate the lease and its not a cessation money as Malaysia is claiming it was and therefore implying its sovereignty. Before the Federation of its gov't was created, the Sultanate of Sulu ceded and transferred their rights and sovereignty to the govt.of the Republic of the Philippines in the year 1960.

The decision of the Arbitral Tribunal was based on the evidence presented by the heirs of the Sulu Sultanate. This evidence was in the form of receipts paid by the Malaysian government as their rental "pajjak" fees to the land until it stopped sometime in 2013. The continued payment beginning in the 18th century until 2013 strongly acknowledges the ownership of the Sulu Sultanate of the Sabah land. Hence, this issue must be separate from what is being raised by the Malaysian government concerning "sovereignty". The heirs of the Sulu Sultanate can file a motion for the enforcement of the decision of the Arbitral Tribunal (monetary claims) while it awaits the separate issue on sovereignty to be heard pendente lite. The stay order filed by Malaysia is illegal!

Just a reminder, the french arbitral court enforced by stampa was ILLEGAL and Contradicts the laws.
Dec 16, 2021 from the First President of the Paris Court of Appeal suspending the effects of the Exequatur Order in France and barring the claimants from relying on it.
Stampa upheld the claimants' request in disregard of the suspension of the effects of the Exequatur Order.
"Therefore, it follows that the final award rendered by Stampa on Feb 28, 2022 not only violates Malaysia's sovereign immunity but was also rendered in disregard of the Madrid and Paris court decisions.
The Spanish Public Prosecutor has filed a criminal complaint against Stampa for serious contempt of court and professional intrusiveness, it said.
It added that the Criminal Court N.40 of Madrid has subsequently started a criminal investigation in connection with the illegal actions of Stampa.
"The Malaysian government will continue to take all necessary actions including legal actions to put an end to the claim and to ensure that Malaysia's interests, sovereign immunity and sovereignty are protected and preserved at all times,"

Same with Sulu its their land but they don't govern, only difference is that the Malaysian government doesn't even acknowledge the rightful owners!

And if you want to go deeper the Malay side says they sold it and Philippine side says they leased it...
Well you have to go back further when the Americans who originally obtained the agreement from the Sultan of Brunei (which BNBC would later administrate) and what it says.. a decade before the Sulu BNBC 1877-78 agreement
In July 1865, the United States' Consul for Borneo, Mr. Claude Lee Moses, obtained from the Sultan of Brunei a concession which embraced most of the territory later to be administered by the British North Borneo Company ("BNBC"). Mr. Moses was unable to develop the concession himself and ceded the grant to the "American Trading Company" headed by the American Joseph Torrey with the backing of two Chinese businessmen from Hong Kong.
With the financial situation of the company in a precarious situation, Mr. Torrey sought to convince the U.S. Government to take over the concession. When this proved unsuccessful, Mr. Torrey found new purchasers in the persons of the Consul-General of Austria-Hungary in Hong Kong, Baron von Overbeck, and the brothers Alfied and Edward Dent, two commercial agents who had founded the British company "Dent & Co." operating out of London and Shanghai. The new concession was an assignment of the original concession to the "AMERICAN COMPANY" (note the word company and the fact they were deal with commercial agents and commercial interests)
But what does "concession" mean in terms on commerce, commercial agents and companies?
-the right to use land or other property for a specified purpose, granted by a government, company, or other controlling body.
      "new logging concessions"
      or
      - a commercial operation set up by agreement within the premises of a larger concern.
"the concessions will offer photo processing and a pharmacy"
the right, given by a company, to sell goods, especially in a particular place.
So we instantly understand that the concession obtained from the Sultan of Brunei by the Americans was commercial in nature and not a concession of land or property in terms of:
      - a thing that is granted, especially in response to demands.
"the government was unwilling to make any further concessions"
      or
      - the action of conceding or granting something.
"this strict rule was relaxed by concession"
      or
      - a gesture made in recognition of a demand or prevailing standard.
"her only concession to fashion was her ornate silver ring"
      Furthermore:
On 29 December 1877, the Sultan of Brunei agreed to issue three separate grants to Messrs. Dent and Overbeck encompassing a large area of North Borneo (some 28,000 square miles of territory) in exchange for a total annual payment of $1 5,000~~.
(Since we know what "concession" meant in the original agreement between the American Consul and Brunei by Mr. Claude Lee Moses in 1865 it was for rights to trade and do commerce in the Brunei territories, the rights/concession of which would be later administrated by BNBC)
We also understand what "grant" means in these above agreements between Dent and Overbeck. And they were not "land grants or sales of land" but grant in terms of making lawfully the Brunei lands available for the BNBC company to use.
-a sum of money given by a government or other organization for a particular purpose.
      "a research grant"
      or
      - the action of granting something.
"we had to recommend the grant or refusal of commercial licenses"
Furthermore: Since this grant included a portion of territory along the east coast of Sabah which was also claimed by the Sultan of Sulu, Baron von Overbeck deemed it prudent to enter a separate agreement with that ruler as well. In the words of the British Acting Consul-General in Labuan, Mr. Treacher: "The Sultan of Brunei's territory extends, at the utmost, only to the West side of Malludu Bay, though formerly the Brunei kingdom extended as far as Cape Kaniungan, on the east coast, in latitude 1" north. (IMPORTANT PART --->)The remaining territory mentioned in the grants is actually under Sulu rule, and occupied by Sulu Chiefs, and it was only because the districts were Mentioned in the original American grants that they are again included, and Mr. Overbeck will now have to make a separate agreement with the Sultan of Sulu for them".
On 22 January 1878, the Sultan of Sulu agreed to transfer to Dent and Overbeck for an annual payment of $ 5,000 a concession to the territory described as follows:
". . . all the territories and lands being tributary to us on the mainland of the Island of Borneo, commencing from the Pandassan River on the West coast to Maludu Bay, and extending along the whole east coast as far as the Sibuco River in the south, comprising al1 the provinces bordering on Maludu Bay, also the States of Pietan, Sugut, Bangaya, Labuk, Sandakan, Kinabatangan, Marniang, and al1 the other territories and states to the southward thereof, bordering on Darvel Bay and as far as the Sibuco River, with al1 the islands belonging thereto within
three marine leagues of the Coast"
Following these transfers, the Dent and Overbeck syndicate established a presence in Sabah. In early 1878, two "residents" were established on the west coast on the Tempasuk and Papar rivers and one on the east coast at Sandakhan Bay.
I have proven without a doubt that these were "commercial grants" for British originally American syndicates, companies and commercial interests to use for an annual payment to use those lands for their commercial activities... after the companies left or disband the land would still belong to the Sultanates that gave them grants and concessions to use it..
These were not "land grants or sales of land in perpetuity" of any kind to the Americans or the British.. To look at it any other way is an attempt to steal,... and makes any other points null and void.

