Could he be sentenced to 40 years, Yes! Will he? I don't know. That's all I am reporting. The pre-trial reporting will include the exams of the children. Which is why I stated that additional factors could be at play & additional charges could be added at the state level if they determine Josh did anything to his children. I am not here to fight with what some other RUclipsr does or does not believe. I am going off what the prosecutors say. Period. We will know when he's sentenced. I am not going to say what his sentence will be because that is literally not up to me. I can only provide you what is provided by the Feds. I hope this helps! Don't give detractors room in your head. If you tell them and they don't believe you. O.k. They can move on. You can't change minds if they aren't willing. Your info has been very accurate. It’s not just Josh and Anna’s children that should be Examined! All the Minors on that property need to be examined and possibly his nieces and nephews who have been in contact with Josh as well. Also, all money or property transferred to a 3rd party will be “clawed back” by the Government!
I completely agree with that! Every single minor (children, siblings, cousins, nieces/nephews) that he has had access to in the past needs to be evaluated. Some of them are adults now, and could reject this evaluation, but everyone who is still a minor should be thoroughly checked.

Here is what I think …protect him until he is sentenced that in order to make sure sentencing is not delayed and he is ok to hear the book getting thrown at him. Once he is sentenced throw him in and have everyone tear him limb by limb
I am glad that the prosecution is working to get the children evaluated. I am surprised with the severity of the charges that it wasn’t forced in the first place. I hope the kids are “ok” considering everything going on. If something happened to those kids, no only should Anna be charged with child endangerment, but I would love to see charges for Jimbob and Michelle for their enablement.
I hope they will also do evaluations on JB & Michelle's youngest 4 girls! That picture that is often used where Josie is sitting on Josh's lap makes me sick every time I see it. They knew all about him by then, and they were still letting him hold their little girls on his lap! 🤬

That might happen at a later date. Honestly one of the most frustrating things about the justice system is how slow it it. There's so much red tape that they have to get through that a lot of the time people fall through the cracks. I hope that eventually they will evaluate all the kids that Josh had contact with.
Anna choosing him over the safety of her children and refusing to see the truth shows shows how incompetent she is as a parent. I fear not only what's happened to the kids in the past, but also that she's not able to protect them in the future if she's this naive.

Josh has done NOTHING to show that he is accepting responsibility for his behavior or that he is remorseful. He doesn’t deserve less than the maximum sentence. If he gets 40 years, he won’t get out until he’s 73. 40 years-no less.
Look at Michelle and old Jimbo. They hired attorneys to defend Josh. In my opinion, Michelle and old Jimbo must think Josh did nothing wrong and shouldn't be in prison.
I don't know what all goes into doing Federal psi's. I used to work for the Department of Corrections for the state I live in. I have done psi's. We woukd look at taking responsibility and remorse. A person that doesn't take responsibility and denies a crime would get a longer sentence. They are a greater risk to community. We would also look at this when they're being released from prison.

I have a gut feeling that Anna is more involved in this than what we know at this point... This story goes deeper here... I get the whole brainwashed situation BUT there is also basic morals and instincts that real women are BORN WITH to serve and protect their children and by declining this these permission requested tests has me thinking she's covering up for SOMETHING... Maybe Anna was just scared to death of what could be uncovered. She was raised much like Josh. JB and Anna’s dad set up the marriage. The whole thing is disgusting. No one can change where they came from. All I can hope is ALL the kids break free of the sick “Duggar” mindset and get to live a normal life. I think with Anna what you see is what you get. I don't believe she is a particularly smart woman and I don't think she is at all savvy. If she believes josh was set-up, she probably also thinks that investigators might put words in her kids' mouths and manipulate them. Of course that is ridiculous, but so is believing josh is innocent.
I was floored in the first place, when the court allowed Josh to stay out of jail. Then, it completely blew my mind that she gave him access to the kids. His children should have been evacuated from the start of this! I’m hopeful that as time goes by, Anna and his other siblings will start figuring this out. I’m really sorry that Anna is staying with the Duggers. They are masters at manipulation. I believe as time goes by, that Anna will go back and review the facts. JBD will take control of raising those children. It’s all a horrific tangled mess.

