      Some people end up in Jail because they're of no fixed abode . . . because they can't get an income and can't afford their own home. . . police arrest them and then they wind in jail because they be bailed anywhere. . . it is not a simple matter of good v bad.

      Yes, the Maori All Blacks have an interesting history. I don't know if you remember this but many years ago they were denied access to South Africa because they were a team selected based on race. But here's the kicker...

    Criminals are not 'impacted'. They are responsible for choosing actions.
    The people 'impacted' are the victims who were robbed or harmed in some way by a victimiser. To lessen the impact of malicious people on others we have laws.
    Laws are only relevant if they are enforced.

    Yes... but it does specifically identify Maori - as if they are particularly identified, focused... and the choice of wording is important (as a lawyer she should know this) and is deliberate. And the further discussion of the particular case regarding Maori backs up the idea of there being a focus. Pls don't treat us like fools bc we have EXPERIENCED this bias again, and again... this lady is as biased as the SG's deliberation. Incidentally, this lady talks about Maori as if they are half-wits and don't understand consequences --- her low expectations of Maori is, frankly, racist!

    All we (Julila and team) are saying is that Maori get special treatment, that prosecutors will be chilled in how they handle Maori alleged offenders, they will have to prove that they have paid special attention to the needs of Maori alleged offenders, while the rest of us have to live with the consequences of ram-raids, gangs, drugs, violence etc. All of this masks the most fundamental question of all - why do more Maori proportionately offend than any other group in society??? Blaming the justice system is just a cop out - what are the real causes of Maori offending in greater number?? Don't distort the justice system; Maori leaders need to step up and take responsibility to help their people create better, safer, healthy lives instead of pushing grievance demands for preferential discriminatory treatment.

      It appears so, Una Jagose herself specifically called them out as needing special rights, like they are inherently criminal by nature and breeding, so need to be treated with special guidelines in order to take into account their negative inherent traits. Does she really believe this? Does she believe Maori are inferior?
      It's obvious she doesn't believe they're equal, or she would mot have made that special provision.
      Quite disturbing really, especially for Maori who actually believe they are all just NZ's like the rest of us.

    Language is important. One thing that has always seemed stupid to me is when a person is judged "not guilty of murder with/for reasons of insanity." Shouldn't it be?"found guilty of murder but with reason of insanity. After all, the victim is still dead. My point is the same here ,it matters not one jot to the victim of a crime that the person committing that crime on them is Maori,white,Asian, pacific Island or anything else and giving a lesser sentence because of it gives the very real impression that the crime didn't really matter that there personal harm doesn't matter, only the poor criminal matters.

      Murder is a crime of intent, which is a state of mind and requires the ability to distinguish between right and wrong. The idea is that the minds of young children and people suffering from severe insanity do not allow them to differentiate, so they can't be found guilty of murder.

    Good to hear the Maori law side of the argument. Transparency discussion and debate is a cornerstone of a democracy. Shame about the main media and their selective journalism. People should weigh up the facts before they form an opinion. There are clearly somw deep rooted beliefs in this whole Treaty principles and Waitangi debate. Plus now this perception of public servants deliberately disobeying government policy in creating racist privilege.
    New Zealand must have a respectful debate as this festering sore will only get worse.
    The he puapua aganda of Jacinda seems to be embedded in the public service where least expected. This must be identified reviewed and dealt with appropriately

    From this brief discussion it appears that anyone considered to be on the spectrum of the disadvantaged is to be treated differently. My question is who is the arbiter of such, what scale would be used and what safeguards against abuse… Without knowing this the public will continue to lose trust in the justice system.

    It is the values in the home that children are bought up with that impact on the lives of the children.
    You must go to the cause and deal with that (upbringing), rather than fluff around with the effect (offending).
    Giving weaker sentences will not stop reoffending.
    And you cannot rehabilitate anyone until they are prepared to change their ways.
    It takes a concerted effort by the extended family (and community) to stop offending.
    Paying lip service and or turning a blind eye to it will not make it happen.
    This sounds like another bandaid that will cause more festering of the wound.

    Wow Michael Laws ran rings around this lady. The LAW is not so arbitary tool in the bag of tools available to the courts, it is the Specified rules of judegement for a particular crime not a particular individual. The individual has broken the 'rule' and must face the consequences. How the consequence is tempered to an individuals specific circumstances, impairment or race is not a consideration for the courts but for those tasked with applying the consequence. As Mike Laws said the corrections, social services etc and other 'corrections or rehabilitation providers, but certainly not the opinion of the judge or jury whe prosecute the crime according the Law.

    Two tier policing.
    Uk has it for African/Middle eastern immigrants vs native white citizens.
    The US has it for black Americans vs non black Americans.
    Evidence suggests it results in higher crime rates in those pampered groups.
    Jump back 60 years ago and those minorities were law abiding citizens, educated, owned their own homes and businesses, had fathers in the household, had respect for themselves and others.
    Then Labour and the democrats changed that.
    Told minorities that they were second class citizens due to racism.
    And told women of minority groups that they would be paid money to have children as long as the father wasn’t around.
    Fact ; receiving a lesser punishment is a reward within itself.
    Let’s reward the offenders.
    And if you don’t agree you will be punished for being racist etc.
    Forget progressiveness.
    Let’s turn back the clock to normality.

    What is she talking about.
    If someone commits a crime the should be prosecuted if there is sufficient evidence. If there are extenuating circumstances that would be taken into account at sentencing, if at all.
    Otherwise the net result is suddenly all the criminals will suddenly start identifying with 'affected' groups.

    NZ has had a one stop shop system for decades and clearly it hasn’t worked. Given NZ has a low income work force and a large proportion of its society isn’t sufficiently educated along with one of the most expensive countries to live in most are on the back foot . i would never make excuses for crime but some people are living in bad situations and see very little way out .

    If a certain cultural group comes to the attention of the justice system, racism within the justice system is 1 possible reason. Today, under post modern critical analysis, all over the west, that is the ONLY reason ALLOWED to be assumed. Another likelier possibility is that the attention is warranted. It seems likely to prove a lot more fruitful to pursue the reasons for this, particularly if no concrete examples of systemic racism can be produced.

    Think the real issue is revolving door some have 100 convictions like the free accom food electric no bills free medical support even pocket money and social welfare ie free clothing . Want to go back in . Real victims staff getting up everyday paying taxes and know whatever do get no where . Lawyers happy crims happy as fully supported only losers taxpayers and workers in these places with assaults poor pay etc
