    A WORK OF ART cross examination.

    • @jlnriddick
      @jlnriddick Год назад

      Jacksonripholmes... Sorry, I'm pretty sure the jury would disagree with you on that. Cappleman had the opportunity to back Charlie into a corner with two of the most obvious, bullet proof questions... 1) How does someone extort you for money if they have no dirt to hold over your head? What leverage do they have to insure you won't go straight to the police? And 2) Why would two Hispanic dudes from South Florida drive all the way to Tallahassee (twice) to murder some law professor they had no beef with, and never heard of, unless someone specifically hired them to do that? Those two questions should have put Charlie in checkmate, but Cappleman never used them to her advantage. Charlie still walked away with a boatload of reasonable doubt. I love Georgia, but she left far too many "gotcha" moments on the table in this case.

    The prosecutor is methodical, thorough and careful. There were no throwaway questions, everyone was meant to dismantle his credibility.
    She allowed him to make his own story sound absolutely incredulous.
    For example he went to the cops because a motorist almost hit his dog but didn't go to the cops when he was supposedly being extorted by a violent gang who threatened to kill his whole family.
    And at 5:51 when he said "if they got it from Katie they got ir from me." A Freudian slip no doubt.

    I think the prosecutor had some good moments (withholding evidence while Katie was in jail; the fact that no Latin King ever contacted him; the contradiction about his mother's worrying; speculating about whether there was evidence against Katie) but she also gave him many opportunities to proclaim his innocence and to repeat his interpretation of events.
    Charlie concocted an elaborate version of events, and it is a mistake to get into the weeds with him ("first extortion," "second extortion"). THERE WAS NO EXTORTION. He paid for a a murder. All of his rationalizations and evasions can't hide the big, absurd inconsistency: why would someone kill his ex brother-in-law to extort him? They could have simply extorted him, or gone to his house and made him open his safe. What does Dan Markel have to do with any of this?
    Maybe they shouldn't have bothered to question Charlie at all, and simply told the jury that his testimony to is lawyer wasn't believable.

    Overall, the prosecutor is doing a good job letting Charlie show the sheer implausibility of his claim to have been extorted after the fact. She has brought out that he was not under physical duress at the time of the beginning of the "extortion." His girlfriend, threatening extortion, then spends the night with him. Further, he reveals he had the only firearm between them, in his safe; she was unarmed. He said he agreed to pay. Yet, a followup, hammer-the-point question the prosecutor is "What did they (the "extortioners") have on you that you would be so ready to cough up $138,000 and then $3,000 a month until $333,333 was reached?" I can't imagine it. My sister's ex-husband has just been murdered. My girlfriend, who doesn't even know my ex-brother-in-law, suddenly claims HER ex-husband and an accomplice, neither of whom knew my ex-brother-in-law either, did the killing. Remember, supposedly, I've just learned about the murder the same day. Now my girlfriend claims her ex and his "people" have enough to blackmail me or they will attempt to frame me for involvement in my ex-brother-in-law's murder or kill me if I don't pay? Hogwash! Charlie masterminded the assassination of Dan and used Katie as a buffer between the Adelsons and those who actually did the killing. If anything, Charlie's testimony reveals that perhaps there was a moment in which Katie came to him and said on behalf of the killers, "OK, the deed is done, time to pay up or you'll wind up like Dan." And Charlie is attempting to twist that exchange into one of extortion. There was no extortion. Charlie and his mother schemed up this murder, including outsourcing the "mechanics" and had their budget for the "project" already worked out.

    Charlie had a lot of time to remember all his lies and remember his stories. Im going to be surprised if jury doesn't find him guilty. And Adelson family were the only one who would benefit from his death. Charlie, Wendi and their mother should be behind the bars for the rset of their lives. Dan, his boys and parents deserves justice. RIP 🙏

    She picked him apart, no there was no knockout punch, this was a methodical Muhammad Ali 15 rounds work the body and jab and move, not Mike Tyson like we want to see, but this was very telling.

      I think she started off softly softly and I expected her to build up the tempo - but it stayed exactly the same. At the end I was very worried, I think she dropped the ball and will need to make up for it in Closing Argument IMO.

    Waiting with bated breath here in Australia and this is such a fascinating and tragic trial.. Cameras are not allowed in courtrooms here; same in the UK. I was happy to catch up with some sleep over the weekend as 9am in Florida is 11pm here.
    For those complaining about the prosecutor I really dont agree. Georgia has lived and breathed this case for years. Actually I like her style, she sounds somewhat laidback and that confuses people who think a prosecutor should shout and put on a show. Unless there is a weird juror I dont see any of them swallowing Charlie's crazy lies. At least Luis Rivera attested to his part.

      Josecortez... I have to agree! I was expecting Georgia to sink him with questions he couldn't talk his way out of, but she didn't do that. I also feel like she could have hammered home the obvious point that if they didn't have any dirt on Charlie, how were they extorting him in the first place? What was their leverage? She should have also repeatedly asked him why in the world Garcia and Rivera would go to Tallahassee and murder someone of their own accord, whom they didn't know at all and had never met? These two questions alone would have stunned Charlie into having to create an answer that didn't exist. Why in the world did she not take advantage of those two questions? She made little gains here and there, but I don't believe she got rid of the reasonable doubt at all. I love Georgia, but this cross was very disappointing!

    Most viewers of this trial thought the prosecutor, Georgia, was going to rip him to shreds. That did not happen. To me, her cross was disappointing. Johnny Depp's attorney, Camille, would have nailed him & put him in his place. Georgia really displayed her frustration with him, which should never be shown by a prosecutor. Hopefully, her cross didn't leave any doubt on the jury.