I was a corrections officer and you absolutely wouldn’t believe how protected the Child Molesters are! One trustee was bringing laundry back to the pedos and he threw a diaper in the laundry cart ( from the visitation room) The inmate complained and the trustee had to spend 3 MONTHS in solitary confinement! They are SO PROTECTED and the biggest tattle tails. Quite ironic wouldn’t you say!? Nobody protected the children they harmed. So sick and sad 😞

They should not have had a choice about having the kids examined. There's no reason for the delay. If there's something to know, the court should consider it for sentencing. If not, fantastic. But if anything happened the kiddos should be put into (non-church) counseling. It helps. My grandbaby saw his biological father hit his gf and then started hitting. He was put into child counseling and it worked. Not exactly the same, but my point is, kids are receptive listeners. It could help them.
I mean that’s easy to say when someone is guilty, but what about someone who is innocent and falsely accused and now they want to do a genital exam on their small daughter. Parents should absolutely have the right to deny those exams.

As a child who was SAd, but my parents didn't know, I'm sure they would have felt justified in refusing. Same with Anna. She probably thinks Josh would never touch their kids. That may or may not be true. For sure, the Duggar will never get them help if he did. That's why I think they shouldn't have a choice. Just my perspective.

If god knows everything why does he allow those victims to be hurt? Why does the supposedly loving god have to be begged via prayers? Doesn't he have the wherewithal to jump in and fix it without waiting for you to beg him?!
Hopefully her kids are honest and are not coerced into “forgetting” or lying during the evaluation. It wouldn’t be the first time a parent scared a child into lying. Forensic evals with kids can be incredibly difficult, as kids’ memories are not as accurate all the time, and due to being susceptible to being led in questioning if there’s not enough objectivity. It’s a very complex and fragile task. (Psychologist who does child rivals here!)
These sorts of therapist and social workers can spot coaching pretty easily. Maybe not with a teen but certainly with children. I think coaching will make them look more guilty

This woman has been conditioned since birth to keep her head down and her loyalty strong no matter what. It’s going to take years for her to be able to see the truth if she ever does.
I believe here in the U.K. that there would have been absolutely no choice of the kids having to go through some kind of screening and checking forensically and cognitively I think that certainly as soon as Josh was found guilty this would have been done automatically by our child protection services and yes I do believe that this should happen without a doubt. I really don’t understand Anna “declining” protective services. Does Arkansas have a law about parental consent for these exams? I am in Nevada… if there is ANY report, or concern, CPS with the police backup, can go and remove the child from the hom. If nothing is found they go back, but their (parental) permission… absolutely not!
They’ve been known to do that in Michigan too. A friend of mine had her kids taken away for over a year because she stayed. She had to do parenting classes, get a divorce, a ppo, and a bunch of other stuff before dhs would even consider giving her custody
She declined because they don't trust the government and she didn't have to allow them to interview her kids. It can disturb kids and they don't know what they will be asked. Even if they force them, the ones that can evade questions will be prepped to answer in certain ways. I know someone living in a bad situation and CPS came and the parents told their daughter not to talk to the Social Worker. Nothing was done. Right now, the mother was finally arrested after her daughter talked to her teacher. The SW called and spoke to tell the mom what her daughter said. Eventually the mom attacked dad and is not allowed to go in the house without police. When more SWs came the other SW got into trouble and the mom finally got charged. The dad was told they could come in for an inspection at anytime and if he is drunk, his daughter is going into care. I hope that the kids get interviewed though.
If I have to assume, they must have only been able to prove files were downloaded. If they wouldn't have been able to confirm films had been uploaded as well, they would have removed them immediately. It's so sad why those child are about the go through with physical exam. Josh burns down everything he touches... now he's kids have to suffer. I hope Anna takes those kids and run far away. No visits, no letter, no calls, no commissary... let him suffer. I think Anna needs to be evaluated to find out how a mother could essentially abandon her kids and stand by a man like Josh. I think she was brainwashed, threatened and emotionally is not physically abused.
It's my understanding that now that he's convicted, CPS will follow up with all the children independent to assure they have stayed safe and will stay safe.