      Note here:
Lord Salisbury Foreign secretary on North Borneo to the Dutch Inquiry of the nature of the Overbeck and Dent concession/grant.
      In September 1878,
Count de Bylandt, the Dutch Minister in London, handed a note to the Permanent Under Secretary of the Foreign Office, Sir Julian Pauncefote, setting forth the legal rights of The Netherlands~~.
(Sir Julian Pauncefote between 1874 and 1899, was a British barrister, judge and diplomat. He was Permanent Under-Secretary of State for Foreign Affairs between 1882 and 1889)
Pressed fürther by Count de Bylandt (the Dutch minister) with respect to the request for a Royal Charter by Dent and Overbeck and as to Britain's intentions concerning north-east Borneo, the British Foreign Secretary,
Sir Julian Pauncefote superior Lord Salisbury, replied: that his Government respected the rights of the Sultans of Sulu and Brunei and did not intend to do anything in derogation of those rights.
      Lord Salisbury added:
"Probably, even if our response to Messrs. Dent and Overbeck was favourable, Her Majesty's Government would not go fürther than was justified by the precedents of Sir James Brooke at Sarawak, or of those
chartered commercial companies which in former times it had been the policy of this country to establish in various parts of the world without any aim of territorial acquisition.
More importantly he goes on to say:
"The object of Her Majesty's Government was not to set up any dominion, or to enter upon controversy with respect to territorial
claims, but simply, if we saw an opportunity, to promote the development of the resources of the country under discussion"~
CLEAR STATEMENT IS MADE BY LORD SALISBURY FOREIGN SECRETARY OF HER MAJESTY'S IN UNAMBIGUOUS TERMS THERE WAS NO INTENT TO TAKE CONTROL OR RULE OVER LANDS ONLY TO DEVELOP LAND!
      FUTHERE MORE:
In any event, the Netherlands Governrnent was not unduly concerned by the BNBC company's activities in North Borneo since, as the Dutch Colonial Minister noted in reply to an enquiry raised by the Parliament in 1880, this was "simply a question of the establishment of a private Company"(By the British). Moreover, the Minister felt that the Dutch interests had not been affected by the grants given by Brunei and Sulu
(grants to develop the land not to buy or control or rule over them!)
THE BNBC OWN CHARTER STATES AS FOLLOWING:
The BNBC's Charter stipulated a policy of respect of the local customs and internal
affairs. Historical studies of the BNBC's administration confirm that the Residents were carefùl not to interfere in the life of the indigenous populations. Notably, judicial administration over the natives was exercised by their own chiefs and headmen and carried out by the village courts in accordance with local customs. Similarly, the collection of taxes was carried out by local chiefs and other native collectors. In any event, even if the BNBC had wanted to carry out a different strategy, it lacked both the staff and the financial resources
to administer properly such a vast and diverse expanse of land5'.
      - the charter states the judicial administration of civilians was in the hands of the local rulers not the BNBC, only the real rulers have right to decide judicial matters or tax people and did not delegate them to the BNBC (the BNBC was there to develop land not to rule and make judgments or tax people)
malaysia have no legal ground to stand on
even her queen majesty clears states through her foreign secretary of north borneo at the time
with lord salisbury's statements to the Dutch about their grants in north borneo "The object of Her Majesty's Government was not to set up any dominion, or to enter upon controversy with respect to territorial claims, but simply, if we saw an opportunity, to promote the development of the resources of the country under discussion"
therefore the grants given by the sulu sultanate are leases and even if they were not (which they were not) the queen did not want any of her representative or private and commercial charters GAINING ONWERSHIP DOMINION OR RULE OVER ANY TERRITORIAL CLAIMS IN THE AREA!!! FOR BNBC TO GO AGAINST THEIR QUEEN WOULD MEAN THEIR CHARTERS AND LICENSES REVOKED.... thus it was always a lease...

