The syariah law only applies to certain states as Malaysia is a federal state. Certain states with a significant non-muslim population don't have such a punishment. Unfortunately, this happened in conservative state so they had to execute the punishment.

It merely coordinate Islamic affairs ( excluding the Shariah laws) through the government agency , JAKIM . However, the Federal law, including the Penal code, is held supreme over state laws and no state law, other than those allowed, can supercede the provisions of the Federal law .

Syariah Law is only applicable in several states and not the entire Malaysia. However the religious authority can still arrest misbehaving Muslims anywhere in Malaysia. Non-Muslims are not affected. I have been to Terengganu and Kelantan many times and do not see any issues there.

Malaysia is a federalist system. Hence, each state has their own laws and customs. Though I might not agree with it, we must respect it or not don't be preaching diversity only when it is in your favour.
Friend, perhaps you have missed this point. Islamic affairs are administered by each state government , of which the respective sultans of each state is the head of Islamic affairs under the constitutional monarchy political system . Therefore, each state would implement Islamic Shariah laws differently. The 4 states of Perlis, Kedah, Kelantan and Trengganu are ruled by the democratically elected conservative Islamic politically party, PAS ( Parti Al-islam Se-Malaysia) . Hence, these state governments would implement a more stricter Shariah law that is approved by the state legislative assembly. What then is the federal government ( Putrajaya) 's role? It merely coordinate Islamic affairs ( excluding the Shariah laws) through the government agency , JAKIM . However, the Federal law, including the Penal code, is held supreme over state laws and no state law, other than those allowed, can supercede the provisions of the Federal law .

@@kokkintang9983Muslims have separate laws regarding marriage, divorce, inheritance, etc. Some states have their own enactments of Islamic law provisions separately for Muslims. The states have the authority to enact such laws. Such laws cannot contradict the provisions in the Federal Constitution.
A mother-daughter team have challenged the Kelantan enactments and won.
In this caning incident, so far, no one challenge such laws in the Court.
Federal government will not interfere in state islamic enactments, unless it's seemed as ultra-vires (done in a bad faith). 😀🇲🇾

Uh.. I see people who are not Malaysian will misunderstood the location. No, it was NOT DONE INSIDE THE MOSQUE. It was done in a Dewan in Bahasa Melayu or translated to English is Hall. So he was caned infront of the public in a hall that is within the mosque area. Most mosque today have attached offices, classrooms, halls, and many more multipurpose rooms.

A public punishment is a good thing in my opinion. It serves as a warning and a reminder to others who watched it. It can act as a deterrent. AND IT WILL HELP MAINTAIN A FAIRNESS TO ALL WHO ARE PUBLICLY PUNISHED. Because there will be witnesses when the punishment is being carried. The person executing the punishment must do it fairly to all and follow exactly what supposed to be done or he will be held accountable for it. So instead of just leaving it 100% to the court, the public will also be involved in upholding the law. Which is what we all are supposed to do anyway.

Syariah Law is only applicable in several states and not the entire Malaysia. However the religious authority can still arrest misbehaving Muslims anywhere in Malaysia. Non-Muslims are not affected. I have been to Terengganu and Kelantan many times and do not see any issues there.