How has Anna been caring for her NEWBORN when she’s been in court every day? I’m assuming she wasn’t able to nurse (I didn’t see her wearing any clothing which would facilitate pumping) and she’s essentially been gone for over a third of her little life. One more example of how their cult teaches women to place the needs of a HUSBAND *over* those of her children. At this point, I am beginning to think that if the court told Anna tomorrow that she could go live with Josh in some weird conjugal prison IF she gives up her kids…we’d see nothing but the heels of her mule slippers after “gifting” Jana with the children.
@@nancyjones6428 It’s more a reflection on how the care of her newborn (by care, I mean the way she - and all the other IBLP women - has been trained to care for her brood) went out the window in favor of being a visible supporting presence for her husband. It’s not whether she’s choosing to nurse or not, it’s how quickly this baby was handed off to others when that is such a taboo in their world. Not defending Anna. But I keep seeing so many people saying, "She knew the truth about him and his sisters and married him anyway." I think that at that time she was probably told the version of 'the truth' that the girls were told...only touching over the clothes and only once. The sentence is up to 20 years. He will serve at least 86% of that time before being released. That time won't be classified as parole. It will be more restrictive and will include include wearing an ankle bracelet at all times. Josh will have been asked for content before being given access to deep content. It makes sense that he would have used his children. Anna needs to allow her kids to be examined. She could well be charged if any of the kids were abused. Jim Bob should also be charged with lying to court.
The sentence hasn't been determined yet. The crime he committed has a POTENTIAL of imposing a maximum of 20 years for each count. Josh was found guilty of 2 counts. So he faces a maximum of 40 years in prison.
Anna no longer has a choice about her children being examined. They will come to the door with a court order and take them. No family members will be allowed to be present at these examinations. Their choices have made it worse for the kids.

Windowless house is creepy enough. I hope and pray that Josh did not harm his own kids, but given we were told far less than the truth about what Joshy did to his sisters (Touching while reading a Bible story??), sadly, nothing wills surprise me. Admittedly, he was reading from a script, but in one of the early specials he had to say "I'm kind of a video nut..." That now creeps me out. I had just watched your video discussing the possible sentencing of JD. This woman stated falsely what you had just said. I commented on her site of how unprofessional she was, 1..because she misrepresented, lied about what you had said & 2.. her actions & words were that of someone who was out to slander another person at all cost. Arkansas DHS usually doesn't charge people when their kid gets loose once (I have experience with this 😳). I believe this is not the first time it has happened that children wandered off from that house.
If this did not happen to Jana, I could see her going & spending the next years helping Anna raise the kids, that is not fair to Jana. The fines won't make a difference in Josh's life since he's going to be sitting in jail for at least 20 years. It will be a hardship for Anna, especially with 7 children but she continued to have kids with this pervert after the Ashley Madison debacle so it's hard to feel any sympathy for her.