    *MANILA ACCORD August 5, 1963*
(Sabah still belongs to Sulu Sultanate)
    Was signed by:
    1. Tengku Abdurrahman (Malaysia)
    2. Diosdado Macapagal (Philipina)
    3. Soekarno (Indonesia).
    *Content of the agreement.*
Based on the context of attachment of UN General Assembly 1541 (XV), number 4 principal 9, and evaluation of UN Secretary General (at that time held by Bhutan); the three countries, Malaysia, Philipine, and Indonesia HAVE TO WAIT SABAH STATUS DECISION BASED ON TERRITORY OWNER VOICE (FROM SULU SULTANATE), OR RESULT OF LOCAL PEOPLE VOTES IF SULU SULTANATE WITHOUT BEING FORCED HANDED OVER THE DECISION OF SABAH STATUS TO LOCAL PEOPLE WHICH WOULD BE SUPERVISED BY UNITED NATION; because it is related to law order of territorial tenure or decolonization (on the basis of rent document as a proof, SABAH IS NOT BRITISH COLONY, or IS NOT OWNED BUT RENTED BY BRITISH, SO THAT SABAH IS OWNED BY SULU SULTANATE, and BRITISH HAS NO RIGHT TO HAND OVER SABAH TERITORY TO ANOTHER COUNTRY).
Generally, INTERNATIONAL LAW, decision to certain Sabah status (attachment of UN General Assemby 1541 (XV), number 4 principal 9) MUST BE BASED ON ONE OF THE ALTERNATIVES BELOW:
    a. give back Sabah teritory to Sulu
Sultanate as the owner of Sabah,
    or
    b. (if) Sulu Sultanate without being forced
handed over voice right to local people
for voting Sabah status certainty, then
the decision of Sabah status would be
certained by one of the following
    choices:
    - join to Malaysia
    or
    - join to Philipine
    or
    - join to Indonesia
    or
    - establish a new country.
BUT MALAYSIA DIDNOT OBEY THE AGREEMENT and IGNORED UNITED NATION RULE ABOVE through DECISION TO ESTABLISH FEDERAL STATE OF MALAYSIA AT SEPTEMBER 16, 1963; ANNEX SABAH WITHOUT RESPECTING THE OWNER VOICE, OR LOCAL PEOPLE WILL (if Sulu Sultanate handed over the decision of Sabah status to local people) AND WITHOUT RESPECTING UNITED NATION RULE ABOVE THAT WAS COMMITTED IN THE AGREEMENT. This Malaysia’s decision ignite anger of two countries (Philipine and Indonesia), so that in 1963 Philipines and Indonesia cut off diplomatic relations to Malaysia, and was followed by conflict and confrontation by Indonesia that was called “Ganyang Malaysia” at that time. Generally, INTERNATIONAL LAW (based on attachment context of UN General Assembly 1541 (XV), number 4 principal 9), enforces rule that TAKING OVER A TERITORY TO BECOME A NEW COUNTRY MUST BE OBEY THE RULE BASED ON ASPIRATiON (VOICE) OF THE TERRITORY OWNER’S DECISION. IF NOT, THEN THAT TERITORY IS PERMANENT BELONG TO THE OWNER. Because British was not the owner (rent document as a proof), then SABAH IS STILL OWNED BY SULU SULTANATE (British only as a renter to Sulu Sultanate according to agreement). SULU SULTANATE AS THE SABAH TERRITORY OWNER HAS THE LAW RIGHT TO DO ANYTHING RELATED TO HIS OWN TERRITORY.

