O 39 rule 4 simply talked about that a injunction order can be set aside by aggrieved party on moving an application for set aside it's order, If the party in whose a favour the injunction order has been passesd, has taken by misrepresentation of fact or by misleading TGE court, then court may set aside the order. If the circumstances are changed in which court believe that it's necessary to change or varied it's order, then court may do that

Sir Court of 1st instance means the court which passes decree first not where suit was filed originally.

Only the court which at the time of making the application for execution has the jurisdiction to entertain the case, can execute the decree