I agree Katie Joy has given plain simply and as accurate information as she could possibly give. I worked with section 1 offenders she that made josh's actions and involvement like that of a sixteen years old boy attempting to be on a par with middle aged men of vat experience. I am concerned about how the sharing of information as she appeared visibility upset several times. Katie has little realisation of how much she presented this terrible situation in such a manner as to break through the *** he's a Dugger** their good people*** it's the haters, those envious others who fabricated everything about this ** ** he never touched his sister's or anyone else** ** he like his family members are home schooled he doesn't understand the way computers work so he isn't capable intellectually to have done all that** ** he was hacked set up and framed ** ** he was /is being groomed for blackmail**. The fact that they took photos of his hands and then Josh’s team tried to have that suppressed…. That doesn’t bode well, for the argument that he wasn’t making content. They aren’t going to just take a picture of someone’s hands.
The hand pictures the Feds took has been confusing to me. I imagined it was proof he was sitting at his desk, hands on the keyboard, watching the downloaded content. Was there ever any mention of his hands identifying him? Why wouldn’t they investigate him for uploading content prior to trial? It makes no sense for there not to have been a full investigation.
@@Pixyedust That’s really good news. My understanding is that file sharing is the way these sickos are able to receive material. With Josh’s prior access to so many children, I was really concerned that his children were videotaped in exchange for the materials he received.
@@CorruptionRevealed the file sharing in torrent means that everyone downloads bits of the file from other people’s systems. Similar to how the old Napster worked for music. It doesn’t mean you have to create and upload your own content.

With all of the shenanigans Josh and his counsel were doing pre trial and the action that was seen during the trial, I think that the judge is going to throw the book at him... it's going to be as long as he can make it legally...
I hope they also do that for his youngest siblings. Considering what he did with Joy-Anna and there are clips of other children in his parents house sitting in his lap and they should check jessas children.
I think Anna just loves her nasty husband and will follow him to the ends of the earth. She will never believe anything bad about him even if it happens in front of her eyes. I also think they will give him enough time in jail until his new baby is close to being grown.

I think Anna got the full dose and truth in court for a few days. Her only hope was the spoke person by the defense about the computer then that was shot full of holes. Anna knew Josh had issues she knew it when she married him, after Ashley Madison and his sister's she had to know he was not going to stop. There is no help for people like Josh he will continue this behavior the rest of his life in or out of jail.
Honestly think Anna feels she has no choice but to stay with Josh. Like she lives on Jim Bobs property, he’s the one paying for her kids. Anna is coaching the kids to not disclose anything. She is an enabler. She’s not as innocent as people think. No way did Josh not touch his kids, and no way Anna didn’t know. It’s just the beginning. I think if he physically harmed children it most likely wouldn’t be his own but rather a niece or nephew so I agree with the sentiments that all children in that family need to be evaluated which is so heartbreaking because that’s a devastating life experience no children should have to go through.
He would most likely do it to his own children to be honest. He doesn't strike me as the kind of guy who is good with kids and the one who is always down on the ground hanging out with the kids, being hands on and building relationships in order to groom He seems like the type who will take what he can get, where he can get it where no one is watching him: at home...when Anna is busy...as a ploy of being a good Dad, manipulating his kids into stuff.

In federal law, the lesser charged was stayed because you can not be found guilty for the same crime twice. They do both charges so if the receipt for some reason was found not guilty, then they still had the possession. If the verdict for receipt was overturned they still have the possession and thats why it is stayed and not dismissed and that is why he was charged and tried for it. He can not be sentenced on both. The lesser charge will essentially be served with in the larger sentence. Like its engulfed by it. He serves them at the same time. Josh never got a plea deal. Reread the email to his attorney. Thwy said thwy would recommend to the court, based on hitting all the enhancements and everything that happened, a sentence of about 10 years. They went to trial so no such recommendation was made but it was not a plea deal. Josh can't be punished for not accepting a plea. It's his constitutional right to avail himself of the justice system and have a trial with a jury of his peers. His asshat dads behavior can not be held against him. And him not taking the stand can not be held against him. The judge can give him the max of 20 years but ita likely he will see 10 to 12 and thats prob what it will be.
He could be sentenced for both charges individually if the charges have different dates of offense and each charge is for different images/videos. As in, the prosecutor broke it up to ensure he served more time. In that case, it would be up to the Court’s discretion as to whether the two counts ran concurrently or consecutively. If the receiving/possession charges are for the same images/videos then it will be at the Courts discretion as to which charge he will be sentenced on. If the Court wants to be lenient, it will sentence on the possession charge. If the Court wants to ensure he at least serves the 5 year mandatory minimum it will sentence the receiving charge.
I truly hope the evaluation “if done” produces nothing. Those babies are and will be going through enough. The simple fact of who their Parents are when they are older and understand will be plenty. In the overal scheme of things there are already way too many victims. So, hopefully nothing additional is added to any plates. Hoping we can get to sentencing- Josh pays for his crimes and people can begin to move on in a Josh free world (well until he does his time).

