      As explained in the video, the judge has no immunity from prosecution in this case. The minor was not a party to a case in the courtroom, and was not an officer of the court. The minor was on a FIELD TRIP. The officer(s) that placed the handcuffs on her followed an unlawful order and made an unlawful arrest. Those officers don't have immunity, either.

    As far as a bailiff putting the cuffs on based on the order of the judge. I recall a huge trial where "just following orders" wasn't a defense .

      You know,though,thst it would be damn hard to not follow those orders. He would be fired for it,wrong or right. So bailiff is screwed either way. Not trying to defend the court officers but understanding thats a "in between a rock and hard place" situation.

      I think when the judge admitted he was doing "his own version of scared straight" or whatever, that's telling. He absolutely should have known what he was doing was over the line.
      Knowing he did this mock trial like this makes it worse! I wouldn't be surprised if most all of the students there WERE scared as hell by what was going on... THE WHOLE CLASS should sue the hell out of the judge for how fed up this was. He WAS TRYING to scare the hell out of ALL OF THEM, just because this one person was drowsy, because he's an fing nutjob and needs to be in jail for this gross an abuse of authority. This should qualify as false arrest and child abuse under threat of violence.
      And that goes for the whole class, because all of them were implicitly threatened with use of force if they did anything other than shut up and comply.
      When it comes to the other court officers, I think that their best defense is to also claim being the victims via intimidation of some sort. Or just abject incompetence and stupidity.

    If the whole mistreatment of this young lady only lasted five minutes, it was still wrong in every way. This was far beyond his authority.

      Whether the situation or mistreatment that this young person endured was one minute, five minutes or one second, it was more than enough to he stripped, handcuffed and placed in a prison uniform. The teen was a guest in the courthouse as part of a field experience.. This was not a Trial

    I am gobsmacked. I had a job at a fast food restaurant when I was 17 years old. I often had to close the restaurant and clean up. This sometimes meant that I would not leave until 1 AM. The alarm clock rang at 6 AM for school. Some days, I would fall asleep on the bus or in class. My point is that a sleepy teenager is not a criminal just because they are sleepy. What this judge did goes well into the realm of criminal behavior. I believe he should be indicted for these crimes.

      I'm pretty sure people fall asleep in courtroom all the time. Unless they have some special duty in the courtroom, the juge have no business to punish them. At most, they can be asked to leave. Falling asleep isn't a crime.

      I’ve had students fall asleep in class and almost always it is due to overwork. Concern should be the first response if kids are falling asleep in class.

      Teens are generally sleepy enough in general, really. If she fell asleep again after being chided once then the judge really is a poor father AND an idiot of a judge. I think he remembered his camera-audience way too well, and forgot that an exhausted girl was his target.

    This is a clear case of an adult, in a position of authority, with tremendous power, emotionally abusing a child.
    This type of abusive behaviour rarely occurs in isolation.
    The child was held against their will, publicly humiliated and their clothing removed.
    Any child that judge has had meaningful contact with needs should be interviewed as a safeguarding measure.

    -malicious prosecution
    -kidnapping

    He's supposedly a judge, so he should get the maximum charges possible, not the opposite.

    As soon as the girl was "taken into custody" being a minor they were to immediately contact the parent of guardian of said child and that alone is a crime and goes against the right of due process with the child. Sooooo many issues and laws broken and human rights violations

    The judge and the bailiff committed a crime. They do not have the authority to do that when court is not in session. They need to go to jail for this.

    Whoever was the official who made her strip down and put on the orange jail jumpsuit would definitely be named in the lawsuit, even as a Jane Doe.
    Talk about emotional damage. Being 15, homeless and on a field trip for school and then ordered to strip and put on a jail suit? Yeah, emotional distress for sure!

      Hopefully the lawsuit wins and she gets a pile of cash. If that can be used to improve her family’s situation then that would be some small modicum of justice. But it wouldn’t actually reverse the harm, or remove the judge.
      It certainly feels like more than a lawsuit needs to happen to the judge and bailiffs.

