He has to show that there was an agreement between the members of the alleged conspiracy in order to prevail against the public defenders. Public defenders aren’t ordinarily State actors when they are counsel to an indigent defendant in a criminal proceeding...but when they conspire against their client to work with State actors to secure a conviction they are State actors under section 1983. See _Tower v. Glover,_ 467 US 914 - Supreme Court 1984 {We conclude that state public defenders are not immune from liability under § 1983 for intentional misconduct, "under color of" state law, by virtue of alleged conspiratorial action with state officials that deprives their clients of federal rights.} -Tower v. Glover, 467 US 914 - Supreme Court 1984 So there is a possibility that he could prevail on a section 1983 claim. One issue is that he says that a federal judge or magistrate has found that there is no evidence of a conspiracy.

Here in NYC you can't be arrested for a bench warrant if you're already inside of the courthouse because it indicates you're turning yourself in. Once I missed a court date and a detective called me "nicely" tried to get me to meet her outside of the courthouse to "turn myself in". She was late and so I went into the courthouse to the clerk who warned me that the detective was trying to arrest me and gave me a slip to sign assigning a courtroom to go to. After getting assigned a public defender the detective showed up at the court all angry trying to have me forced to leave the courtroom so she could arrest me. The officer of the court informed her that it was not legal to have me removed. With the help of a very awesome public defender I got an ACD for what was a complete B.S. charge of trespassing. It was for walking through the park of a project in Harlem because I had just moved to the neighborhood and rookie police suspected I was there purchasing drugs. I don't do drugs and there were no trespassing signs because it's a public space. Fun times with shady police and detectives.
Many public defenders see themselves as assistant prosecutors, they believe their job is to guide people through the process of pleading guilty regardless of the evidence, and they get really indignant when clients insist on pleading not guilty.
I have personally had this happen to me. My Public Defender, and later my Alternate Defense Counsel, tell me that my problem is that I can't afford a real attorney and that I get what pay for. They both also stated that they were not working on my defense, and that was not their job. This led to my being illegally detained for over 2 1/2 years without a trial and being forced to accept a plea deal under duress with the choice of either accepting their deal or sitting in jail for another 6-10 years without a trial, and if I did somehow manage to get a trial that the state would hand select the jury. I find it very disturbing that they (the government) don't seem to understand or care that people do not trust them, as well as the fact that they disgrace our Country by violating our God and constitutionally given rights.
@@timothyven3740 I did complain about my public defender to the judge, and even tried to get rid of him. Needless to say, he decided that there wasn't. It was about 6 months later when my public defender did the same thing after he tried to get me declared incompetent to proceed a second time where the preciding judge granted that. Then I ended up with another state payed attorney who didn't work for me either, and was allowed to do as he wished and only work on medigation instead of my defense.

What adds fault to the judge was that she knew it was called at 8:45. She called him after the arrest to have it on record he come in late. Before he came back in, they talked about what time to say they called him. They decided to say it was after 9:00. The court secretary even told the judge it was 8:45. In the video, it is clear that this was done maliciously because everyone was laughing about what they did to him, including the judge. I will repeat this. The judge was told it was 8:45 when they called his name but decided to lie about the time. She even asked what time should they say it was. Not what time was it. That is why this man had no chance. He was doomed before he even got there, with all sides ready to lie.