The pre-trial reporting will include the exams of the children. Which is why I stated that additional factors could be at play & additional charges could be added at the state level if they determine Josh did anything to his children.

It’s not just Josh and Anna’s children that should be Examined! All the Minors on that property need to be examined and possibly his nieces and nephews who have been in contact with Josh as well. Also, all money or property transferred to a 3rd party will be “clawed back” by the Government!
I completely agree with that! Every single minor (children, siblings, cousins, nieces/nephews) that he has had access to in the past needs to be evaluated. Some of them are adults now, and could reject this evaluation, but everyone who is still a minor should be thoroughly checked.

I am glad that the prosecution is working to get the children evaluated. I am surprised with the severity of the charges that it wasn’t forced in the first place. I hope the kids are “ok” considering everything going on. If something happened to those kids, no only should Anna be charged with child endangerment, but I would love to see charges for Jimbob and Michelle for their enablement.

I don't know what all goes into doing Federal psi's. I used to work for the Department of Corrections for the state I live in. I have done psi's. We woukd look at taking responsibility and remorse. A person that doesn't take responsibility and denies a crime would get a longer sentence. They are a greater risk to community. We would also look at this when they're being released from prison.

I think with Anna what you see is what you get. I don't believe she is a particularly smart woman and I don't think she is at all savvy. If she believes josh was set-up, she probably also thinks that investigators might put words in her kids' mouths and manipulate them. Of course that is ridiculous, but so is believing josh is innocent.

I was floored in the first place, when the court allowed Josh to stay out of jail. Then, it completely blew my mind that she gave him access to the kids. I’m really sorry that Anna is staying with the Duggers. They are masters at manipulation. I believe as time goes by, that Anna will go back and review the facts. One trustee was bringing laundry back to the pedos and he threw a diaper in the laundry cart ( from the visitation room) The inmate complained and the trustee had to spend 3 MONTHS in solitary confinement! They are SO PROTECTED and the biggest tattle tails. Quite ironic wouldn’t you say!? Nobody protected the children they harmed. So sick and sad 😞

They should not have had a choice about having the kids examined. There's no reason for the delay. If there's something to know, the court should consider it for sentencing. If not, fantastic. But if anything happened the kiddos should be put into (non-church) counseling. It helps. My grandbaby saw his biological father hit his gf and then started hitting. He was put into child counseling and it worked. Not exactly the same, but my point is, kids are receptive listeners. It could help them.

Hopefully her kids are honest and are not coerced into “forgetting” or lying during the evaluation. It wouldn’t be the first time a parent scared a child into lying. Forensic evals with kids can be incredibly difficult, as kids’ memories are not as accurate all the time, and due to being susceptible to being led in questioning if there’s not enough objectivity. It’s a very complex and fragile task. (Psychologist who does child rivals here!)
I’m sure those kids will be coached to the hilt by JB, Shelly and Anna.
These sorts of therapist and social workers can spot coaching pretty easily. Maybe not with a teen but certainly with children. I think coaching will make them
look more guilty