Then it was change to 5300 ringgit far from the actual price of leasing by Malaysia. So the heir princess maybe shocked by not paying them as in a real price by BNBC.
Surely the interests of it goes highs it was blown out to 14.9 Billion dollars or maybe pounds. And that's a huge payment for Malaysian gov't. They must pay it or else may get sequestered of their some assets such as Petronas. Now the princess and families demanded that Sabah must be taken back to them and to the Philippines for the rights to govern again smoothly, non payment of it will give them a great concequences..

There's a win-win situation here that we can aim for. The Malaysian Government can continue leasing the land and pay the Philippine Government and the Philippines in turn under the constitution must also give the Heirs of the Sultanate of Sulu a part of the lease. The Philippines in turn must get shares in the natural resources in Sabah as well as the income. It's a win-win situation. Malaysia can keep Sabah in exchange for the annual lease payments. The Philippines can get shares from the Natural resources and the Sultanate of Sulu can earn money.

The thing is the annual lease payment should be in Mexican gold currency like how the Brits paid before the lease was transfered to Malaysia, and Malaysia paid in ringgit which was sorely lacking and was only tolerated to avoid dispute. The last straw was when they stopped payment altogether. The coin was supposedly a Mexican gold coin not ringgit.

The original lease contract from 1878 is now null and void. The Philippines, along with representatives of the Sulu Sultanate, should renegotiate a new lease for a commensurate amount that reflects the actual value of the natural resources being extracted from Sabah. That way, Malaysia retains its "sovereignty" over Sabah, the heirs of the Sulu Sultanate get paid a significant sum every year, and the Philippines government receives capital gains tax on that lease money paid to the Sultanate.

    • @neoab8608

Even if you don't go to the court. It's a simple logic. Why Malaysia was still paying rent until 2013 to the heirs of Sulu Sultanate? The moment they have started paying the rent is already a justification that part of Sabah is not part Malaysia and is in fact owned by Sulu Sultanate. As per the Malaysian MPs, they tend to belittle their neighbouring countries and also the Sulu Sultanate because it is not a governing body anymore. Another logic, is it acceptable when the renter is saying he owns the property he is renting?

    • @itsme_mocha
      @itsme_mocha 2 года назад

@@neoab8608 It was not a rent. It was cession money. It had been like that since Overbeck & Dent. The Sulu sultanate never challenged the wording in the receipts. And majority of the people in Sabah agreed to join Malaysia, confirmed by Cobbold Commission. And only 2 presidents of the Philippines recognised Sulu sultanate yet wanted to claim Sabah which clearly contradicting. And the decision made by Stampa is not legal because he was already annulled by Madrid. Focus on the welfare and harmony of the people and nation rather than making attempts to claim other people's country which can lead to wars and loss of lives.

    • @neoab8608
      @neoab8608 2 года назад

@@itsme_mocha how come its a cession money? It's a rent money. I got your point. War is not the solution. Pajak is a rent money. The Malaysian Federation was paying RENT until 2013 for 5300/53000 ringgit. The ruling was to pay the just amount for renting the land. You can also ask the sabahan, they all know from different generations about the history of Sabah that the Sabah is the Sulu Sultanate's land. If we trace the root cause of this... These British made a mess again.

    • @itsme_mocha
      @itsme_mocha 2 года назад

@@neoab8608 prior to any claim made, ensure the evidence is justified. Pajakkan to British means to grant and cede. This is supported by Najeeb Mitry Saleeby etc. This word is stated in 1878 agreement. However in 1903, Sultan Jamalul Kiram II signed a document with a phrase "kita telah keredai menyerahkan kepada pemerintah British North Borneo". This is not something that only Malaysia and the Philippines know. This is a history known by many historians throughout the world. The sources are easily available in the Official Gazette of the Republic of the Philippines website. And the Sabahans had already agreed to form Malaysia together with Malaya instead of the Philippines and that is their stance even now. Even UN confirmed this. Everyone can bring evidence but it must be a sufficient, relevant, comprehensive, and reliable one. If not, even Indonesia can claim Borneo today because of Majapahit's history.

    • @itsme_mocha
      @itsme_mocha 2 года назад

@@neoab8608 also if North Borneo really belongs to Sulu till now, then why not the Philippines give their leadership to Sulu in order to reestablish the sultanate? Why not start at home since some of the heirs are Filipino nationals rather than trying to claim the land of other nation? Why only 2 presidents of the Philippines recognised them? This is illogical and irrational.

Following this, Stampa's appointment as an Arbitrator was revoked and annulled by Spanish Court. His arbitration award to Sulu of US$14.92B compensation was also annulled. Criminal proceeding was also taken against Stampa.
Sulu and Stampa tried to appeal in higher Spanish courts but failed. And finally Spanish Constitutional Court upheld lower courts' decisions revoking Stampa's appoinment as an arbitrator and annulling his arbitration on Sulu's claim.