@@constitutionislawofthislan6169 The issue with our justice system is politics and class. The system is not set up for justice. It is set up to punish. Justice and punishment are rarely the same things. Those with the right class, race, political connections, status, ect. They might get justice, but most of the time, there is no middle ground. If the system was set up for justice, it would not make a person go broke to defend himself when innocent. It would not make a person take a plea deal to not die in prison from a sentence that does not fit the crime. That video was just an overt view of how the system is corrupt. I was falsely accused of shoplifting in Salt Lake County, Utah. The public defender tried everything to convince me to take a plea. Making me feel extremely guilty and saying things like “this isn’t like the movies.” She berated me for pleading not guilty as if she thought I was just playing with the system. Their unsaid assumption is everyone who comes to this court is already guilty and you are even worse of a criminal if you have the audacity to ask for a public defender. Her job was to make as much money for the courts. That made me feel so uncomfortable I went out and searched for my own attorney. Also, when called for jury duty, I saw a few of my fellow city employees in the same group. Agreed. And at 10:43AM the prosecutor is the one that first alerts the judge that the defendant is present waiting in the hall. The judge is upset because it's so late, but neither prosecutor nor defense say anything about seeing him earlier. I “won” an ethics complaint against an attorney who failed to file a brief in a case I retained him for. That victory, like most involving lawyers or judges and ordinary citizens, was pyrrhic. The result was dismissal of my case for failure to file that brief. The attorney got a private reprimand. I lost property and any chance of ever recovering because dismissal ensured my case would never be heard. It was a tactic to make a valid claim go away. And when before the judge, my not guilty plea was no well received. Informing me that if found guilty, I risk being deported. I thought this was very odd, given that I'm an American. But I knew to keep my mouth shut, as they weren't in a good mood. It was the strangest proceedings I've experienced. As if I was being rail-roaded by my own defense attorney, that I am paying! The prosecutors were also unreasonable. AND I was also treated to this 8:45am bullshit. Ex-wife didn't show for a family court case, and thus it defaults in my favor. But they decided to wait for her another 10 minutes! Then ruled for her! Trust me, there is something going on behind your back that you assume can't be happening in a court of LAW. The criminal justice system is just one big self-serving racket. Great coverage of this case, and channel! Good luck to everyone seeking justice.
Same bs with me on traffic court .. dodn t even want to look at my prove ( one of it a ghost witness) . All the public defender knew is take plea and raise the voice when dosen t go his way . They didn t show up 2s . 2 weeks later sheriff was looking for 2 families involved in semi scam .. I recognized one of the family. Get this , the victim was a nurse ... she have seen enough of those stories to act atupid . LA is not better then AZ . It s a lot of "conflict of interest "when comes to judge , cop , defender, prosecutor, district attorney etc .. that is already a red flag since everyone eat and bring money in same piggy bank
I was gonna say-- Salt Lake City, Mormons, Hispanic client, racism... Don't bother arguing with me, everybody knows what those self-righteous hypocrites are capable of.
No. His attorney, her assistan, the DA, the bailiff, and the judge ALL knew he was there out in the hallway at 8:45. The DA knew he was there even earlier. He was watching him. The bailiff knew he was there and informed the judge that he was there. And thats when the judge issued the warrant, then intentionally called another case before his so she could run the clock longer so he would appear late. They didnt call his case until 9;45.
It's very disturbing to even hear any authority try to make light of this matter. The legal system in this country should be up in arms about such a travesty. I would have thought it was a crime to actually conspire to do such an act against a client. Those of us , who are just regular American Citizens , once believed that the legal system would never allow such atrocities to go unpunished. Not sure how comforting it is to see , only one decent Lawyer (S Lehto) stand up and call those lawyers out as unethical. It's easy to see why the public is losing faith in the court system.
This is such a clear picture of what really happens when you have a lawyer that does not want to do legal aid or has been assigned by the court and then totally sells you down the river. The DA and the judge should be fired for allowing this to happen.
Nothing surprises me in the legal beagle world any longer. After having my civil rights violated literally nothing surprises me anymore. Sad that this guy got this kind of treatment in America. I hope he gets some justice.🤔🇺🇸❤️
Steve, excellent commentary and analysis. I have an attorney in the family with your integrity and logic. Attorneys who can have integrity and logic are the best whether they're prosecutors or defenders. I hope this guy gets compensated.
I had a public defender coerce me into a plea agreement that has since held me back in life because she didnt think she could represent me at trial and the punishment would be much more severe. I could not afford a lawyer. The one provided me just told me they'd be fucking me at trial. What could I do? This behavior of public defenders does not come at any surprise to me. Public defenders are how the state appears to keep the constitutional rights of the accused while not actually honoring those rights. There are no rights, only privileges granted or denied by government.
The vast majority of court cases are pled. These defense attorneys are exactly like the majority of government officials. Lazy and incompetent with a sense of importance. And the other government officials protect them.
Never say you can't afford a lawyer and expect any tears shed from the masses. Everyone knows that lawyers will let you make payments to then the rest of your life if you have to, or they will accept nearly any kind of collateral. Steve so glad you did this one , when I watched the courtroom video I was stunned . Apparently court appointed attorneys are appointed to force you to take a plea or get thrown under a bus.
Probably, these two lawyers should be disbarred. I cannot imagine a context where these actions would be ok, but maybe they can. If I was the judge, however, I definitely would have scolded the lawyers for not at least allowing their client the time everyone agreed he should have. I would have put their case at the bottom of the docket to give their client more time. There is absolutely no justification for expecting the client to arrive before his court date or for advocating legal action against their client at all. Unless each of them can reliably demonstrate prescience, the client's actual tardiness is irrelevant; they had no way to know whether he would be late TODAY and their presumption of guilt is contrary to our justice system. The bar should not allow offenses this egregious to stand even once.
The problem with putting their case at the bottom of the docket, while it does allow the client more time, it still allows those public defenders to act as defense, when you already know that they have worked against the clients best interest. I don’t know the correct way to handle it, but as the judge, you need to see that he receives proper defense.