I believe here in the U.K. that there would have been absolutely no choice of the kids having to go through some kind of screening and checking forensically and cognitively I think that certainly as soon as Josh was found guilty this would have been done automatically by our child protection services and yes I do believe that this should happen without a doubt. I really don’t understand Anna “declining” protective services. Does Arkansas have a law about parental consent for these exams? I am in Nevada… if there is ANY report, or concern, CPS with the police backup, can go and remove the child from the hom. If nothing is found they go back, but their (parental) permission… absolutely not!
They’ve been known to do that in Michigan too. A friend of mine had her kids taken away for over a year because she stayed. She had to do parenting classes, get a divorce, a ppo, and a bunch of other stuff before dhs would even consider giving her custody
As a parent, I would want to know the truth.
She declined because they don't trust the government and she didn't have to allow them to interview her kids. It can disturb kids and they don't know what they will be asked.
Even if they force them, the ones that can evade questions will be prepped to answer in certain ways. I know someone living in a bad situation and CPS came and the parents told their daughter not to talk to the Social Worker.
Nothing was done. Right now, the mother was finally arrested after her daughter talked to her teacher. The SW called and spoke to tell the mom what her daughter said. Eventually the mom attacked dad and is not allowed to go in the house without police. When more SWs came the other SW got into trouble and the mom finally got charged. The dad was told they could come in for an inspection at anytime and if he is drunk, his daughter is going into care. I hope that the kids get interviewed though.

If they wouldn't have been able to confirm films had been uploaded as well, they would have removed them immediately. It's so sad why those child are about the go through with physical exam. Anna has many of the markers of someone with serious trauma. A normal brain and body would never do what she's done.
It's my understanding that now that he's convicted, CPS will follow up with all the children independent to assure they have stayed safe and will stay safe.

How has Anna been caring for her NEWBORN when she’s been in court every day? I’m assuming she wasn’t able to nurse (I didn’t see her wearing any clothing which would facilitate pumping) and she’s essentially been gone for over a third of her little life. One more example of how their cult teaches women to place the needs of a HUSBAND *over* those of her children. At this point, I am beginning to think that if the court told Anna tomorrow that she could go live with Josh in some weird conjugal prison IF she gives up her kids…we’d see nothing but the heels of her mule slippers after “gifting” Jana with the children.

Not defending Anna. But I keep seeing so many people saying, "She knew the truth about him and his sisters and married him anyway." I think that at that time she was probably told the version of 'the truth' that the girls were told...only touching over the clothes and only once. The sentence is up to 20 years. He will serve at least 86% of that time before being released. That time won't be classified as parole. It will be more restrictive and will include include wearing an ankle bracelet at all times. Josh will have been asked for content before being given access to deep content. It makes sense that he would have used his children. Anna needs to allow her kids to be examined. She could well be charged if any of the kids were abused. Jim Bob should also be charged with lying to court.
The sentence hasn't been determined yet. The crime he committed has a POTENTIAL of imposing a maximum of 20 years for each count. Josh was found guilty of 2 counts. So he faces a maximum of 40 years in prison.
Anna no longer has a choice about her children being examined. They will come to the door with a court order and take them. No family members will be allowed to be present at these examinations. Their choices have made it worse for the kids.

Windowless house is creepy enough. I hope and pray that Josh did not harm his own kids, but given we were told far less than the truth about what Joshy did to his sisters (Touching while reading a Bible story??), sadly, nothing wills surprise me. Admittedly, he was reading from a script, but in one of the early specials he had to say "I'm kind of a video nut..." That now creeps me out. I want those children to just have a creepy Dad, not to have been "used" in any way by his creepiness.

Arkansas DHS usually doesn't charge people when their kid gets loose once (I have experience with this 😳). I believe this is not the first time it has happened that children wandered off from that house.
DHS is not prosecuting. She has to show to court for the citation she received.
I just hope someone is looking out for the kids, and it is clear that in this family no adult has ever been looking out for the kids.

Like so many others who are Christians I would beg that no one judges other denominations of the Christian faith by the standards and teachings of this " faith "" group because they are not of this way of thinking.
Can I please ask those who believe in the power of prayer pray for those damaged by the actions and attitudes displayed by the characters of this case. The fact that they took photos of his hands and then Josh’s team tried to have that suppressed…. That doesn’t bode well, for the argument that he wasn’t making content. They aren’t going to just take a picture of someone’s hands.