      She won't. This guy's a judge, which means he's friends with all the judges in town. Even if found guilty, he'll be sentenced to writing an apology and buying her lunch. Have you noticed how nothing ever happens to cops that go up before a judge? It's even less for a judge that goes up before a judge.

    A judge is supposed to interpret the law, not enforce it. That said, I dont believe theres a law against being sleepy. He should be disbarred and face criminal charges.

      He neither interpreted any law, nor did he enforce any. Sleeping is not a crime and the court was not in session and the girl committed no crime. Hence there was absolutely no legal grounds to arrest the girl. Meaning this was a Kidnapping, among many other felony offense. And even the Bailiff can't hide behind "just following orders", if he knew the order to be criminal in nature... and he knew, at least that's what his LEO license tells us.

    I taught school for 30 years. If a child fell asleep, I let them sleep, figuring they must need it. I never allowed that child to be woken unless it was time to go home. Parent would be informed and child would be encouraged to get more sleep. SLEEPING SHOULD NOT BE A PUNISHABLE OFFENSE!

      We need different standards for the law schools... right now they care about grades and test taking. Character needs more power than "academic" agility. The system needs to be about integrity and laws, not power and ego trips.

    "Dressing her in prisoner clothing" is a statement that comes with assumed obvious actions.
    She (a minor) was undressed under supervision.
    She (a minor) was frisked for contraband to avoid self harm.
    These assumptions are implicit for criminals. Those actions are criminal and infringements on constitutional rights to an innocent child.

      You lose certain rights when you are processed in accordance with the law. But since they are claiming these actions were done OUTSIDE the jurisdiction of the court, it was at best a "citizen's arrest"?
      They can't have it both ways. He either acted within his power or without. He's either immune because he was technically conducting official business, or he is a criminal.

    What if she refused or attempted to fight being put in handcuffs? She 100% would have been charged with at the very least contempt of court.
    They may not be able to remove the judge from the bench over this, but whomever put the cuffs on her needs to be fired. You have a right to refuse orders that are unconstitutional.
    The worst part of this, in my opinion, is making her change into jail clothes. Its all bad, but if she just had to put the jail OVER her clothes that not nearly as bad as forcing 15 year old to strip and put on a jail uniform. I would be furious if this happened to my kid without being forced to put on a jail uniform. I would be out for blood if they were forced to strip. Absolutely disgusting.

    The fact that she was stripped alone goes beyond scaring her straight. Handcuffs alone are would be enough to scare a teen to think "This is real" but to make her expose herself to a stranger for no reason goes beyond invasion of privacy. He way overstepped his power and authority, given the non-seriousness of the situation. What he did was more or less for show on RUclips and for a judge in a courtroom where no proceeding was in session, that's completely unacceptable.
    For the teen I wish I could tell her that what happened to her wasn't normal and the judge was wrong. She was an innocent bystander and did nothing wrong, she wasn't on trial for anything and there was no reason for her to be treated like that. I'm not sure but I think maybe the supervisor of that judge should speak to her personally, explaining what is/isn't normal for a judge and how people like herself in her position should been treated. She was there to get an idea of how courts work and function, not to be treated as a criminal.

    This judge isn’t hamming it up for the camera, he is just egotistical. She was falling asleep because she’s homeless and was tired. She is an excellent student, and her mom signed her up for the program so that her daughter could have something productive to do.
    Even with some of the court officer this judge has been very nasty and demanding on zoom that they come to the court when the docket was being discussed. The attorney refused to come until the docket was clear and also told him that he wasn’t going to be disrespectful to her. He kept interrupted her and he said “When I am talking you stop.” She said “I will not when I am talking and you won’t talk to me like this”.