Indeed they won't. The system is overtly corrupt.
Amen to that but God is watching n they will have to answer for what they did.. this probably isn’t the first time they have done this
He has to show that there was an agreement between the members of the alleged conspiracy in order to prevail against the public defenders. Public defenders aren’t ordinarily State actors when they are counsel to an indigent defendant in a criminal proceeding...but when they conspire against their client to work with State actors to secure a conviction they are State actors under section 1983.
See _Tower v. Glover,_ 467 US 914 - Supreme Court 1984
{We conclude that state public defenders are not immune from liability under § 1983 for intentional misconduct, "under color of" state law, by virtue of alleged conspiratorial action with state officials that deprives their clients of federal rights.}
-Tower v. Glover, 467 US 914 - Supreme Court 1984
So there is a possibility that he could prevail on a section 1983 claim.

Wow that's crazy. We get bogus charges out in the sticks like that too... the crazy cop that was plotting against you is really really weird.
Hats off to that clerk

As you're driving down the main street of the county seat (Angelina, for those who want to know) every single light is timed to make you stop. And they have highly visible signs hanging from the traffic lights that say "we enforce that speed limit" or something like that, giving the impression 1 mph over will get you a ticket. And the lights are set to where IF you go one mile over, you will make every single one of those traffic lights!
Even worse?
During the daytime you can often find police cars with an officer holding a radar gun outside the window in the middle of those intersections parked directly under those traffic lights!!!!
And the speed limit there is 25 mph. It drives me crazy going through that town because the speed limit is 70 mph at the border entering the town,, then drops to 55 mph and then 40 before it gets to that 25. And the signs are placed too close together for you to just take your foot off the accelerator and coast down to the slower speed; you have to use your brakes.
It's the definition of a speed trap!
@@samjordan8800 "And the signs are placed too close together for you to just take your foot off the accelerator and coast down to the slower speed"
There are a number of federal laws on the books about that kind of thing specifically _BECAUSE_ towns were breaching safety guidelines to milk "speeders" from out of state
Notifying the DOT about such setups should get a federal investigators checking things out - and if they find evidence of wrongdoing the town will be forced to void the tickets & disgorge the income

@@jasonpatterson8091 I've seen them in action, overworked, caseload so heave that you'd need a forklift, plus they don't give a damn.Look at the last part of my post. PD work for the system trying to prosecute you..
@@dejonsmall9886 Do you think I can't read three whole sentences or something? You sat on a single jury and thus are now an expert on public defenders?
Very often the PDs are top of class graduates getting experience before becoming private attorneys
@@nicolasraage More often they are bottom of the class barely-graduated who can't get a job at a regular law firm, so they are stuck working for the employer with the lowest performance requirements.
Hopefully they get disbarred. The judge seems sensible to immediately recuse himself/herself from the case, but absolutely should have known better, and should definitely bare responsibility. After all, it wasn't the corrupt lawyers that issued the warrant.
Are you kidding? It's 2021, all they have to do is get a lgbtq activist to back them up and they'll be heroes.

