GERMANY: No "general danger" in Syria! Court denies refugee status to Syrian
In a recent ruling, the Higher Administrative Court in Münster has determined that Syrian asylum seekers are no longer automatically considered to be at risk from the civil war. This decision contradicts the previous practice of the Federal Office for Migration and Refugees, which mostly grants subsidiary protection to Syrian asylum seekers. The limited protection applies to people who cannot prove individual persecution, but who can provide serious reasons why they could face serious harm in their homeland.
In the specific case of a Syrian national from Hasaka province, the court did not see a sufficient threat, either in his home region or in Syria as a whole, and dismissed his case. Despite ongoing armed conflicts and occasional attacks in Hasaka, the level of danger was not high enough to seriously endanger civilians. The ruling is not yet final, and although an appeal has not been allowed, an appeal can be lodged.
In addition, the judges emphasized that the plaintiff was excluded from any asylum protection due to his involvement in the smuggling of people from Turkey to Europe and a resulting conviction in Austria. He had originally sued for full refugee protection.
This decision has already sparked discussions. While the district council and parts of the Union are calling for Syrians to no longer be granted subsidiary protection, the Pro Asyl association is warning against an increase in the status of Bashar al-Assad's regime.