      I think the original comment in this video is better interpreted as camera = live stream vs security camera? The presence of the live stream does complicate things in both directions imo. The media is able to move faster, in theory more people can see and call out injustice. But there's also the performance aspect the lawsuit is accusing him of. If his small group of regular viewers self-select into an echo chamber (ex: over minor disagreements in how he does stuff), it could normalize problems over time (in the minds of both judge and viewer), and it could get slowly worse until a harder line is crossed. I think the live streams are more good than bad, but since I also consume the content as entertainment it's hard for me to know if I'm being objective about it... I suppose the issue should be discussed in ongoing ethics education? (sorry tldr)

    Get rid of Qualified Immunity and hiring ex-military who are underqualified who have PTSD. The transition from military to civilian life, especially into roles like policing, can be challenging. The skills and mindset that are crucial in a war zone don’t always translate well to community policing, where empathy, de-escalation, and communication are key.

      Judges need to have significant authority to maintain order during court sessions. You definitely don’t want a courtroom turning into a Jerry Springer scene. Imagine if a criminal defendant started threatening the jurors-situations like that require a judge to step in and regain control. One of the ways a judge can do this is by temporarily jailing someone, which can also happen if a witness refuses to answer a question. In that case, you could be jailed until you provide an answer in court or until the trial concludes. With great power comes great responsibility, and in this instance, the judge clearly abused that power.
      Reigning in power is a bit too much, but yes, we need accountability as no one is above the law, not even judges.

      @@IRL_Lore The First Amendment is primarily about free speech (along with freedom of religion and the press, but those aren't relevant here), which means you're allowed to say what you want* without government retaliation. Why the asterisk? Because there are limits, you're not allowed to yell 'fire' in a crowded theater just for fun, and you can't incite violence against others.
      When a witness refuses to answer a question, they remain silent, which is the opposite of speech. Of course, there's the Fifth Amendment, which protects against self-incrimination. But if that’s the reason for remaining silent, the District Attorney (DA) might offer immunity for that specific offense, or at least a much lighter sentence.
      If a witness is uncooperative(legal term is hostile), a judge can order them to answer and might even allow an attorney to lead the witness, which is usually not permitted. This order from the judge is a court order, and you are legally required to follow it. Failing to do so could result in being held in contempt of court. As I mentioned earlier, this could lead to being jailed (in a courthouse cell) until you're willing to answer the questions or until the trial concludes.       Here’s an example I got from a neighbor who is a corporate lawyer but sometimes handles criminal cases. Let’s say you share an apartment with three friends. One night, a friend comes home wearing bloody clothes after a night out. A few days later, an investigator shows up, interviews you, and takes notes. Eventually, the DA issues an arrest warrant for your friend, and you’re listed as a material witness. Wanting to help your friend, you refuse to answer the DA's questions in court. After you’re jailed for not cooperating, the judge might allow the testimony of the investigator who interviewed you earlier. Because you refused to answer questions, hearsay is no longer a defense, meaning the jury will still hear what you said.

    When i was 13 I started falling asleep in class. As it turned out I had narcolepsy which is adolescent onset. My teachers would send me to the office for falling asleep in class. Just for being tired. I was never more tired than when i was a teen in school because you aren't supposed to be getting up that early anyway. The girl should have a sleep study done to see if she might have narcolepsy and if she does she should sue under the ADA as well.

    Wow, I hadn't even thought about the act of kidnapping but that's exactly what he did to this child. Her lawyers should be seeking a criminal conviction against him as well as against the deputies who carried out his criminal orders.

    Remember, the chief judge didn’t appear to think any crime was committed and only wanted “additional” education. I thought being a judge meant you were at the top of your field. Why would you need additional education on right and wrong. This is just so horrible, yet I cannot believe the system will provide any real justice. Sure a law firm will become richer but unless this judge goes to jail then there is my proof that the system is broken. Just ask yourself this question. What if a judge was treated in the same fashion? Would those people not be charged?

    This judge should do jail time for false arrest/imprisonment (minimum) as well as lose his job and license to practice law indefinitely. I hope a jury awards her twice his net worth.

    As a trauma therapist, there are so many problems with this.....
    There is not a single adult involved in this event that **DID NOT** fail this child.
    The US is now worse than a two tiered justice system, and there needs to be a massive overhaul if we want to inspire confidence in the next generation.