Thank you for allowing me to reconfirm things I've forgotten. Learn new legal ideas.( in Michigan),and especially federal cases such as Tyson Timbs!

I’m a retired Palm Beach County Prosecutor and Judge and fortunately, my experience with the Public Defender’s Office is that they do an excellent job for their clients here in Palm Beach County. As a Judge, I always waited until the end of the docket before issuing bench warrants for those who failed to appear.
Bull
@@Simonofcalifornia There were attorneys that were much more effective than the average Public Defender, but you pay quite a lot for these. Many such private attorneys started out as Public Defenders or Prosecutors, even. But Public Defenders, as a rule, we’re quite young, but competent and the ones whom I knew would never sell out their clients like these did. At least, I hope that they wouldn’t.
Since he plead guilty under severe duress wouldn't that original charge be dismissed?
Thank you so much for doing this story. I watched the video and it made me sick to my stomach.
Love it when Steve gets REALLY passionate
Wow! I’ve never thought an attorney should spend time in jail for misconduct before but that’s an appropriate thing for these defenders. 2 weeks in jail is fair
Those attorneys should be arrested, JAILED, convicted, and JAILED again for this behavior!
Like to put people in jail? Check.
Don't care about ethics? Check.
Surprised they aren't prosecutors.
Glad you caught this, the video was in my mentions last night. Thanks Steve.
A verse from Alice’s Restaurant comes to mind, “what are you in for kid?” “Littering (seven minuets late)”
Anyone who's late even to a single minuet should be beaten severely; miss 7 and the ghosts of Bach, Brahms and Mozart will show up and stomp the poop outta you...

Sounds like my days going to Catholic school back in the 1950's when corporal punishment was still OK.
@@davidbates7429 I'm making a joke about the OPs accidental use of "minuet" instead of "minute." But for a fact, Bach was known to pile drive late comers to his performance, straight into the orchestra pit, where they would then by chained to a hat drum - forevermore a slave.
And don't get me started on Mozart... All that BDSM stuff he'd do to the late - on stage and with the full approval of the polezi - makes me sick to my stomach. Just imagine the places a flute can be inserted in you try hard enough... Then imagine the horrible noise made by the byproducts of digestion... Lemme tell you, it was a real sh1t-show...
"Your honor I can't tell a lie. I put that letter on the bottom of that pile of garbage."

It's Utah, his name is Sanchez. Every single other person involved is white. Somehow there was no recording of the incident and he has not only the prosecution, but his own attorneys doing everything they can to get him to plead out.
Then you get prosecutors and his own attorneys sitting together and talking about getting a warrant on him and locking him up to try and put pressure on him to plead guilty and get off of the case.
There should be three attorneys in a cell and disbarred.
Oh, and the BIGGEST problem, that lawyer that sat there silent later is now working for the Utah AG office as a civil rights attorney.
Sounds about right....
This whole fucking country is a legal shit show, and anything short of it full reformation fails everyone

Knock it off with race-based crap, this happens to a lot of people including whites.
@@glee21012 yes it does but to get these POS out of the court system that will play into it as i said in another post all the court footage needs to be looked at and see if there is a pateren and find anyone else who have been wronged by the defence the pro. and the judge and dont be surprised that it leans to other then white people with this group they are working togather

Thank you Steve for your insight on this one.
I am so interested in this case! The attorney client relationship is so important I feel like you should be able to trust them as much or more than a parent. This situation needs rectified cannot wait for updates. Thanks for the good work
Glad more channels are picking this up, we need calls and emails to make sure there is justice.