The hand pictures the Feds took has been confusing to me. I imagined it was proof he was sitting at his desk, hands on the keyboard, watching the downloaded content. Was there ever any mention of his hands identifying him? Why wouldn’t they investigate him for uploading content prior to trial? It makes no sense for there not to have been a full investigation.
If they had videos that he made, he would have been charged with that already.

Oh thank goodness, I said that from the get go, those kid's have been in danger this whole time considering the fact that Anna does not believe Josh is GUILTY OF ANYTHING therefore has never bothered to worry about her children when she was not around even after his conviction by Judge and jury she claims he's innocent and willing to stand by her man so so happy to hear this news.
I pray these kids get a proper evaluation from a well-trained, compassionate professional. And I pray that they are able establish the truth beyond a reasonable doubt, whatever the truth is. They need to know. The family needs to know.

I hope they also do that for his youngest siblings. Considering what he did with Joy-Anna and there are clips of other children in his parents house sitting in his lap and they should check jessas children.
I think Anna just loves her nasty husband and will follow him to the ends of the earth. She will never believe anything bad about him even if it happens in front of her eyes. I also think they will give him enough time in jail until his new baby is close to being grown.

I think Anna got the full dose and truth in court for a few days. Her only hope was the spoke person by the defense about the computer then that was shot full of holes. Anna knew Josh had issues she knew it when she married him, after Ashley Madison and his sister's she had to know he was not going to stop. Anna is coaching the kids to not disclose anything. She is an enabler. She’s not as innocent as people think. No way did Josh not touch his kids, and no way Anna didn’t know. It’s just the beginning. I think if he physically harmed children it most likely wouldn’t be his own but rather a niece or nephew so I agree with the sentiments that all children in that family need to be evaluated which is so heartbreaking because that’s a devastating life experience no children should have to go through.
He would most likely do it to his own children to be honest. He doesn't strike me as the kind of guy who is good with kids and the one who is always down on the ground hanging out with the kids, being hands on and building relationships in order to groom He seems like the type who will take what he can get, where he can get it where no one is watching him: at home...when Anna is busy...as a ploy of being a good Dad, manipulating his kids into stuff.

In federal law, the lesser charged was stayed because you can not be found guilty for the same crime twice. They do both charges so if the receipt for some reason was found not guilty, then they still had the possession. If the verdict for receipt was overturned they still have the possession and thats why it is stayed and not dismissed and that is why he was charged and tried for it. He can not be sentenced on both. The lesser charge will essentially be served with in the larger sentence. Like its engulfed by it. He serves them at the same time. Josh never got a plea deal. Reread the email to his attorney. Thwy said thwy would recommend to the court, based on hitting all the enhancements and everything that happened, a sentence of about 10 years. They went to trial so no such recommendation was made but it was not a plea deal. Josh can't be punished for not accepting a plea. It's his constitutional right to avail himself of the justice system and have a trial with a jury of his peers. His asshat dads behavior can not be held against him. And him not taking the stand can not be held against him. The judge can give him the max of 20 years but ita likely he will see 10 to 12 and thats prob what it will be.

He could be sentenced for both charges individually if the charges have different dates of offense and each charge is for different images/videos. As in, the prosecutor broke it up to ensure he served more time. In that case, it would be up to the Court’s discretion as to whether the two counts ran concurrently or consecutively. If the receiving/possession charges are for the same images/videos then it will be at the Courts discretion as to which charge he will be sentenced on. If the Court wants to be lenient, it will sentence on the possession charge. If the Court wants to ensure he at least serves the 5 year mandatory minimum it will sentence the receiving charge.
I don't think so. Judge Brooks will probably give him 25.
I truly hope the evaluation “if done” produces nothing. Those babies are and will be going through enough. The simple fact of who their Parents are when they are older and understand will be plenty. In the overal scheme of things there are already way too many victims. So, hopefully nothing additional is added to any plates. Hoping we can get to sentencing- Josh pays for his crimes and people can begin to move on in a Josh free world (well until he does his time).
