HOS Adverse Driving Condition

The change to the adverse driving provision is intended to make its use more advantageous by allowing the driving window, instead of just driving time, to be increased by two hours. The final rule also modified the definition of “adverse driving” so that the exception may be applied based on the driver’s knowledge of the conditions before being dispatched, rather than just the dispatcher’s knowledge. The definition includes unforeseen traffic conditions, as well as weather conditions.
