The Münster Higher Administrative Court has ruled that Syrian asylum seekers will no longer be recognized as civil war refugees across the board. This contradicts the previous practice of the Federal Office for Migration and Refugees (BAMF), which generally granted Syrian asylum seekers subsidiary protection. Subsidiary protection was previously granted to people who were not individually persecuted refugees but who feared serious harm, such as civil war, if they returned to their home country.
In the case of a Syrian national from the province of Hasaka, the court did not see sufficient grounds for a threat from the civil war. Despite occasional attacks and armed clashes in the region, the danger did not reach the level at which civilians would have to expect to be killed or injured. The verdict is not yet final; an appeal is possible, although an appeal has not been allowed.
In addition, the applicant was excluded from any asylum protection due to criminal offenses. The man had been involved in smuggling people from Turkey into Europe and had been sentenced to several years in prison in Austria for this. Due to these crimes, he was denied both refugee status and subsidiary protection.
The ruling by the Münster Higher Administrative Court could be groundbreaking for future decisions in asylum procedures for Syrian nationals. There are voices, such as from the Landkreistag and from the Union, calling for Syrian asylum seekers to no longer be granted subsidiary protection. The Pro Asyl association, on the other hand, fears that this could lead to an upgrading of Bashar al-Assad's regime.
